John,
Kim, Erin and I spoke after our call yesterday regarding the clearing on the property adjacent to the
Wildlands Sandy Branch project. One of the factors that we felt was important is that the clearing
along the upper reaches of UT2, shown on the attached figure you provided, had previously been
identified during our review and approval of Sandy Branch Phase I. During that initial review we
determined that the clearing activity was exempt as an agricultural activity. Now that you have
come in with a new proposal, we want to be consistent with previous determinations; therefore we
will continue to treat the clearing on this reach (UT2, Reach 1 and 2) as exempt for the purposes of
prior permitting requirements should you submit this area as part of a future project (either as a
bank or DMS proposal).
Nevertheless, we still have concerns regarding the recent clearing of a forested buffer along any
reach proposed for mitigation through buffer reestablishment, especially along UT2 Reach 1 in this
case. We agree that the approach you proposed to address this (i.e., enhancement II through buffer
reestablishment along Reach 1 without credit, and Restoration along Reach 2 for credit) would
address these concerns provided that these approaches are determined to be appropriate based on
the conditions of the channel at the time of the IRT's review should this site be included in a future
submittal.

Hey Kim and Erin,
Would you all be up for a half hour zoom (or whatever format) call sometime soon? We proposed
an addition to our Sandy Branch site as a full delivery project recently in the Cape Fear 03. DMS had
some concerns about site clearing in 2007 and other land use changes on the reach we referred to
as UT2. We had forgotten about this but Jeremiah remembered that you (Erin) had commented on
it in the original Sandy Branch Mit Plan and it turns out our response had speculated that this
particular reach might be ephemeral. Understandably, DMS elected to not move forward with the
project. With all that is happening with megaparks in that basin, we think there will be future
opportunities for full deliveries and we'd like to figure out a way to submit this site that would work
for the IRT. There are some big positives with the site and connectivity to multiple other full
deliveries as well as being in the local watershed planning area.
I have attached a figure of our original submittal. I have also attached your comments in the Sandy
Mit Plan so you don't need to dig for it.
