The Wilmington Regional Office received a complete, modified Stormwater Management Permit
Application for Eagle Point Golf Club on February 22, 2016. Staff review of the plans and specifications
has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in
Session Law 2008-211 and Title 15A NCAC 2H.1000. We are forwarding modified Permit No. SW8
980634, dated February 24, 2016, for the construction of the built -upon area associated with the subject
project.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
conditions and limitations as specified `therein, and does not supersede any other agency permit that may
be required. Please pay special attention to the conditions listed in this permit regarding the Operation
and Maintenance of the grassed swales, the limitations on built -upon area, the restrictions on piping,
certification of the project, and the procedures for changing ownership, and transferring the
permit. Failure to establish an adequate system for operation,and maintenance for the grassed swales, to
limit the built -upon area, to limit piping, to certify the project car to transfer the permit in a timely
manner, will result in future compliance problems.
The following modifications are included and covered by this permit:
1. The full 25% BUA allocation of 2,361,061 square feet has been approved, based on a project area
of 216.81 acres. Of this maximum amount, only 716,649 square feet is currently permitted,
leaving 1,644,412 square feet available for future development.
2. A new 12,508 square foot Fitness Center/Halfway House & Dormitory Facility is being added
adjacent the existing clubhouse. However, since 5,812 sf of BUA is being removed, the net gain
is only 6,696 sf.
3. This project contains 42.7 acres that are within 575 feet of an ORW classified water body (the
-ORW AEC). Under the 1995 stormwater rules, low density is the only development option for
this area. The maximum density allowed within the ORW AEC is limited to 25%.
4. A small inlet and 4" PVC pipe were added because runoff from the cart washing operation tended
to stand in the area of the cart path. The drainage area to this inlet is approximately 9,700 sf. The
runoff is transported to a nearby golf course pond that has 3 8,43 5 sf of surface area at the normal
pool, where it receives adequate treatment. Please note that from this point forward; the permittee
is prohibited from adding any drainage piping not currently shown on the approved plans, unless
and until. the permittee sball have submitted an application and received approval from the
Division.

The current owner of the golf course is Eagle Point Partners, LLC (Property Owner) who is leasing the
site to Eagle Point Golf Club, Inc. (Lessee / Developer). The Lessee / Developer shall be responsible for
meeting the conditions and limitations specified in the permit. A copy of the lease agreement that outlines
the Lessee / Developer responsibilities for this stormwater system must be kept with the permit and
maintenance activity records.
Please be aware that it is the responsibility of the Lessee / Developer, to notify the Division of any
changes in ownership and request an ownership/name change for the stormwater permit. However, please
be reminded that if the lease agreement or contract between the Lessee / Developer and the Property
Owner is dissolved, cancelled or defaulted, and the Division is not notified by the Lessee / Developer to
transfer the permit, then the responsibility for permit compliance reverts back to the Property Owner. The
Property Owner must notify the Division immediately of the permit ownership change and submit a
completed Name/Ownership form to the Division within 30 days. Otherwise the Property Owner will be
operating a stormwater treatment facility without a valid permit. This is a violation of NC General Statue
143-215.1 and may result in appropriate enforcement action including the assessment of civil penalties of
up to $25,000 per day, being taken against the Property Owner.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAR). The written petition must conform to Chapter 150B of the North Carolina General Statutes. Per
NCGS 143-215(e) the petition must be filed with the OAH within thirty (30) days of receipt of this
permit. You should contact the OAH with all questions regarding the filing fee (if a filing fee is required)
and/or the details of the filing process at 6714 Mail Service Center, Raleigh, NC 27699-6714, or via
telephone at 919-43 1-3 000, or visit their website at www.NCOAH.com. Unless such demands are made
this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules and Regulations
PERMISSION IS HEREBY GRANTED TO

