PROTECT DESCRIPTION: The applicant's project is located at 6702 13`h Avenue, adjacent to Stump Sound, in North Topsail Beach, Onslow County. To find the property,, take Highway 17 North.from Wilmington and travel approximately 20 miles to NC 210 Turn right onto NC210 and travel approximately 2 8 miles to the intersection of NC 50 & NC 210 Turn right onto NC 50 / NC 210 and travel approximately 19 miles to North New River Drive. Turn left onto North New River Drive and travel approximately 5.0 miles before turning left onto 13th Avenue. The project site will be located on the right'hand side of the road, at 6702. The property consists of a single lot with a total area of approximately 5,000 sq ft, with majority of the property consisting of §404 type wetlands. The remainder of-the lot is upland, consisting of wax myrtles and other scrub vegetation. The property is surrounded by residential properties and has no connectivity to any Coastal Wetlands or Estuarine Waters. The applicant received a Notification of Jurisdictional Determination (SAW- 2013 - 01311) from the US Army Corps of Engineers on July 22, 2013.The lot has an average elevation of approximately 3.5' above Normal, High Water (NHW) and does not have any water frontage along Stump Sound. The first line of stable, natural vegetation is, located approximately 460,feet toward`the east, as measured from,the eastern most property'line There are no man-made structures currently on the property. The Tong term erosion rate for this, portion of North Topsail Beach,is 2 feet,per year. The 100 -year storm,recession line for this area is 210 feet, creating a total Ocean Erodible Area {OEA) AEC of 260 feet. Although the applicants' property is located outside the OEA, it is located within the High Hazard Flood AEC' as indicated by. zone VE (elevation 11) on the Flood Insurance Rate Maps as°weltas within,575' Coastal Shoreline AEC, whichis located,ofthe normal high water line,associated with Stump Sound (SA -ORW). The waters of 'Stump Sound, adjacent to the project site, are classified as SA- ORW'by the North Carolina Division of Water Quality and are designated as a Primary Nursery °Area (PNA) by the M.C. Division, of Marine Fisheries. According to maps provided by -the Department;of Environmental Health, Shellfish Sanitation Section, the waters in this° area are OPEN to the, harvesting of shellfish The waters of the Atlantic Ocean in the vicinity of the - project area are classified SB by the North Carolina Division of Water Quality The subject property is located within the High Hazard Flood Area, as indicated by Zone VE (elevation 11) on the Flood Insurance Rate Map The High Hazard Flood Area (VE Zone) associated with the subject property is contiguous to the Atlantic Ocean. 10. PROPOSED PROJECT: The applicant proposes to construct a single - family residence with associated §404 type wetland fill. As proposed, approximately 2,904 sq. ft. of §404 wetlands would be filled throughout the lot within the proposed building envelope As proposed, there would not be,encroachment into any coastal wetlands or open water areas. A silt fence would be placed at the limits of disturbance to contain the fill material. The area of the proposed fill has an elevation approximately 18 " -24" lower than the adjacent high ground (uplands) of the upland portion of the lot, as well,as the surrounding properties. The applicant is proposing to raise the elevation of the property another 18" for the construction of a home and strip driveway The proposed dwelling would have a maximum footprint of approximately 24' in width by 3 6' in length. In addition, an 8' x 24' covered deck would be located along the southern side of the residence,and a 6' x 24' uncovered deck would be located along the northern side of the residence. A 3' x S' roof covered porch would hang over the entrance way along the eastern side of the residence. As proposed; the dwelling would be elevated' on pilings with a concrete.slab under the home. The applicant =is proposing to construct a pervious driveway which would extend from the edge of the pavement to the concrete slab under the dwelling. Robert Haag Page Three As described in the application,package, the applicanttproposes to minimize,the impacts within the,wetlands by reducing the size of the dwelling,, reducing the amount of fill within wetlands„ using porous material for the construction of the driveway, and restoring the disturbed area (not being developed) back to� their original condition As,presented, no true "mitigation" plans have been implemented, but it is believed the applicant -has demonstrated a reduction in wetland impacts by the above mentioned activities /development. 1`0. ANTICIPATED IMPACTS: As proposed, the project -Would result in the filling of approximately 2,904 sq ft. of §404 wetlands. The proposed house will be similar in size and construction characteristics as -to other newer houses being built in the general area (preliminary plans are to build a house very similar to the house that was built at 690712th Ave in 2013; this house is directly north of the 6702 13th Ave). The house will be used for beach vacations by the owner and occasional rentals. However, the proposed building specifications, were developed to minimize this 'impact. The following considerations will be used to minimize the iimpact on, the, wetlands area and are deemed the mitigation proposals: - The size of the house is consistent with new construction ,in the area, ,yet has a footprint that requires only a reasonable amount of fill. The house will have multiple levels �of living space which also limits amount of fill while still provides adequate habitable space. - The amount/ area of beach compatible fill/ sand used to raise -the elevation of the area containing the house and driveway will be minimized to support construction of the house yet limit the impact on exiting wetlands. The area directly under the house and. ,decks will have a fill depth of approximately 1'8 inches. The,fill material is needed under the house to bring this area to'a suitable elevation to properly transition the driveway from 13th Ave to the concrete slab under the house. The fill is also needed ,to provide a suitable base for the, concrete pad that will be under footprint of house + front deck. - Use of impervious material will be limited. A concrete pad will be a placed over the fill material only for the footprint of house and front deck (42 ft X 24 ft). - The house will be located towards the front of the lot (close to 13th Ave) to maximize the undisrupted area in the back of the lot. The house will be 12 feet from the street right -of- way (this will require a variance from the town of North Topsail, Beach due to the r20 ft setback not,being met). The, area at the back of,the; house will be fenced off during construction to reduce idamage`to existing vegetation. This area will remain in its existing,configuration following completion of construction. - Porous material in the form of gravel and sod will be used for the driveway to avoid rainwater runoff. Driveway construction will be similar to driveways at 6902 12th Ave and 690612th Ave (see photos # 3 and 5). Sod areas will extend from the concrete slab to road right -of -way. The gravel area across entire driveway will cover the area from the front, of the lot (road right -of -way) to the actual pavement on 1 S4 Ave. - All areas outside of the house footprint and portions of driveway as noted below will avoid having impervious surfaces. - The back deck 6ft X 24 ft will NOT be,covered to help promote wetlands areas. All wetland areas at the back of the lot will remain in their existing/ natural configuration (see Figure # 2). The following factors were used to determine the amount of wetland area being disturbed by the proposal to build a house at 6702 13th Ave. : Based on the actual location of Wetland Flag WD -1 and'WD -4 (see attached Corps of Engineers'Wetlands 'Determination for 6702 13th Ave —'SAW- 201 3001 31 1) and measurement of property pins for the 50 ft,X 100 ft lot,, wetlands have been assigned to all portion of the lot with the exception of the front two feet of the property.
