SUBJECT: Consistency Certification Submission Status for the Proposed Impact to Approximately
1.452 acres of wetlands and 3,247 linear feet of a man-made tributary to the Cape Fear
River to Facilitate the Wilmington Beach Street Improvements Project, Town of Carolina
Beach, New Hanover County (DCM#20070088)
Dear Ms. Thomson:
We received the consistency certification of the Soil and Environmental Consultants, PA on behalf of
the Town of Carolina Beach ("Applicant") on September 19, 2007 for proposed impacts to
approximately 1.452 acres of wetlands and 3,247 linear feet of a man-made tributary to the
Cape Fear River to facilitate the implementation of the Wilmington Beach Street
Improvements Project. The site of the proposed project is in various locations in the general
vicinity of the intersection of Ocean Boulevard and Pinfish Lane within Town of Carolina
Beach, New Hanover County, North Carolina.
The submission was filed complete as of September 19, 2007. Pursuant to the requirements of
15 CFR 930.60, the purpose of this letter is to inform the Town of Carolina Beach; Soil and
Environmental Consultants; and the U.S. Army Corps of Engineers (Corps) that the State of North
Carolina has initiated commencement of its Federal consistency review. Please be aware that as we
continue to review this submission that we may develop questions on the proposed project that will
require that Soil and Environmental Consultants respond through the submission of additional
information.
The public review period for this project was initiated on September 21, 2007. The public notice has
been scheduled to be printed on September 23, 2007 in the "Wilmington Star News ". Furthermore,
the project has been distributed to State agencies that would have a regulatory interest in the proposed
activity for review and comment. The public review period will close on October 12, 2007. We
intend to make a decision regarding whether the proposed activity would be consistent with the State's
coastal program soon after. Based on the requirements of 15 CFR 930.62, DCM has until
March 19, 2008 to either concur or object to the consistency certification.

Please note that the Division of Coastal Management does not typically issue a consistency
concurrence decision until the applicant has obtained all other required State permits and/or
pc;r!:tis;ions. '1~'I~-is allows for DCM to review the final project. t}-at may have been modified to
inct~rporate the requirements of the other State agencies. Other required State approvals may inchide,
but are not iimitt~d to, a Section 401 Wa?e,r Quality Ce-tific;ation, an eresion and sediment: control plan,
a stonnwater management plan, and an acceptance of any proposed mitigation by the State's
Ecosystem Enhancement Program (EEP). Before DCM -nakes a final decision on this consistency
determination, all of these approvals, as required, must be obtained. Please forward copies of those
approvals as they are received to DCM. Thank you for your consideration of the North Carolina
Coastal Management Program.
