Dear Ms. Christian:
The Wilmington Regional Office received a request to transfer the Stormwater
Management Permit for 1612 Front Street on July 22, 2003. Staff review of the
documentation, Engineer's Certification, recorded deed restrictions, and an inspection,
have determined that the project is in compliance with the Stormwater Management
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding a copy of Permit
No. SW8 960711, dated September 10, 1996, for 1612 Front Street.
This permit shall be effective from the date of issuance until September 10, 2006, and
shall be subject to the conditions and limitations as specified therein. Please pay special
attention to the Operation and Maintenance requirements in this permit. Failure to
establish an adequate system for operation and maintenance of the stormwater
management system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an ajudicatory hearing upon written request within thirty (30)
days following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150E of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless
such demands are made this permit shall be final and binding.

Confirming your meeting with Joe Christian on July 18, 1612 Front Street
Homeowners Association is immediately implementing in it's
maintenance program for the stormwater retention pond the procedure of
turning off the spray aeration fountain during periods of rain. That
responsibility will be delegated to the member responsible for ground
maintenance.
We understand that with the addition of the above procedure the fountain
may remain in place and operational except during rain.
You will also find enclosed the completed "Name/Ownership Change
Form" and the completed "Stormwater Management Permit Application

Dear Mr. Christian:
Thank you for forwarding the recorded deed restrictions for the development, 1612 Front Street.
While the restrictions do contain all the necessary statements pertaining to the built -upon area and the
maintenance of the pond, there is an inaccuracy which I must bring to your attention.
Under Section 21, Compliance with Stormwater Runoff Low Density Requirements, the reference
to low density is not correct. This project was not permitted under the low density option, and the lot owners
should not be given the impression that the project is low density. The maximum allowable impervious cover
for low density is 25 % in that area, not 61 %, as stated in the deed restrictions. Please correct these
statements as soon as possible. You need not reference the permit type in the restrictions. Most developers
simply say that in order to meet the State of North Carolina's rules regarding stormwater, the lots are limited
to square feet of impervious area. If you wish to reference the permit type, please do so correctly- a
high density development.
