Date Received by LQS: September 9, 2022 Plan Type: Revised Dear Mr. Hughes: This office has reviewed the subject erosion and sedimentation control plan. We find the plan to be acceptable with modifications and hereby issue this letter of Approval with Modifications. The Modifications Required for Approval are listed on the attached page. This plan approval shall expire three (3) years following the date of approval, if no land -disturbing activity has been undertaken, as is required by Title 15A NCAC 413 .0129. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (eNOI) form requesting a Certificate of Coverage (COC) under the NCGO10000 Construction General Permit. After the form is reviewed and found to be complete, you will receive a link with payment instructions for the $100 annual permit fee. After the fee is processed, you will receive the COC via email. As the Financially Responsible Parry shown on the FRO form submitted for this project, you MUST obtain the COC prior to commencement of any land disturbing activity. The eNOI form may be accessed at deq.nc.gov/NCGOI I. Please direct questions about the eNOI form to the Stormwater Program staff in the Raleigh central office. If the owner/operator of this project changes in the future, the new responsible party must obtain a new COC. The approved E&SC plan as well as any approved deviation. 2. The NCGO1 permit and the COC, once it is received. 3. Records of inspections made during the previous 30 days. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to ensure compliance with the approved plan. North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring protection of existing natural resources and adjoining properties. If, following the commencement of this project, it is determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this office may require revisions to the plan and implementation of the revisions to ensure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to this land - disturbing activity. This approval does not supersede any other permit or approval. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form, which you provided. You are requested to file an amended form if there is any change in the information included on the form. The submitted Financial Responsibility/Ownership Form (FRO) was signed by Mr. David Hughes, Manager, on September 6, 2022. The Limited Liability Company Resolution, conducted on September 13, 2022, approved to provide signature authority to Mr. Hughes on the same day. Therefore, Mr. Hughes did not have legal authority to sign the FRO on 9/6/22 for the corporate entity. Provide a new FRO, with Mr. David Hughes signing the FRO after being given signature authority for the corporate entity. A revised FRO shall be submitted to this office prior to the start of land disturbance activities. 2. The FRO shows Holly Grove Development Partners, LLC as the Financial Responsible entity. Is Holly Grove Development Partners, LLC the developer as well? The cover sheet on the plans shows Carolina Development Services, LLC as the developer. Ensure the cover sheet references the correct corporate entity that is developing the property. Submit a revised plan cover sheet prior to the start of land disturbance activities. 3. There is grading being shown below the barrel pipe outlet of Basin #3, which has not been shown on prior plan submittals. Refer to the enlarged Sheet C4.2 to view this area in more detail. The LOC and grading are now being shown inside the undisturbed stream buffer. The LOC and grading needs to be located out of the stream buffer. In addition, it is unclear why the outlet protection (below the barrel pipe outlet) ends within a disturbed graded channel. The outlet protection shall be extended to the upper edge of the 20' Vegetated No Build Setback buffer. The portion of channel within the 20' Vegetated No Build Setback buffer shall be stabilized with sod. If sod fails to adequately stabilize the channel, a revised plan shall be submitted showing a sufficient stabilization method. Note: these items will need to be fixed on all of the plan sheets (e.g. all phases), including Sheet C12.9. Revise plans as necessary. Two sets of revised plans shall be submitted to this office prior to the start of land disturbance activities. 4. Provide a copy of the Approval Letter allowing all proposed land disturbance activities located within the 100-yr flood plain as shown on the plans. A copy of the approval letter shall be submitted to this office prior to the start of land disturbance activities. Note: if approval cannot be obtained and/or is altered from what the plans currently show, a revised plan shall be submitted and approved showing any changes that are necessary. The top crest width of the embankment for Basin #3 shall be constructed as shown on Sheet C 12.9 in the initial condition. In addition, the bottom of the basin shall be excavated to Elev. 571.76' per basin Table on Sheet C 12.3.