construction, operation and maintenance of a 25% low density development in compliance
with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules')
and the approved stormwater management plans and specifications, and other supporting
data as attached and on file with and approved by the Division of Energy, Mineral and Land
Resources and considered a part of this permit.
The Permit shall be effective from the date of issuance until rescinded and shall be subject to
the following specific conditions and limitations:
I. DESIGN STANDARDS
1. This permit covers the construction of a maximum of 2,361,061 square feet of built -
upon area (BUA), of which 716,649 sf is currently proposed and 1,644,412 sf is
available for future development.
2. The overall tract built -upon area percentage for the project must be maintained at no
more than 25%, as required by Section 1005 of the stormwater rules.
3. Approved plans and specifications for projects covered by this permit are incorporated
by reference and are enforceable parts of the permit.
4. The only runoff conveyance systems allowed will be vegetated conveyances such as
swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and
approved by the Division.
5. No piping is allowed except that amount as shown on the approved plans.
6. The built -upon area within 575' of the mean high water of ORW classified waters (the
ORW AEC) must be maintained at 25% or less. Currently, 187,233 square feet of
buildings, parking and cart path is proposed within the 42.7 acre ORW AEC.
II. SCHEDULE OF COMPLIANCE
1. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer
between all impervious areas and surface waters.
2. The permittee is responsible for verifying that the proposed built -upon area does not
exceed the maximum allowable built -upon area.

3. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been
made.
4. Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated
with the permitted development, except for average driveway crossings, is strictly
prohibited by any persons.
5. Projects within CAMA's Area of Environmental Concern (AEC) are subject to a
reduction of the permitted amount of built -upon area due to CAMA jurisdiction within
the AEC.
6. The following items will require a modification to the permit. Revised plans,
specifications and calculations must be submitted and approved prior to the permittee
beginning construction:
a. Any revision to the approved plans, regardless of size.
b. Redesign or addition to the approved amount of built -upon area.
C. Further subdivision or sale of the project area, in whole or in part.
d. The addition of a piped runoff collection/conveyance system.
e. Filling in, altering or piping any vegetative conveyance shown on the approved
plan.
f. The construction of any future built -upon area listed on the application.
g. Any other revision that the Director determines should require a modification to
the permit.
7. Swales and other vegetated conveyances shall be entirely constructed, vegetated,
and operational for their permitted use prior to the construction of any built -upon
surface.
8. During construction, erosion shall be kept to a minimum and any eroded areas of the
swales or other vegetated conveyances will be repaired immediately.
9. The permittee shall at all times provide the operation and maintenance necessary to
operate the permitted stormwater management systems at optimum efficiency to
include:
a. Inspections
b Sediment removal.
C. Mowing, and revegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
10. Within 30 days of completion of the project, the permittee shall certify in writing that
the project has been constructed in accordance with the approved plans.
11. The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request.
12. The current owner of the golf course is Eagle Point Partners, LLC (Property Owner)
who is leasing the site to Eagle Point Golf Club, Inc. (Lessee / Developer). The Lessee
/ Developer shall be responsible for meeting the conditions and limitations specified in
the permit. A copy of the lease agreement that outlines the Lessee / Developer
responsibilities for this stormwater system must be kept with the permit and
maintenance activity records.

13. It is the responsibility of the permittee (Lessee / Developer), to notify the Division of
any changes in ownership and request an ownership/name change for the stormwater
permit. If the lease agreement or contract between the Lessee / Developer and the
Property Owner is dissolved, cancelled or defaulted, and the Division is not notified by
the Lessee / Developer to transfer the permit, the Property Owner must notify the
Division immediately of the permit ownership change by submitting a completed and
signed Name/Ownership form to the Division within 30 days of the default or
cancellation. Otherwise the Property Owner will be operating a stormwater treatment
facility without a valid permit. This is a violation of NC General Statue 143-215.1 and
may result in appropriate enforcement action against the Property Owner, including
the assessment of civil penalties of up to $25,000 per day.
III. GENERAL CONDITIONS
Any individual or entity found to be in noncompliance with the provisions of a
stormwater management permit or the stormwater rules is subject to enforcement
procedures, as set forth in North Carolina General Statutes 143, Article 21.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The filing
of a request for a permit modification, revocation and reissuance, or termination does
not stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopening. and
modifying the permit, revoking and reissuing the permit, or terminating the permit as
allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina
Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-
215.1 et. al.
5. The permittee grants permission to DEO / DEMLR staff to enter the property during
normal business hours for the purpose of inspecting all components of the stormwater
management facility.
6. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes; rules, regulations, or ordinances which may be imposed by other
government agencies (local, state and federal) which have jurisdiction.
7. The permittee shall retain a copy of the approved plans on file at all times.

