Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This final permit includes no major changes from the draft permit sent to you on September 24, 2003:
This permit includes a special condition that requires additional information to be submitted by January 30,
2004. See Part I. A. (5) for details.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
Heater Utilities, Inc. is hereby authorized to:
1. Continue to operate an existing 0. GD wastewater treatment system with the
following components:
> Influent pump station
> Influent equalization basin
> 0.089 MGD extended aeration treatment plant
> Dual 0.036 MGD extended aeration treatment plants

This facility is located north of Leesville at the Hawthorne Subdivision WWTP on
Norwood Road in Wake County.

3. Discharge from said treatment works at the location specified on the attached map

A. (3) CALCULATION OF TOTAL NITROGEN LOADS
a. The Permittee shall calculate monthly and annual TN Loads as follows:
i. Monthly TN Load (pounds/month) = TN x TMF x 8.34
Where:
TN = average TN concentration (mg/L) of the composite samples collected during the month
TMF = Total Monthly Flow of wastewater discharged during the month (MG/month)
8.34 = conversion factor, from (mg/L x MG) to pounds
ii. Annual TN Load (pounds/year) = Sum of the 12 Monthly TN Loads for the
calendar year
b. The.Permittee shall report monthly Total Nitrogen results (mg/L and pounds/month) in
the discharge monitoring report for that month and shall report each year's annual
results (pounds/year) in the December report for that year.
A. (4) ANNUAL LIMITS FOR TOTAL NITROGEN
(a) TN limits for NPDES dischargers in the Neuse River basin are as p 'scribed in the
basin's Nutrient Management Strategy rule for wastewater treatm- t facilities, T15A
NCAC 2B .0234.
(b) The Permittee's TN discharge is governed by this Permit un - ss the Permittee is a
member and co-permittee of an approved compliance associ . • on, in which case its TN
discharge is governed by the association's group NPDES pe • it and the limits therein.
(c) TN limits for NPDES dischargers in the Neuse River b - - in are annual, calendar -year
limits. All such limits in effect on January 1 of a giv n year remain in effect for the
entire calendar year. Changes in TN limits become - ffective on January 1 of the year
following permit modification and remain in effect • r the full year. Similarly, changes in
membership in a compliance association beco ► e effective on January 1 of the year
following the change and remain in effect for . - full year.
(d) For any given calendar year, the Permittee .. all be in compliance with the annual TN
Load limit in this Permit if:
(1) the Permittee's annual TN Load is le than or equal to said limit, or
(2) the Permittee is a Member of a • mpliance association and a Co-Permittee to the
association's group NPDES pe
(e) The Permittee's effective TN limit . any) may change due to changes in its TN allocation
or membership changes in a co • pliance association.
(1) The Permittee may notify e Division and request a modification of this Permit to
incorporate allowable c . nges in its TN Load limit. Allowable changes include those
resulting from pure se of TN allocation from the Wetlands Restoration Fund;
purchase, sale, tr e, or lease of allocation between the Permittee and other
dischargers; regio alization; and other transactions approved by the Division.
(2) If the Permittee ' tends to join or leave a compliance association, the Division must
be notified of the proposed change.
(3) Upon receipt/of timely and proper notification, the Division will modify the affected
permits) a's necessary to incorporate the allowable changes in TN limits or to reflect
the change in membership.
a. The Division must receive notification no later than August 31 for changes
proposed for the following calendar year.

(f) For the purpose of permit compliance, an association's Co-Permittee Members in a
calendar year (and the Permittee's membership status) shall be as defined in its group
NPDES permit. The roster and the members' TN allocations will be updated annually
and in accordance with state and federal program requirements.
(g) The TN monitoring and reporting requirements in this Permit remain in effect until
expiration of this Permit and are not affected by the Permittee's membership in a
compliance association.
A. (5) WASTEW R MANAGEMENT PLAN
No later than January 3 2004 [60 days after the effective date of this permit], the
Permittee shall submit to th - ' 'vision additional information for the wastewater
management plan, requested in • ctober 15, 2002 correspondence. In order for the
Division to complete the evaluatio • f the Wastewater Management Plan, the following
information must be provided:
• The evaluation of alternatives sho . d include the capital cost and annual
operational costs for each alternative nd a present value cost analysis. These
components were not included in the re . ort. Please provide the cost analysis for
20 years for all the alternatives discussed b , the report.
• The communication from the City of Raleigh re:: ding connection to their system
is dated 1997. In recent years, Raleigh has accep • similar facilities. Please
provide recent documentation from the City of Ralei • - garding connection to
the city's system.

