The NPDES Unit received your permit renewal application on September 23, 2005. Your permit renewal
application has been assigned to me for review. We do not expect severe delays in processing your permit renewal.
You should receive a draft permit in February2006.
The recent change of facility ownership [from Jefferson Apparel to James R. Vannoy & Sons Construction
Company, Inc.] was documented in the Division's information management system. However, due to an internal
error regarding the status of the permit, no permit modification was sent out. We are therefore sending a modified
permit with this letter, it will be in effect until the permit renewal is issued next year.
The Division understands that the owners wish to retain the permit despite the fact that the facility has not
discharged since 2001. Be aware that the owners are still required to pay an annual fee of $715.00 per year while they
hold the permit, regardless of the facility's discharge status.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked. As of
this permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the
exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements,
terms, and provisions included herein.
James R. Vannoy 85 Sons Construction Company, Inc. is hereby authorized to:

The Jefferson Apparel building is unoccupied and used for storage at this time. There has
been no flow to the WWTP since its purchase by James R. Vannoy & Sons in 2001. The
plans for this building are to resale.
All aspects of this building are kept current and up to date, should a buyer/business come
in and need to occupy fast. With the permit in force, a minimum time for occupancy
would be established.

On 9/26/2001, Marcia Lieber e-mailed me to ask if anyone had sent in a Name & Ownership
change request for this permit. Jefferson Apparel had returned their annual fee invoice, saying
that the site had been sold "and no longer require the permit". I responded that no one had
requested a name change.
On 9/6/2002, this permit was rescinded. Marcia entered the rescission event. However, I can find
no record of any rescission letter being sent to Jefferson Apparel.
On 2/21/2003, we received a Name & Ownership change request from William E. & James
Vannoy. The request was sent to Central Files, with the note that the permit was rescinded.
On 9/23/2005, we received a renewal application from James R. Vannoy & Sons Construction.
That's how we got here. If there's a valid reason to renew the permit, we can do so.

reinstated?
If the new owners can provide a valid flow justification, we can renew the permit.
If not, we shouldn't. Consider the mess at Staley Hosiery Mills (NC0048241)....
