Dear Mr. Harwood:
Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15,
2007 (or as subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental permit that may be required.

In compliance with the provisions of North Carolina General Statute 143-215.1, other
lawful standards and regulations promulgated and adopted by the North Carolina
Environmental Management Commission, and the Federal Water Pollution Control Act, as

Hawthorne Subdivision WWTP

to receiving waters designated as Upper Barton Creek in the Neuse River Basin in

Parts I, II, III and IV hereof.
This permit shall become effective April 1, 2008.
This permit and authorization to discharge shall expire at midnight on January 31, 2013.

of this permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the
exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements,

2. Total Residual Chlorine limits and monitoring requirements apply only if chlorine is used in the treatment
process. See Special Condition A. (4) for instructions should the facility's permitted UV disinfection system
fail and an alternate means of disinfection is required.
3. The daily average Dissolved Oxygen effluent concentration shall not be less than 5.0 mg/L.
4. The quarterly average for Total Phosphorus shall be the average of composite samples collected during each
calendar quarter (January -March, April -June, July -September, October -December).
5. TN Load is the mass quantity of Total Nitrogen discharged in a given period of time. See Special Condition
A. (2), Calculation of TN Loads.
6. For a given wastewater sample, TN = TKN + NO2-N + NO3-N, where TN is Total Nitrogen, TKN is Total
Kjeldahl Nitrogen, and NO3-N and NO2-N are Nitrate and Nitrite Nitrogen, respectively.
7. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units (s.u.).
There shall be no discharge of floating solids or visible foam in other than trace amounts.
A. (2.) CALCULATION OF TOTAL NITROGEN LOADS
a. The permittee shall calculate monthly and annual TN Loads as follows:
i. Monthly TN Load (lb/month) = TN x TMF x 8.34
Where:
TN = average TN concentration (mglL) of the composite samples collected during the month
TMF = Total Monthly Row of wastewater discharged during the month (MG/month)
8.34 = conversion factor, from (mg/L x MG) to pounds
ii. Annual TN Load (lb/year) = Sum of the 12 Monthly TN Loads for the
calendar year
b. The permittee shall report monthly Total Nitrogen results (mg/L and lb/month) in the
discharge monitoring report for that month and shall report each year's annual
results (lb/year) in the December report for that year.
A. (3.) TOTAL NITROGEN ALLOCATIONS
a. The following table lists the Total Nitrogen (TN) allocation(s) assigned to, acquired by, or
transferred to the permittee in accordance with the Neuse River nutrient management rule (T15A
NCAC 02B .0234) and the status of each as of permit issuance. For compliance purposes, this
table does not supercede any TN limit(s) established elsewhere in this permit or in the NPDES
permit of a compliance association of which the permittee is a co-permittee member.

A. (4.) TEMPORARY MEANS OF DISINFECTION
In the event that the wastewater treatment plant's ultraviolet (UV) disinfection system
should fail, under -perform, or otherwise be removed from effective service, the permittee or
his agent should immediately inform the Surface Water Protection Section staff of the
Raleigh Regional Office (919/791-4200) of this development and discuss temporary,
alternate means for disinfection of the effluent.
If chlorine compounds are used as temporary means of disinfection, the Total Residual
Chlorine (TRC) concentration of the effluent must be monitored and reported on the
Discharge Monitoring Report.
Use of a disinfection system other than the permitted UV system during circumstances not
deemed as emergency and/or temporary (replacement of lamps, lamp cleaning or
maintenance, etc.) will be considered a violation of the terms of this permit.

B. DESCRIPTION OF FACILITIES AND WASTE(S) (renewals and modifications only)
1. Describe the existing treatment facility: Since the last pennit renewal, this WWTP has been expanded
to 0.250 MGD. The current system is as follows: influent pump station, chemical phosphorus removal,
flow equalization basin, dual 0.089 MGD extended aeration treatment plants, dual 0.036 MGD
extended aeration treatment plants, four (not three as indicated in application) sludge holding tanks,
post aeration, ultraviolet disinfection, flow meter, and standby power. The underground "effluent
equalization" tank has not been used for years, and thus is not included in the description above. Rocks
are present below the outfall pipe, but the facility does not really have cascade (step) aeration. Post
aeration is provided by blower fed diffusers at the end of each package plant.

3. Does the facility have operational or compliance problems? Please comment: The WWTP generally
produces a high quality effluent. [Note the values listed in the Effluent Data section of the permit
application are the current permit limits not a summary of the effluent monitoring data.] For the period
from 9-2003 through 8-2007 there were four daily max fecal coliform limit violations, one monthly
average NH3-N limit violation (Limit = 4 mg/1; Calculated value = 4.03 mg/1) and three violations of
the quarterly TP limit. No limit violations have been reported in 2007 (through 8/2007).

Current enforcement action(s)): Each of the fecal coliform limit violations resulted in DWQ sending

application. The expiring permit did require completion of a wastewater management plan which my
records indicate was submitted to the NPDES Unit. This system is not close to municipal sewer.

EQ tank have had rust and corrosion damage over the years. The walk way grating over the EQ tank
