Required Items Checklist, Page 1 of 1 High Density Residential Subdivisions Deed Restrictions & Protective Covenances In accordance with Title 15 NCAC 2H.1000 and S.L. 2006-246, the Stormwater Management Regulations, deed restrictions and protective covenants are required for High Density Residential Subdivisions where lots will be subdivided and sold and runoff will be treated in an engineered stormwater control facility. Deed restrictions and protective covenants are necessary to ensure that the development maintains a "built -upon" area consistent with the design criteria used to size the stormwater control facility. I, JaKe Mcmss S1bQVJ adknowledge, affirm and agree by my signature below, that I will cause the following deed restrictions and covenants to be recorded prior to the sale of any lot: 1. The following covenants are intended to ensul ongoing compliance with State Stormwater Management Permit Number _5',09 lwofa as issued by the Division of Water Quality under the Stormwater Management Regulations. 2. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the stormwater management permit. 3. These covenants are to run with the land and be binding on all persons and parties claiming under them. 4. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Water Quality. 5. Alteration of the drainage as shown on the approved plan may not take place without the concurrence of the Division of Water Quality. 6. The maximum allowable built -upon area per lot is 5,500 square feet. This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. OR, if the proposed built -upon areas per lot will vary„ please REPLACE #6 above with the following: 6. The maximum built -upon area per lot, in square feet, is as listed below: This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement.' Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. 7. Each lot will maintain a 30** foot wide vegetated buffer between all impervious areas and surface waters. **50 foot for projects located in the 20 coastal counties. 8. All runoff from the built -upon areas on the lot must drain into the permitted system. This may be accomplished through a variety of means including roof drain gutters which drain to the street, grading the lot to drain toward the street or grading perimeter swa/es to collect the lot runoff and directing them into a component of the stormwater collection system. Lots that will naturally drain into the system are not required to provide these additional measures. A preliminary in-depth review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: Drainage Area: a. Location: A drainage area map was provided, however, the drainage area does not contain the area where houses will likely be built. For many lots, the line bisects the lot through the middle of the area labeled as the building pad. Please provide a drainage area map that clearly shows that all of the impervious area for the project will be directed to the appropriate pond. b. Proposed Grading: Please provide proposed grading to support the location of the drainage area lines. 2. Drainage Easements: Drainage easements are provided throughout the property, but please ensure that the ponds are located inside drainage easements. 3. Relocated Wetland Strips: Please ensure that you have contacted the appropriate agenc(ies) to obtain the appropriate approvals for relocating wetlands. Approval of the stormwater permit does not approval the relocation of wetlands. 4. Please remember that a change to one number may have a domino effect on other numbers. Please check all plans, calculations and forms and make changes as needed. Please note that this request for additional information is in response to a preliminary review. The requested information should be received in this Office prior to October 21, 2010, or the application will be returned as incomplete. Turn left onto Flemington Drive & travel approx. 0.03 miles. Turn left onto Church Street & travel approx. 0.48 miles. Turn right onto McRae Lane & travel approx. 0.19 miles. The site is on the east side of McRae Lane. Total site area is approx. 15.52 acres. Total disturbed acreage is approx. 