Subject: Effluent Limitations, Cedar Village Apts., Chatham County
We have reviewed the model used to set effluent limitations for Cedar Village
Apartments. The existing limits including the 5 mg/1 BOD5 and 2 mg/1 NH3-N
levels are appropriate for this discharger. The analysis used to set the
limitations is consistent with our knowledge of the receiving streams.
USGS estimates that the 7-day 10-year low flow in the Pokeberry Creek tributary
which receives Cedar Village's wastes is 0 cfs. The drainage area at this point
is 0.15 square miles. Pokeberry Creek 7/10 low flows at the mouth of the UT
and 2 miles downstream are estimated to be 0 cfs as well. USGS has measured
flows on Pokeberry Creek at a station where the drainage area is 12 square
miles. A low flow of 0.04 cfs has been documented at this station.
These data illustrate the limited assimilative capacity available in Pokeberry
Creek. Advanced wastewater treatment is necessary to maintain the 5.0 mg/1
dissolved oxygen standard during critical low flow conditions.

This will acknowledge your letter to me of May 4, 1981, relative to the
effluent limitations assigned for the discharge from Cedar Village Apartments.
The NPDES permit was issued April 29, 1981, with limits of SOD at 5 mg/1 and
ammonia at 2 nag/1. A copy of the permit effluent limitations is attached.
Tour request for further consideration of the stream flow and wasteload allocation
is being referred to Mr. Forrest Westhall, head of the branch which calculates
these allocations, for his raview and response. If Mr. Westhall determines
that some diifferent allocation is appropriate for this discharge, the NPDES
would be amended accordingly.

At the end of January we made application for a discharge permit for a group
of 18 rental houses in Chatham County known as Cedar Village. We have not
received the permit, but you did call us and give us the waste lead alloca-
tions, which include 5 ppm BOD and 2 ppm ammonia. I write you to request for-
mally that these limits be eased, for the reasons stated below.
The present owner of Cedar Village bought the development only about 7 or 8
months ago. The development currently has one very large septic tank and
sand filter, and discharges into a nearby stream. The new owner, Mr. Harold
Williams, at his own volition called the Chatham County Health Department to
check and see if his system was in compliance. The health official informed
Mr. Williams that he would need to contact DEM to get a discharge permit, and
that is when this firm became involved. As you can see, Mr. Williams is very
interested in meeting the regulatory requirements.
Mr. Williams did not build the development or the present treatment system;
the development has been in place for some 5 to 10 years.
The receiving stream is actually the discharge from a lake that is immediate-
ly above the discharge point. This lake is fed by 7 separate springs, and
even in the current warm weather when several lakes and ponds are falling in
level, there is a good strong overflow discharge out of this lake. Perhaps
in computing the wasteload allocations for the receiving stream, the flow -
moderating effect of this lake discharge was not taken into consideration. We
would suggest that in a very high proportion 'of the time there will be a good
source of dilution water in the stream.
To meet the stringent effluent limits that you communicated to us earlier on
the phone, a tertiary wastewater system costing in the neighborhood of $2,000
per house would need to be built. We feel that in this case, because the sit-
uation is existing, because the owner is so very interested in compliance, be-

cause there is a good and fairly steady source of dilution water in the
receiving stream, and because any treatment facilities provided would be
an improvement, the Division of Environmental Management would be justi-
fied in raising the effluent limits somewhat to put the treatment scheme
into the category of secondary treatment. We thank you for your attention
to this matter, and we would be very pleased to discuss this with you fur-
ther.
