Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This final permit includes no major changes from the draft permit sent to you on March 31, 2004.
This permit includes a TRC limit that will take effect on January 1, 2006. If you wish to install
dechlorination equipment, the Division has promulgated a simplified approval process for such projects. Guidance
for approval of dechlorination projects is attached.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be

SUPPLEMENT TO EFFLUENT LIMITATIONS

SPECIAL CONDITIONS
A (2). CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia
dubia at an effluent concentration of 2.1%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina
Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase
II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be
performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the
NPDES permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit
limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as
described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998)
or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest
concentration having no detectable impairment of reproduction or survival and the lowest concentration that does
have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection
methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic
Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR.-1) for the months in which tests were performed, using the parameter code TGP3B for the
pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the
following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature.
Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the
facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No
Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the
address cited above.

Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be
required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water
Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include
alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an
invalid test and will require immediate follow-up testing to be completed no later than the last day of the month
following the month of the initial monitoring.

plant is used for treatment. In the past, due to underloading, the Division cut back the flow
from 3.5 MGD to 1.5 MGD. The current plant has operation and maintenance problems and
the WSRO has offered the County a Special Order by Consent (to address TSS violations).
TOXICITY TESTING:
Current Requirement:Chronic P/F Q 2.1% (also recommended with renewal)
Cooleemee has passed its whole effluent toxicity testing requirement since 2000, with one
exception.
COMPLIANCE SUMMARY:
The facility has had compliance problems, which are being addressed by the regional office.
Facility owners are also in the process of upgrading the plant, improvements are scheduled to
be completed in 2004. The most recent compliance evaluation inspection conducted on
December 16, 2003 found facility to be in compliance. The following Notices of Violation were
issued during the previous permit cycle: 4/14/02 - fecal coliforms, flow recording; 4/8/02 -
toxicity failure; 5/29/01 - TSS, fecal coliforms, pH; 2/25/00 - 3 TSS violations; 4/26/00 - 3
TSS violations, fecal coliforms, pH; 2/2/00 - 3 TSS violations.
INSTREAM MONITORING:
Cooleemee is part of the Yadkin - Pee Dee Basin Association and is not required to perform the
instream monitoring. Unfortunately, the Association doesn't have a monitoring station near the
discharge (upstream of the discharge), which complicates analyses of the effects of discharge on
the water quality in the receiving stream. However, such impact is unlikely due to high dilution.
PROPOSED CHANGES:
Cooleemee currently monitors for cadmium and chlorides through the pretreatment program.
No reasonable potential to exceed the allowable levels for these parameters was found through
the pretreatment data analysis. Concentrations of all analyzed parameters were below water
quality standards.

The meeting to discuss the compromise proposal for the Cooleernee hydro
project has been scheduled for Friday, December 12, 2003. We will start at
10:00 AM and continue after lunch if needed. The meeting will be held at
the NCDENR Regional Office in Winston Salem, in conference room 202.
I have attached a copy of DWR's earlier response to this proposal to give
some background and outline the issues to resolve.
This meeting will allow the agencies and the Bullocks to discuss questions
regarding their compromise proposal for releases to the bypassed reach.
Pete Yearington from the FERC may also attend. (Susan - if someone from the
regional office will be attending for DWQ, please forward them this info.)
At this point it would be counter -productive to have representatives from
citizen groups attend, so please do not extend invitations to them.

I spoke with Pearlie Bullock yesterday and persuaded her that it would
be a good idea to have a follow-up discussion regarding the proposed
amendment (64 cfs compromise) for the Cooleemee hydroelectric project.
Potential dates we are considering are: 11/17, 11/24, 12/1, 12/5, or
any day during the week of 12/8. We would like to have this discussion
as soon as possible to keep the process moving.
Please let me know which of these dates will work for you. The plan is
to have the meeting in the Winston Salem Regional office, probably
starting right after lunch. We might consider getting there early to
have a lunch meeting amongst ourselves to prepare for the Bullocks.
There are four major questions we need to try to resolve:
1. Is re -location of Davie County's WWTP outfall feasible?
2. Will the 64 cfs be provided to the bypass via a spill over the
crest, a release through a gate(s), or some combination of the two?
3. What mechanisms and monitoring devices will be in place to assure
run -of -river operation?
4. Do we need to do field demonstration of the 64 cfs release to assess
hbitat, aesthetics and recreation? Can we do this with agency
involvement only and not have a circus for local citizens and media?