I have reviewed the subject draft permit with the following comments. The changes to the
current draft permit are detailed in the cover letter. The RRO supports those changes. The
cover letter states that Weekly Average limits for ammonia have been added. The Limits
page of the subject permit contains Daily Maximum limits for ammonia and does not
stipulate Weekly Average. Since the measurement frequency is Weekly one would /
assume that one sample per week will be taken which would in essence be a Daily
Maximum. Additional sampling within that same week might expose the facility to
additional liability for Daily Maximum violations. Perhaps a Weekly Average column
could be added to the limits page for clarification. The map page of the draft permit gives
the coordinates for the discharge point. When mapped with Topozone the coordinates
plot a different location. A staff report prepared by RRO staff in 1992 supports
coordinates lat 35.56.12 and long 78.43.41. _

On the basis of thorough staff review and application of NC
General Statute 143.21 Public law 92-500 and other lawful
standards and regulations, the North Carolina Environ-
mental Management Commission proposes to Issue a
National pollutant Discharge Elimination System
(NPDES) wastewater discharge permit tothe person(s)

The Carolina Water Systems, Inc. (P.O. Box 240908,
Charlotte, NC 28224) has applied for renewal of NPDES
permit NC0033111 for the Fairfield Harboro Subdivision
WWTP in Craven County. This, permitted facility dis-
charges treated wastewater to the Upper Broad Creek In
the Neuse River Basin. Currently BOD, total nitrogen,
total phosphorus and total residual chlorine are water
quality.timited. This discharge may affect future alloca-
tions in this portion of the Neuse River Basin. .
NPDES Permit Number N00056618, Carolina Water Ser-
vice, Inc. of NC (Carolina pines Estates WWTP) has
applied for a permit renewal for a facility located in
Craven County discharging treated wastewater into the
Neuse River in the Neuse River Basin. Currently, BODS,
ammonia, fecal coliform and total residual chlorine are
water quality limited. Thls discharge may affect future
allocation in this portion of the receiving stream.
NPDES Permit Number NC0056545, City of New Bern
(Trent River WWTP) has applied fora permit renewal for
a facility located in Craven County discharging treated
wastewater into the Trent River in the Neuse River Basin.
Currently, BODS, ammonia, fecal coliform and total
residual chlorine are water quality limited.. This discharge
may affect future allocations in this portion of the receiv-
ing stream.
NPDES Permit Number NC0070084, City of New Bern
(Stately Pines WWTP) has applied for a permit renewal
for a facility located to Craven County discharging treated
wastewater into the Neuse River In the Neuse River Basin.
Currently, BODS, ammonia, fecal coliform and total
residual chlorine are water quality limited. This discharge
may affect future allocations in this portion of the receiv-
ing stream.
NPDES Permit number N00049662, Heater Utilities, Inf.
(Hatvthome Subdivision WWTP) has applied for a permit
renewal for a facility located in Wake County discharging
wastewater into Upper Barton Creek in the Neuse River
Basin. Currently, BODS, ammonia, fecal coliform and and
total residual chlorine are water quality limited. This
discharge may affect future allocations in this portion of
the receiving stream.
NPOES Permit Number NC0060526, Pope industrial park
has applied for a permit renewal for a facility located In
Wake County discharging treated wastewater into an
unnamed tributary MI swift Creek in the Neuse River
Basin. Currently, BOD5, ammonia, fecal coliform and
total residual chlorine are water quality limited. This
discharge may affect future allocations in this portion of
the receiving stream.
McMurry Fabrics, Inc. (NC8023710) has applied for re-
newal of Its NPDES permit discharging to the Roanoke
River within Me (Roanoke River Basin. No discharge
parameters are water quality limited. This effluent may
affect 'future wastewater discharge allocations to this
receiving stream.