1. Attached is a revised Page 3 of 6 of the main application where I added the "Future" impervious area.
2. It is my understanding the 12" circular drop inlet and 4" PVC drain was added after golf carts were being
washed off up against the building above this location and water began standing in a low place in the cart
path. The drainage area is only +/- 9,687 sf with only 4,104 sf of it being impervious. This drainage area is only
0.001% of the entire golf course site and the impervious area is only 0.0017% of the allowed impervious area. It
appears during heavy rainfall events runoff will bypass this inlet and sheet flow onto the adjoining grassed
fairway and be treated. The pond that the 4" PVC line is draining to is +/- 38,435 sf in size at the normal pool
elevation and would treat anything that flows into it. I hope this information is enough justification to allow the
12" inlet to remain.
Also attached is a revised narrative with the 12" diameter drop inlet mentioned.
If you feel it needs to be removed, please let me know and I will inform the golf course that it will be required to be
removed.

The BLIA breakdown on the application does not include any Future BUA. 1 recommended to the architect that
accompanied me on my inspection, that he take the full 25% BUA allocation with this modification. In the future,
you would only need to provide a plan revision rather than a full modification. Do you want to revise page 3 of 6
to include a future amount of 1,644,412 sf in the overall column and a future amount of 271,291 in the ORW
column?
2. Please update the narrative statement to include the as -built inlet and collection piping near the cart barn that
drains into the golf course pond. As you are aware, collection piping is not allowed under low density. You will
need to either provide justification for keeping it, or it must be removed.

STORM WATER NARRATIVE

The site is located at 8131 Bald Eagle Lane in Porter's Neck off of Market Street. The
proposed project is adjacent to the existing club house located on the 216 acre site. The
building will be a fitnem center and have dorm moms available for people to stay
overnight. The Of course was previously permitted as a Low Density project on
December 17, 1998 (SW8 980634). A modification to the permit was issued on August
23, 1999. The amount of impervious area was only 7.52%.
The site inspection was conducted by NCDEMLR and determined that there was some
slight differences in what had been constructed on site vs the permitted plans.
It was noted that the drop off area directly in front of the club house was different as well
as a concrete paver area had been added for golf carts in front of the pro shop and a
rubberized walkway was added. Based on comparing the previously permitted plans with
a surveyed as -built, it was determined that 1,097 sf of additional impervious area was
added in the drop off area, 750 sf of area for the concrete pavers and 422 sf for the
rubberized walkway.
Landscape islands had also been added to the parking lot area adjacent to the clubhouse
and in front of the two villas that have been constructed. The amount of parking area
permitted totaled 47,706 sf. The amount that is currently shown on the plans only totals
30,649 sf. The landscape islands are shown and taking into account. The small parking
area beside the clubhouse was larger than the area previously permitted. The area
previously permitted totaled 5,812 sf. The amount of impervious area constructed totaled
:,754 sf. However, all of this area will be removed for the new building. For the parking
impervious area, the final number used for the permit is the original number (47,706 sf)
minus the amount that will be removed (5,812 sf) for a total of 41,894 sf.
Al the proposed runoff will continue to sheet flow into natural areas and on to the Of
course grassed areas. A swale was added at the end of the access drive adjacent to the
dumpster to capture runoff coming down the drive and conwey it into a natural area where
it will be allowed to sheet flow. The project drains to the Intracoastal Waterway
(classification SA; ORW).
A small 12" diameter drop inlet with a 4" PVC lane exists that drains a small area (+/-
9,687 s6. This inlet was added after water began standing in the cart path adjacent to the
club house after golf carts were vwwhed down. The 4" fine is +/-182 If and drains to a
pond that is +/- 38,435 sf in size at the normal pool elevation.
