Mr. Tankard,
The Town of Robersonville appreciates the opportunity to respond to the above -mentioned Notice
of Violation. The Town of Robersonville does not dispute that the following violation occurred
however we are currently updating the Pretreatment Plan.
On 7/13/22, the operator turned on the aeration blower at the grit chamber which could have
possibly disrupted the plant to cause the BOD exceedance for that day and was high enough to
exceed the weekly average.
The operator nor compliance received the exceedance notice from the lab with the monthly 14.0
copper which is only collected once per month and permit limits are 13.07. If we had been notified
of the exceedance a second sample for copper could have been collected that month and <12.0
would have had the WWTP compliant for monthly copper.
We understand the reasons for the Notice of Violation but respectfully request that the Division
consider no further action. As noted, the Town has expended significant effort and funds to resolve
the issues at the WWTP and this civil penalty further strains our financial resources, and we hope
the Division will take this into consideration.
