On,August 4, 2014, the Division of Water Resources (the Division) received your application
dated July 28, 2014 for the subject project. The application was reviewed and on September 4, 2014, a
site visit was conducted by Mr. Alan Johnson with this Office along with your representative, Mr. Wayne
Harris. During the visit, several items were discussed that are related to both the application and
observations made during the site visit. These items are listed below and are needed in order to
complete our review of the application:
The application proposes to pipe the entire stream segment that flows through the
subject lot. The Division typically does not allow piping a stream for home construction
given that there should be prior knowledge that a stream exist on particular lot. When
reviewing an application, avoidance and minimization issues are reviewed as related to
impacting streams and wetlands. It would be helpful to provide the lot layout which
shows the required setbacks to determine if relocating the stream is feasible or if the
amount of stream to be piped can be minimized.
Impacts that exceed 149 linear feet (If) of stream require mitigation. This includes the
initial 149 If of impact. During the site visit, there was discussion regarding riprap at the
end of the culvert and if it is considered a previous impact. Based on Mr. Johnson's
inspection, there was approximately 35 If of bank stabilization conducted at some point in
the past. Over time, it appears that riprap from the bank has migrated down into the
channel This riprap in the channel cannot be considered as a previously permitted
impact. In addition, aquatic biota was observed throughout this segment. Acceptance
from the Ecosystem Enhancement program for up to 200 linear feet of proposed stream
impacts is requested.
Information for piping the stream is requested indicating the specific pipe size. Currently
it appears that two 48 -inch diameter pipes are being utilized, with base flow being
contained to a single pipe.
• The General Certification ( #3890) for the requested Nationwide 29 requires storm water
BMPs for sites with greater than 24% impervious area. If this site exceeds the 24%
impervious threshold a request for a waiver with explanation should be provided.
