On September 10, 2010, Christine Nelson of the Wilmington Regional Office of the
Division of Water Quality (DWQ) conducted a follow-up inspection of Lakeside Park in
New Hanover County to determine compliance with Stormwater Management Permit
Number SW8 960605 renewed on November 3, 2006. DWQ file review and site
inspection revealed that the site is not compliant with the terms and conditions of this
permit. Please find a copy of the completed form entitled "Compliance Inspection
Report" attached to this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be
resolved:
1. Ponds 1 and 2: The outlet structures do not appear to be functioning as
designed and permitted. Both ponds were designed such that 1.5 ft of storage
was provided between the permanent pool elevation and the bottom of the weir.
However, during this inspection, both ponds were providing less than 1 foot of
storage and were not draining down any further. Since the last rain event was
more than 5 days ago (according to NOAA), the ponds should have returned to
their permitted level. This problem was also noted during the previous
inspections. An e-mail from Mr. Nadeau on June 16, 2010 indicated that the
orifices for both ponds were flushed out. If the orifices are not clogged, then the
outlet structures are, in other ways, prohibiting the pond from functioning
properly.
2. Pond 1: Vegetation has not fully established in the erosive areas on both sides
of the pond behind Carolina Pediatric. During previous visits, erosion was also
found around the inlet behind the Coast Guard and US Customs facility. Due to
the vegetation being more than 6 inches high, the inlet behind the Coast Guard
and US Customs facility could not be accessed.

Please inform this Office in writing before October 14, 2010, of the specific actions that
will be undertaken and the time frame that will be required to correct the deficiencies.
Failure to provide the requested information, when required, may initiate enforcement
action including the assessment of civil penalties of up to $25,000 per day. If a written
plan of action is not submitted to this office by October 14, 2010 then DWQ staff will re-
inspect the site and issue a Notice of Violation if the listed deficiencies have not been
addressed.

Inspection Summary:
The following deficiencies will be resolved upon the approval of a complete plan revision package:
1. The unpermitted right turn lane providing access to the Delaney Radiology property within the right of way of Medical
Center Dr as well as the proposed right turn lane along Carolina Beach Rd to provide access to the proposed Wilco site.
2. Clarify the current layout of the offsite lots within this development.
3. 'Identify the inlets to the pond that were not clearly shown on the previously approved plans.
The following deficiencies were noted during the inspection that still need to be resolved
1. Ponds 1 and 2: The outlet structures do not appear to be functioning as designed and permitted. Both ponds were
designed such that 1.5 ft of storage was provided between the permanent pool elevation and the bottom of the weir.
However, during this inspection, both ponds were providing less than 1 foot of storage and were not draining down any
further. Since the last rain event was more than 5 days ago (according to NOAA), the ponds should have returned to their
permitted level. This problem was also noted during the previous inspections. An e-mail from Mr. Nadeau on June 16,
2010 indicated that the orifices for both ponds were flushed out. If the orifices are not clogged, then the outlet structures
are, in other ways, prohibiting the pond from functioning properly.
2. Pond 1: Vegetation has not fully established in the erosive areas on both sides of the pond behind Carolina Pediatric.
During previous visits, erosion was also found around the inlet behind the Coast Guard and US Customs facility. Due to
the vegetation being more than 6 inches high, the inlet behind the Coast Guard and US Customs facility could not be
accessed.
To bring this system into compliance, the following must be completed:
1. Continue to work with DWQ to complete the plan revision submittal.
2. Ponds 1 and 2: Ensure the outlet structures are functioning properly to provide the required storage volume.
3. Pond 1: Repair the erosive areas on the pond side slopes and around the inlet. Establish vegetation in these areas.
Routinely maintain the ponds such that the vegetation on the side slopes is no higher than 6 inches.

Met with Dr. Crane, owner of 1098 and 1104 Medical Center Drive, to discuss the changes that need to be made to bring
these lots into compliance. Dr. Crane is attempting to track down the plans for the building at 1098 Medical Center Drive,
if they cannot be located, he will provide a dimensioned drawing of the building and sidewalks to demonstrate the amount
of BUA associated with this structure.
Dr. Crane will add gutters and downspouts to collect runoff from the remaining BUA not directed to the stormwater
collection system (deck and rear roof) and direct it to the stormwater collection system via a previously installed
underground pipe to the parking lot.