Draft Amendment Application with Regards to Minimum Release Turbine
Dear Ms. Bullock:
The Division of Water Resources (DWR) has reviewed your draft proposal to amend the
FERC license for project number 11264, located in the Town of Cooleemee on the South
Yadkin River in Davie County. We appreciate the efforts made by your company to
develop a compromise proposal and the opportunity to review this draft. We realize that
this proposal is a first attempt to consolidate the extensive discussions on 8/26/03 into a
written form. Please understand that our response is not intended to be our one and only
"final word." We wanted to outline our concerns in writing so that any additional
discussions that are needed can take place to move the process forward.
Before discussing our comments, we would like to outline and clarify information about
existing conditions at the site.
The Cooleemee hydroelectric project consists of a dam that diverts water to a power
canal that runs along the east side of the South Yadkin River to the powerhouse. After
passing through the turbine(s), water is discharged back into the river through a tailrace.
The bypassed reach of the South Yadkin River between the dam and tailrace is comprised
of two channels immediately downstream of the dam — the east or "side" channel, and the
west or "main" channel. These two channels merge to form a single channel, still in the
bypassed reach upstream of the tailrace.
In lieu of a site -specific study, DWR used a desktop formula to develop the flow
recommendation of 124 cfs in the bypassed reach. A wetted perimeter field study was
then done to determine the apportionment of flow between the east and west channels and
the minimum release turbine (MRT) proposed to be located partway down the east
channel. Two study transects were located in the east channel upstream of the proposed
MRT and two more in the west channel. The results were incorporated in the existing
FERC license, article 403, that requires releases at the dam of 14.5 cfs to the west
channel, 6.0 cfs to the east channel, and the remaining 103.5 cfs through the MRT.

The license does not specify whether the release at the dam should be made through gates
or spillage over the crest. Note that no study transects were located in the bypassed reach
downstream of the convergence of the east and west channels. Therefore, the wetted
perimeter study results cannot be used to evaluate the effect of a total flow of less than
124 cfs on aquatic habitat between the confluence of the east and west channels and the
tailrace return. Note also that this flow recommendation predates any development of the
park on the west bank of the bypassed reach, and does not reflect any consideration of
aesthetic or recreational flow needs.
The bypassed reach flow of 64 cfs referred to in the proposed amendment is linked to
North Carolina General Statute 143-215.31(c & d). This flow is ten percent of the mean
annual flow (average flow), NOT the 7Q10 flow at this location. Subject to this law, the
NC Department of Environment and Natural Resource (DENR) cannot advocate flows
higher than 64 cfs during any FERC proceedings. However, note that this restriction only
applies if the wastewater discharge is relocated out of the bypassed reach. This limitation
does not apply to all agencies involved in the review of the proposed amendment. The
law also does not require DENR to actively support a flow of 64 cfs; and we could
decline to comment on this aspect of the proposal.
The 7Q10 flow in the bypassed reach of the project is 106 cfs. This is the flow used by
the Division of Water Quality (DWQ) to develop effluent limits for Davie County's
wastewater treatment plant discharge to the South Yadkin River (NPDES permit
NC0024872). The outfall for this discharge is presently located in the bypassed reach
approximately 160 feet upstream of the tailrace return.
During the discussion at our meeting with South Yadkin Power and FERC on 8/26/03,
we outlined the following concerns regarding any change in the MRT installation and
bypassed reach flow.
• Before submitting any final amendment proposal to FERC, we recommend that an
on -site assessment of flows be considered to evaluate aquatic habitat, aesthetic, and
recreational concerns for the bypassed reach. A flow of 64 cfs could be released at
the dam and confirmed by a field measurement that DWR would be willing to
perform. We would be glad to assist with the details and logistics for the test release.
• Any modification of flow to the bypassed reach that might be agreed to can only be
implemented after the outfall for the Davie County wastewater treatment plant has
been relocated downstream of the tailrace return, and after the new outfall is fully
functional.