14.24 acres. Soils to be disturbed are mainly Grifton (Gt) & Pender (Pe). The purpose of this project is to create a residential subdivision. Stormwater runoff from all impervious surfaces on the site will be treated in 2 proposed stormwater ponds. Other runoff from the site will either sheet flow through a swale to an existing town pond, or sheet flow to an existing wetland and then through a swale to an existing town pond. Off -site runoff is bypassed through the site at 2 locations (through wetlands & through swale adjacent to the southern property line). Erosion Control Measures: The attached plans and specifications state or show required Sediment and Erosion Control measures to be taken. Gravel construction entrance will be installed at both proposed entrances to the site as shown on plan. Silt fence will be installed as shown on plan. Inlet protection will be installed as shown on plan. Outlet protection will be installed as shown on plan. Pond # 1 will serve as a rock dam and pond #2 will serve as a sediment trap during construction. Temporary porous baffles will be installed as shown on plan. Seeding and mulching as indicated on plan. Construction Sequence: The gravel construction entrances and silt fence will be installed immediately. Then the proposed swales and ponds shall be excavated and the storm drain pipe may be installed. Inlet and outlet protection is to be installed. Proposed swales shall be stabilized prior to any rainfall event. Temporary porous baffles shall be installed.. Sheet metal shall be installed in existing ditch. Then clearing of the site may begin and utilities may be installed. Any disturbed area within McRae Lane right-of-way shall be seeded and stabilized with excelsior mat or mulch at the end of each day. Roads shall be installed. Upon completion of any phase of activity side slopes will be seeded/stabilized within 21 days of no construction, all other disturbed areas will be seeded/stabilized within 15 days of no construction. Environmental Consultants RECEIVED AUG 2 6 2010 August 19, 2010 BY: Jeff Malvass Malpass Engineering, PC 1134 Shipyard Blvd. Wilmington, NC 28412 Reference: Stormwater seasonal high water table study for the proposed retention pond areas for the Bristol Bay S/D, located off of McRae Ln., in Lake Waccamaw. NC. Dear Mr. Malpass: On Tuesday, August 3, 2010, Land Management Group, Inc. had the pleasure of evaluating the proposed retention areas for the Bristol Bay S/D. The purpose of the evaluation was to describe the soil profile, quantify the depth to the seasonal high water table and to inform the project engineer of any potential limitations of this project. The soils at this site are mapped as the poorly drained Grifton soil series in the Soil Survey of Columbus County (USDA. 1990). Actual soil boring 1 and 2, confirms the soil to be a moderately well drained Grifton soil series, Appendix A. The Grifton Complex soil series can best be described as soils that formed from sandy and loamy marine sediment on flats and low ridges underlain by Marl and Limestone. The seasonal high water table is normally evident by observation of redoximorphic features suggesting past conditions of saturation and reduction. There is evidence of relic redoximorphic features 2T' from the soil surface in borings 1 and 28" in. boring 2 of the proposed retention areas (see testing locations in Appendix A and complete soil profile notes in Appendix B). From observation of regional drainage and hydrologic diversion from development of the town within the immediate area, the contemporary seasonal high water table is believed to be around 42" from the existing soil surface in boring 1 and around 48" from the soil surface in boring 2. All recorded depths are from the existing surface as noted in the soil boring notes. The official published description and physical and chemical data for the Woodington soil series are shown in Appendix C for comparison. The basin area denoted by boring 2 is adjacent to a 404 wetland boundary. In order to maintain that the retention pond does not drain the adjacent wetland it is recommended that an approved barrier of either Clay or Plastic be installed on the 404 wetland side of the retention pond area to a depth of 0.5 feet below the surface to a depth i foot below the permanent pool elevation which is approximately 91.5 feet above MSL (See test area map for barrier layout Appendix A). It was requested by the project engineer that LMG suggest the depth of any potential liner that will be installed if the permanent pool elevation is more than 6" below the SHWT. Table 1 shows the recommended liner installation depth in reference to each soil boring location. In pond 1 the permanent pool elevation provided by the project www.lmgroup.net • info@imgroup.net • Phone: 910.452.0001 • Fax: 910.452.0060 3805 Wrightsville Ave., Suite 15, Wilmington, NC 28403 • P.O. Box 2522, Wilmington, NC 28402 engineer was 92.75 feet above mean sea level (MSL). In borings 1 the permanent pool