On May 17, 2010, Christine Nelson of the Wilmington Regional Office of the Division of
Water Quality (DWQ) inspected the offsite lots at 1098 and 1104 Medical Center Drive
associated with Lakeside Park in New Hanover County to determine compliance with
Stormwater Management Permit Number SW8 960605 renewed on November 3, 2006.
DWQ file review and site inspection revealed that the site is not compliant with the
terms and conditions of this permit. Please find a copy of the completed form entitled
"Compliance Inspection Report" attached to this letter, which summarizes the findings of
the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be
resolved: '
1. Although several roof drains have been re-routed to direct the runoff to the
stormwater collection system since the last inspection, additional drains were
found set in the wall near the deck in the rear of the building that appear to direct
runoff away from the collection system.
2. The plans provided with the 2003 modification to this permit indicate the building
at 1098 Medical Center Dr is future development that will consist of 2,400 square
feet. Updated plans to demonstrate the existing development at 1098 Medical
Center Dr could not be found.
Please inform this Office in writing before July 6, 2010, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to
provide the requested information, when required, may initiate enforcement action
including the assessment of civil penalties of up to $25,000 per day. If a written plan of
action is not submitted to this office by July 6, 2010 then DWQ staff will re -inspect the
site and issue a Notice of Violation if the listed deficiencies have not been addressed.

1. It appears that the impervious area associated with the right turn lane in the right of
way of Medical Center Dr to provide access to the Delaney Radiology property has
not been accounted for in either the Lakeside Park permit or the Delaney Radiology
permit.
2. Pond 1:
a. Three (3) inlets have been installed to direct water into the pond. Similar
inlets were originally approved in 1996. However, the plans provided with the
designer's certification and the plans approved with the permit modification in
2003 only identify one inlet near the center of the pond.
b. The permanent pool elevation appears to be higher than designed. This
pond is designed to provide 1.5 ft of storage between the permanent pool
elevation and the bottom of the weir. However, the pond appears to provide

designed. The ponds are designed to provide 1.5 ft of storage between the permanent pool elevation and the bottom of
the weir. However, the ponds appeared to provide less than 1.5 ft of storage. According to NOAA, the last rain event was
4/27/10. The ponds should have returned to the designed elevation in 2 and 5 days. c. Some fill was added and fabric
was installed on the erosive side slope behind Carolina Pediatric. Some fill was added to a few of the erosive spots
across the pond from Carolina Pediatric. Vegetation needs to be established in the repaired areas. The erosion around
the inlet behind the Coast Guard and US Customs has not yet been addressed.
3. Pond 2: a. Permanent pool elevations appears to be higher than designed. The ponds are designed to provide 1.5 ft
of storage between the permanent pool elevation and the bottom of the weir. However, the ponds appeared to provide
less than 1.5 ft of storage. According to NOAA, the last rain event was 4127/10. The ponds should have returned to the
designed elevation in 2 and 5 days. b. Some fill was added and fabric was installed on a portion of the erosive pond side
slope near the western corner of Delaney Radiology. Vegetation needs to be established in the repaired areas.
To bring this system into compliance, the following must be completed:
1. Either demonstrate that the right turn lane has been approved and permitted by DWQ or submit a plan revision or
modification to DWQ to include this right turn lane into either the permit for Lakeside Park or the Delaney Radiology.
2. Pond 1: a. Since the latest set of approved plans as well as the plans provided with the designer's certification do not
accurately depict the location of the pond inlets, a plan revision must be approved by DWQ to demonstrate the location of
the inlets. b. Ensure the orifice is not clogged and that the outlet structure is operating as designed to provide the
permitted storage volume. c. Establish vegetation in the repaired areas. Stabilize and vegetate the eroded areas around
the inlet behind the Coast Guard and US Customs facility. Monitor side slopes for future erosion problems and repair as
necessary.
3. Pond 2: a. Ensure the orifice is not clogged and that the outlet structure is operating as designed to provide the
permitted storage volume. b. Establish vegetation in the repaired areas. Monitor side slopes for future erosion problems
and repair as necessary.

