Eastern Shore TOA PO Box 726 Bridgeton, NC 28519 Craven Co. Project Setting: The Eastern Shore TOA has submitted a CAMA Major Permit application to replace and reconfigure an existing marina pier. The property is located at 615 A Street, Bridgeton, NC. The lot is maintained lawn and has±750ft. of shoreline along the Neuse River. Structures include community pool, 42 Townhome Units, and concrete walkways and parking lot. The 750 ft. shoreline is riprapped and the existing pier is 480 ft. with a 20ft. X 18ft. L-Head platform on the end and (15) 2ft. X 15 ft. finger piers and 41 wet slips. Depth at the end of the pier is approximately 8 ft. at NWL Adjacent upstream property is a developed lot with a single family residence, 275 ft. pier, retaining wall and boat ramp. Adjacent downstream property is a developed lot with a single family residence and a 140 ft. pier. Neuse River is listed as coastal waters and this section of the Neuse River is not a primary nursery area. It is in the Neuse River Basin and classified as SC;NSW,HQW by the Environmental Management Commission. No SAV was observed during the site visit on July 26, 2022. Project Description: The applicant proposed to install 500 x 5 ft. marina pier with 8 finger piers measuring 5 x 20 ft. and 32 mooring pilings, creating 18 total wet slips. A T-head platform at the end of the pier measuring 9 x 60 ft. is proposed as well as (2) 9 X 10 ft. stepdowns on either side of the pier. Total proposed platform area is 720 Ft3. Depth at NWL at the end of the pier is 8 ft. Anticipated impact: The project will create localized turbidity from piling installation. Total number to slips will be decreased from 41 to 18. Kent Vaughan 8/5/2022 BOBBY CAHOON CONSTRUCTION, INC. 6003 Neuse Road Grantsboro, NC 28529 Phone 252-249-1617 / Fax 252-249-9884 Licensed and Fully Insured NCGC License #62120 Project Narrative Marina Improvements 6/30/22 Eastern Shores TOA 615 A St. Bridgeton, NC 28560 The Purpose for applying for this major development permit is to seek permission for the improvement and replacement of the existing Eastern Shores Townhome Owners Association marina dock located at 614 A St. in Bridgeton NC along the Neuse River. This dock is for private/ townhome owner usage only for the docking of small open runabout and small cruiser type boats typical 20-30' in length. This project is approx. 900 yards southeast of the Bridgton Harbor Marina and the Neuse River railroad bridge, approx.1.6 miles North/NE up the Neuse River from the Hwy 17 Neuse River bridge channel connecting James City to Bridgeton. The current existing docking facility is a 510' long wooden dock structure with a platform at the end and holds 41 boat slips. Due to extensive storm damage from several hurricanes, it is unknown the exact amount of finger piers and outer mooring pilings that were originally in place. The proposed project includes removal and disposal of the existing wooden dilapidated dock structure and pilings. We intend to replace this dock with a new concrete style structure. This dock will have a 5' wide 500' long main walkway, a 9'x60' Tee platform at the end, 8- 5' x 20' finger piers creating 18 slips and will also have a 9' x 10' sitting platform on each side of the walkway nearer to shore. We will have 32 additional outer tie pilings in the slip area. The pilings for this dock will be marine treated southern yellow pine timber pile. We will install them with the use of an excavator with vibratory hammer that will be stationed upon a steal barge. Pilings will have a minimum of 10' embedment into the river bottom. Equipment and material will both be stored upon this barge as well. Other dock framing materials and concrete decking will set with the use of gas -powered saws, drills and hand tools. All materials will be attached with 5/8" and 3/4" hot dip galvanized timber bolts. This new structure is an improvement and replacement of a previously authorized existing community marina. This will be built withing the existing footprint. The usage will remain the same and we are reducing the amount of boat slips currently in place. The project proponent hereby certifies that all information contained herein is true, accurate, and complete to the best of my knowledge and belief. Background On April 6, 2022, the United States Supreme Court issued an order staying a lower court's vacatur of the Trump Administration's 2020 "Clean Water Act Section 401 Certification Rule" ("Federal Rule"). As a result of the United States Supreme Court order, the Trump Administration's Federal Rule has sprung back into effect. The Trump Administration's Federal Rule imposes additional procedural requirements on applicants for 401 Certifications and on DWR's processing of those applications. One requirement is that 401 applicants must request a pre -filing meeting request at least 30 days prior to submitting their 401 application. [40 C.F.R. §121.4] In turn, the Federal Rule requires that applicants include documentation of their pre -filing meeting request in their 401 Certification application. [40 C.F.R §121.1; 40 C.F.R. §121.5]. Please refer to the Federal Rule for more information. Per 40 CFR §121 and §121.5, a 401 Certification application that does not include the required pre -filing meeting request documentation does not constitute a "certification request." As a result of the reinstatement of the Trump Administration's Federal Rule, all 401 applications received after April 6, 2022 that do not have documentation that a pre -filing meeting request was submitted at least 30 days prior to submittal of a 401 Certification application will be returned as incomplete.