elevation is at 0.5 feet below the SHWT: therefore, LMG does not propose that a liner be installed for this pond. Official elevation data was provided by the proiect engineer. Table 1. Elevation Data With Respect to Existing Ground Surface and SHWT HOLE GROUND SHWT ELEVATION Permanent Recommended Pool Elevation # ELEVATION D th of Liner Bl 96.75 93.25 92.75 NA B2 95.28 91.28 92.5 91.5 Qa *Elevation data provided by the proiect engineer In summary, LMG has performed a site specific evaluation within the stormwater retention areas. This area has soils that have a relic seasonal high water table at 27" in boring 1 and 28" in boring 2 from the existing surface. From the observation of existing regional drainage within the immediate area, the contemporary seasonal high water table is believed to be around 42" (93.25 feet above MSL) from the existing surface in boring 1 and 48" (91.28 feet above MSL) from the soil surface in boring 2, these depths to the seasonal high water table should be used for design purposes. It is recommended by LMG that a liner be installed in the basin denoted by boring 2 to a depth of 91.5 feet above MSL (See test area map for proposed liner layout Appendix A). Environmental Consultants Jeff Malpass August 5, 2010 IBY:__ AUG 16 201Malpass Engineering, PC __ 1134 Shipyard Blvd. Wilmington, NC 29412 Reference: Stormwater seasonal high water table study for the proposed retention pond areas for the Bristol Bay S/D, located off of McRae Ln., in Lake Waccamaw, NC. The sons at this site are mapped as the poorly drained Grifton soil series in the Soil Survey of Columbus County (USDA, 1990). There is evidence of relic redoximorphic features 2T' from the soil surface in borings 1 and 28" in boring 2 of the proposed retention areas (see testing locations in Appendix A and complete soil profile notes in Appendix B). From observation of regional drainage and hydrologic diversion from development of the town within the immediate area, the contemporary seasonal high water table is believed to be around 42" from the existing soil surface in boring 1 and around 48" from the soil surface in boring 2. AD recorded depths are from the existing surface as noted in the soil boring notes. The official published description and physical and chemical data for the Woodington soil series are shown in Appendix C for comparison. The basin area denoted by boring 2 is adjacent to a 404 wetland boundary. In order to maintain that the retention pond does not drain the adjacent wetland it is recommended that an approved barrier of either Clay or Plastic be installed on the 404 wetland side;of the retention pond area to a depth of 0.5 feet below the surface to a depth 1 foot below the permanent pool elevation which is approximately 91 feet above MSL (See test area map for barrier layout Appendix A). It was requested by the project engineer that LMG suggest the depth of any Potential liner that will be installed if the permanent Pool elevation is more than 6" below the SHWT. Table 1 shows the recommended finer installation depth in reference to each soil boring location. The permanent pool elevation provided by the project engineer was wwwArngroup.net • info@lmgroup.net • Phone: 910.452.0001 • Fax: 910.452.0060 3805 Wrightsville Ave., Suite 15, Wilmington, NC 28403 • P.O. Box 2622, Wilmington, NC 28402 91.5 Feet above mean sea level (MSL). In borings 1 the permanent pool elevation is at least 0.82 Feet below the SHWT. therefore, LMG proposed that a liner be installed at least,a foot below the permanent pool elevation for the basin where boring 1 is located to a depth of 90M Feet below MSL. Official elevation data was provided by the project engineer. Table 1. Elevation Data With Respect to Existing Ground Surface and SHWT. HOLE GROUND SHWT ELEVATION Permanent Recommended Pool. This area has soils. that have a relic seasonal high water table at 27" in boring 1 and 28" in boring from the existing surface. From the observation of existing regional drainage within the: immediate area, the contemporary seasonal high water table is believed to be around 42"- (92.5 feet above MSL) from the existing surface in boring 1 and 48" (92.0 feet above MSL) from the soil surface in boring 2, these depths to the seasonal high water table should be used for design purposes. It is recommended by LMG that a liner be installed in the basin denoted by boring 1 to a depth of 90.68 Feet above MSL and a liner -be installed in the basin denoted by boring 2 to a depth of 91.0 feet above MSL (See test area map for proposed liner layout Appendix A).
