The investigation report is attached to this letter. There was no observable impact to the area where the waste was emptied, and the waste analysis showed the nutrient content to be low. However, you should have obtained permission from this agency as well as the landowner prior to draining the waste. For our records, please mail a copy of the waste analysis to Mr. Johnson's attention. Any further correspondence related to the subject inspection will be sent under separate cover. Also, please be reminded that North Carolina General Statutes provide for civil as well as criminal penalties for violations of state environmental laws and regulations. Johnson TIME SPENT: 4 hours LOCATION: Myers Farm, Inc., on SR 1832 (Union Grove Rd.) approximately 100 yards west of the intersection of SR 1832 and SR 1817 (Zion Liberty Rd.), in Iredell County. RIVER BASIN: Yadkin - Pee Dee River Basin PERSON CONTACTED: Mr. Barry Myers REPORT: On October 22, 1997 this Office received a complaint that a tanker of animal wastewater had been drained into the complainant's pasture.'The complainant was concerned because the well to the complainant's residence was located in the area where the waste was allowed to drain. Due to the slope of the land from where the wastewater was dumped, it is unlikely the well could have been directly affected by the spill. During the investigation no visible evidence of the wastewater was observed, except for a small 18 inch puddle of clear water. In speaking with Mr. Myers and the complainant, a problem occurred with the tractor causing the hitch of the tanker to fall to the paved roadbed. Mr. Myers stated he was concerned with a possible auto accident and was not having success in finding a means to move/lift the tanker off the roadbed. He stated that around 7 p.m. he decided to drain the tanker (approx. 3000 - 3500 gal) so that it could be moved. Considering the waste analysis he had obtained in July and the "waste" was mostly water, he felt the impact would be negligible. Waste analysis showed the following (lb/1000 gal.): • Nitrogen: 3.4 • Phosphorus (P2O5): 1.4 • Potassium (K2O): 7.3 • Zinc: 0.02 • Iron: 0.10 • Copper: 0.01 • pH: 7.74 State of North Carolina Department of Environment and Natural Resources Mooresville Regional Office James B. The report should be self-explanatory. The North Carolina Department of Agriculture's analysis of the waste showed the nutrient levels to be low. Any impact to your pasture or well would appear to be negligible. However, Mr. Myers was informed that he should have obtained permission from this Office as well as from you prior to draining the tanker.