I'm about ready to start work on this permit renewal. Looks like they
had a special condition (as a result of public hearing) to submit a
wastewater management plan. They submitted something and it was
returned on 10/15/02 because it was incomplete. To date, we haven't

PART IV - EVALUATION AND RECOMMENDATIONS
_ This system serves several subdivisions within the Bartons Creek basin. Wake County's
local regulations require that all discharges in a Water supply watershed met a quarterly
phosphorous limit of 1.0 mg/I. This facility has .a good compliance record with that
requirement. This system has a very complex collection system that has many pumping
stations. Chemicals for odor control are added at three locations. There are also several
individual step systems tributary to the collection system. The utility company appears to be
doing a good job with operating and maintaining the entire facility. A review of the MR-1
over the last 12 months indicate that the operator;nissed one monthly Nitrogen sample event.
Also, compliance is good overall. One daily fecal coliform limit violation was noted.
A problem noted during the last inspection indicates that the existing parshall flume is not big
enough to accurately measure flows over 200 gpm. A few momentary surges are indicated
on the flow recording above this flow rate. The owner states that the flume will be replaced
when the facility is expanded to .250 MCD.
Please consider TN limits upon expansion. The last permit stated that TN limits would be
required for minor dischargers for the 2003 renewal.
The RRO staff recommends renewal of the permit in accordance with the Noise basin play:

The NPDES Unit has completed a preliminary review of the Wastewater Management Plan submitted by
Heater Utilities for the Hawthorne Subdivision. In order for the Division to complete the evaluation,
please provide the following information:
1. The evaluation of alternatives should include the capital cost and annual operational costs for each
alternative and a present value cost analysis. These components were not included in the report.
Please provide the cost analysis for 20 years for all the alternatives discussed in the report.
2. The communication from the City of Raleigh regarding connection to their system is dated 1997. In
recent years Raleigh has accepted similar facilities. Please provide recent documentation from the
City of Raleigh regarding connection to the city's system.

Facility Description
Heater Utilities operates a wastewater treatment plant at Hawthorne Subdivision in Wake County. Treatment
consists of equalization, three extended aeration plants (one plant at 0.089 MGD and two at 0.039 MGD),
chemical phosphorus removal, ultraviolet disinfection, backup chlorination, and cascade aeration.
Permit Summary
The permit contains phased permit requirements for discharge flows of 0.161 and 0.25 MGD to Upper
Barton Creek.
Until expansion above 0.161 MGD:
• BOD is limited at 16.2 mg/L & 24.3 mg/L (summer & winter monthly averages)
• Ammonia is limited at 2.0 mg/L & 4.0 mg/L (summer & winter monthly averages)
• Total Residual Chlorine is limited at 22 µg/L
• Total Phosphorus is limited to a Quarterly Average of 2.0 mg/L.
After expansion above 0.161 MGD:
• BOD is limited at 16.0 mg/L & 24.0 mg/L (summer & winter monthly averages)

• There have been 8 flow violations in the past 3.5 years.
• The NRF objects to past reductions in limits and monitoring for ammonia nitrogen.
• The permittee has appealed past civil assessments, showing a "blatant disregard" for the water quality
program.
• Permittee failed to submit an EAA by 6/ 1 /96 as required by the current permit.
Jerry Tweed — Heater Utilities
• Admitted to ammonia problems in 1993 & 1994
• Major plant upgrade in 1995 included installation of equalization basin, increased retention time (33
hours), UV disinfection and a SCADA monitoring system.
• Plant has had minimal problems since the upgrade was completed.
DWQ Response and Discussion
• This facility is in good condition. The addition of UV disinfection and a SCADA system are reasons
for confidence in the quality of treatment at the site and the permittee's financial commitment to sound
wastewater treatment.
• Connection to a POTW will not be a viable option for this facility in the near future.
Recommended Action(s)
• Issue the permit with the following special condition:
A. (4.) WASTEWATER MANAGEMENT PLAN
No later than 180 days after the effective date of this permit, the Permittee shall submit to the
Division a wastewater management plan. The plan shall include, at a minimum, the following
elements:
• Future flows. Provide estimates of wastewater flows and characteristics for the next
10-20 years and the basis for those estimates, including assumptions and
calculations.
• Alternatives analysis. Conduct a technical and economic evaluation of wastewater
disposal alternatives, specifically including at least the following alternatives:
• connection to the City of Raleigh wastewater collection system,
• conversion to a spray irrigation system
• implementation of a reuse program
• any combination of the above options
The analysis and report should be consistent with the EAA guidance document
provided by the Division.