• Re -location of the wastewater outfall downstream of the tailrace makes it even more
imperative that run -of -river (ROR) operation be maintained without interruptions or
significant deviations in downstream flow. The releases at both the dam and the
powerhouse will need to be managed to maintain ROR flows for wastewater
discharge assimilation. Any proposed amendment should include provisions for
maintaining and monitoring run -of -river operation. It would be most effective to
work out these details prior to submitting a request for an amendment, rather than
developing a plan in consultation with the agencies after the amendment is issued.
Our comments on the draft amendment are as follows:
• Item #1 on page 1 of the proposal refers to the "existing 7Q10 requirement of 64 cfs."
We recommend that this item be dropped since 64 cfs is neither the 7Q10, nor the
existing FERC requirement.
• Items #2 and #3 on page 1 of the proposal refer to summer and winter months. If the
final proposal still contains seasonal variations, we recommend that summer be
defined as Memorial Day weekend through the end of October, and winter be defined
as the seven remaining months.
• Items #2 and #3 on page 1 of the proposal refer to flow requirements to satisfy "EPD"
and USGS. The USGS is not a regulatory agency — they provide objective flow
estimations and measurements for use by others. There is no agency abbreviated by
"EPD." The two state agencies involved are the NC Wildlife Resources Commission
(WRC) and the NC Department of Environment and Natural Resources (DENR).
Agencies within DENR with interest in this proposal include the Division of Water
Resources (DWR), the Division of Parks and Recreation (DPR) and the Division of
Water Quality (DWQ). The NC Department of Cultural Resources - State Historic
Preservation Office may also be involved. Federal agencies, including the US Fish
and Wildlife Service, will also need to be consulted.
• A 7Q10 flow of 64 cfs is referred to in several places in item #3 on page 1-
sometimes in conjunction with a flow to adequately dilute effluent. The 7Q10 at this
location is 106 cfs, and this is the minimum flow needed for effluent assimilation.
• Items #2 and #3 on page 1 refer to making the release of 64 cfs at the dam through a
head gate — except on weekends during the five summer months. Our understanding
of the proposal is that the issue is how the release of 64 cfs will be provided — through
gates or over the crest — but that regardless of the release mechanism, a flow of 64 cfs
will be provided at all times to the bypassed reach. We recommend that the release at
the dam be made over the crest at all times. A key benefit of making the release over
the crest is that it assures run -of -river operation (and wastewater assimilation) in the
event of a shutdown at the powerhouse. By keeping the water elevation in the
impoundment above the crest, any cessation or reduction in the powerhouse release

would almost immediately be offset by increased spillage. The re -aeration of water
spilled over the crest would also improve effluent assimilation at the downstream
wastewater discharge. Crest spillage would provide an even distribution of flow
across the entire river that would be preferable from both an aquatic habitat and
aesthetic standpoint. Water falling over the dam would also be of aesthetic benefit to
the park on the west bank of the bypassed reach.
• At the top of page 2 of the draft proposal, there are three references to water "wasted"
over the dam. We recommend that "wasted" be changed to "released", because this
water still provides a valuable benefit for instream uses, including aquatic habitat.
• On page two, the comparison of the existing and proposed releases would be clarified
if the "proposed changes" section was modified to read as shown below. Note that 60
cfs, not 100 cfs, would gain the advantage of 23 feet of head (an increase of 4 feet).
64 cfs released at the dam, minus 24 cfs as before = 40 cfs additional release
60 cfs release @ 23 feet of head = 126 HP or 96 KW = a reduction
of about 34 HP or 24 KW
We recommend that the listing of amended articles be revised as follows:
Article 402 — Depending on how the release to the bypassed reach is made (gates or crest
spill) the allowable variation in impoundment elevation may need to be revised from the
existing 4 inches below crest elevation. This would reflect a release being made over the
crest of the dam, and the need to minimize downstream flow interruptions — especially
when the wastewater outfall is relocated downstream of the tailrace.
Article 403 — Following the on -site assessment of different releases, revise the references
to 124 cfs to reflect the new release. The references to apportionment of flow between
the east and west channels will not be necessary if water is released over the crest. The
references to the MRT would also be dropped. A condition of this article would require a
release at the dam of 124 cfs until the outfall for the Davie County wastewater treatment
plant is relocated downstream of the project tailrace and is operational.
Article 404 — If water is released over the dam crest, a maximum of two staff gages
would be needed in the river channel — one in the bypassed reach downstream of the
convergence of the east and west channels, and one downstream of the tailrace, but
upstream of the wastewater discharge. A reservoir level recorder would still be required
— as under the present license — and this should be augmented by a staff gage on the dam
abutment. The staff gage at the crest might be sufficient to eliminate the need for a staff
gage in the bypassed reach, but the gage downstream of the tailrace would still be
required. As under the existing license, a plan for all monitoring devices should be
developed with review and comment by the agencies. This article should also include
details of how run -of -river operation would be maintained at the generating facility at all

times. A further condition of this article would stipulate that the bypassed reach release
could not be reduced below 124 cfs until the monitoring and run -of -river operation
measures have been fully implemented.
Article 405 — This article refers to a potential in -channel habitat enhancement in the east
channel of the bypassed reach. With increased releases at the dam, this article could be
dropped.
