Tillery October 3, 2022 Mr. Cheng Zhang Division of Water Resources Raleigh Regional Operations Section 1628 Mail Service Center Raleigh, NC 27699-1628 Subject: Expired NPDES number NC0025721 Town of Weldon Halifax County, NC Dear Mr. Zhang: On September 28, 2022, I phoned Cheng Zhang with Raleigh Regional Office concerning the Town of Weldon's NPDES Permit expired permit and left a message. Mr. Zhang returned my call and I informed him that the Town of Weldon's NPDES permit expired on March 31, 2022. I told Mr. Zhang that on June 9, 2022 one of the wastewater treatment plant operators copied on an email sent to the former Public Utilities Director forwarded the email to me. The email was titled NPDES permit NC0025721 has EXPIRED. This email was from Mr. Charles Weaver. I called Mr. Weaver and advised that the Town of Weldon will be submitting a permit renewal application (forwarded email to Mr. Zhang). I ask Mr. Weaver if he could send me a copy of Weldon's Final permit to which Mr. Weaver sent me a link to download. On June 24, 2022 the town submitted an NPDES permit renewal application. On June 28, 2022 the return receipt was signed for. I told Mr. Zhang that all the wastewater treatment plant had was a draft permit dated August 22, 2018 and thought the permit would expire on August 31, 2023. I advised Mr. Zhang that I received an email on September 22, 2022 from Mr. Nick Coco advising that I had completed and submitted the wrong application and that I needed to complete and submit the correct application. I advised Mr. Zhang that I have never noticed the expiration date on the eMORs prior to the permit expiration. I also advised Mr. Zhang that since the "state" notified the Town I wasn't sure if I needed to notify the Raleigh Regional Office and that since BIMs flags non-compliance it would have flagged this. I also advised that the town failed to comply with Part I; A.(3) Additional Toxicity Testing Requirements for Municipal Permit Renewal, Section B. General Conditions; Item 10 — Expiration of Permit and Section E. Reporting Requirements; Item 9 — Noncompliance Notification. Mr. Zhang advised that I need to contact Ms. Cindy Moore with the Aquatic Toxicology Branch to discuss the second species permit renewal requirement. I have contacted Ms. Moore and scheduled second species testing per her directions (2 species testing October 2022 and January 2023 and regular testing (fathead minnow) November and December 2022). I have completed as much of the correct NPDES application as I can and forwarded the application to the town's consulting engineer for completion. I have forwarded all email correspondence from/with the different department of the state to Mr. Zhang. Should you have any questions or comments concerning this matter, please let me know.
