Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* This site is a wooded 20+ acre site within the Southwind Subdivision. This is a former farm that was subdivided in 2012 into large parcels for homesites. Wetlands and streams were delineated at the time of sub -dividing parcels; all wetlands and streams were recorded on plat map for Chatham County (see attached South Wind Farm Subdivision plat map). Currently the site is a subdivision for single-family homes. 4b. Have Corps permits or DWR certifications been obtained for this project (including all prior phases) in the past? * Yes No Unknown 4f. Explain the purpose of the proposed project: * The landowner plans to build a house near the back of the lot, but needs to cross an intermittent stream to allow his driveway to connect with the house site. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: * Grading of a driveway off of Southwind Road would occur on the parcel. Only one intermittent stream would be crossed and no other stream or wetland disturbances would occur (see attached Site Plan detail sheets). Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Owner originally wanted to locate driveway in area where two intermittent streams would have to be crossed. To avoid a second stream crossing, we relocated the driveway to an area where only one stream would require a culvert crossing. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: We minimized stream impacts during this culvert design by crossing the stream and buffer at a ninety -degree angle. We also used a shorter 20-foot culvert length in conjunction with flared end sections to reduce the length of culvert and transition area needed. We used a scour pool energy dissipater for a more natural approach and a larger culvert size to reduce culvert velocity. 2. Background On April 6, 2022, the United States Supreme Court issued an order staying a lower court's vacatur of the Trump Administration's 2020 "Clean Water Act Section 401 Certification Rule" ("Federal Rule"). As a result of the United States Supreme Court order, the Trump Administration's Federal Rule has sprung back into effect. The Trump Administration's Federal Rule imposes additional procedural requirements on applicants for 401 Certifications and on DWR's processing of those applications. One requirement is that 401 applicants must request a pre -filing meeting request at least 30 days prior to submitting their 401 application. [40 C.F.R. §121.4] In turn, the Federal Rule requires that applicants include documentation of their pre -filing meeting request in their 401 Certification application. [40 C.F.R §121.1; 40 C.F.R. §121.5]. Please refer to the Federal Rule for more information.