In response to your 3/1/10 letter regarding your inspection at Lakeside Park
(SW8 960605), let us address your numbered points individually:
1) The land at 1104 Medical Center Drive is indeed included in the original
permit's drainage area. Your suggestion over the phone that the solid
property line on the drawing is the drainage area line is not right. Rather, it
is the dotted line that outlines the permit scope and 1104 has always been
included. (Drawing Attached)
2) The building at 1098 Medical Center was built by Dr. Jonathan Crane
with, we assume, all requisite permits in hand. We understand you are in
direct contact with Dr. Crane about this. Please understand our pond
maintenance responsibility does not allow us to address 15 year old
construction — related issues on private property.
3) a) We attach our original 1996 approved drawings showing the overflow
inlet, the primary inlet and detail clearly stating lots 12 and 13
drainage "to be directed to pond as shown". Also, that property owner
references SW8 960605 as their permit number. All inlets have been
previously approved.
b) Our contract maintenance provider for 14 years, retention Pond
Services, issued their monthly inspection report on 2/16/10, the day
before your visit. The water level was described in the report as
"normal" and all other site conditions specified were in order.
c) We will address the three minor erosion areas identified by May 1,
2010.
4) a) Again, RPS found the water level "normal' on 2/16. They reported
"...all pipes and hard structures (were) functioning properly".
b) We did not know a tree in the side slope was prohibited. We will
remove it.
c) The pond side slope by Delaney is almost entirely grassed and stable
and evidenced little erosion. We will add soil and over seed in those
areas where the grass is relatively thin, again by May I".
In summary, we will address the four erosion points identified in the coming
month but propose the other five issues you identified are now in
compliance or are not under our control.

On February 17, 2010, Christine Nelson of the Wilmington Regional Office of the
Division of Water Quality (DWQ) inspected Lakeside Park in New Hanover County to
determine compliance with Stormwater Management Permit Number SW8 960605
renewed on November 3, 2006. DWQ file review and site inspection revealed that the
site is not compliant with the terms and conditions of this permit. Please find a copy of
the completed form entitled "Compliance Inspection Report" attached to this letter,
which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be
resolved:
1. Runoff from 1104 Medical Center Drive, which appears to be outside the
permitted drainage area, appears to be directed toward the collection system for
Pond 2.
2. The building at 1098 Medical Center Dr, located within the drainage area for
Pond 2, has piped a portion of the roof runoff to the ditch behind the facility
instead of directing the runoff to the collection system for Pond #2
3. Pond 1:
a. Two (2) unapproved inlets have been added; one near the pond outlet and
the other near the Coast Guard and US Customs property.
b. Pond water elevation was found to be high. At the time of the inspection,
the pond was draining through the overflow weir. Pond orifice did not
appear to be draining and may be clogged.
c. Erosion problems were found on the side slope behind the Carolina

ensure to demonstrate that the runoff from all additional inlets do not short-circuit the pond. b. Ensure the orifice is not

Comment: Pond 1: Pond water elevation was found to be high. At the time of the
inspection, the pond was draining through the overflow weir. Pond orifice did not
appear to be draining and may be clogged. Erosion problems were found on the side
slope behind the Carolina Pediatric property, on the side slope across the pond from the
Carolina Pediatric property, and around the unapproved inlet by the Coast Guard and
US Customs property.
Pond 2: Pond water elevation was found to be high. At the time of the inspection, the
pond was draining through both the overflow weir and orifice. However, the pond
orifice did not appear to be draining at its full capacity and may be partially clogged. A
tree was found growing on the side slope by the pond outlet. Pond side slope near
western corner of the Delaney Radiology property appears to have eroded such that the
slope is now greater than 3:1 causing the slope to be unstable and the potential for
additional erosion issues.
