Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water Quality
(DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR) All previous references to DWQ will
remain in older stormwater permits issued prior to August 1, 2013 until they are modified Please note that this permit
will now reference DEMLR as the Division responsible for issuance of the permit
The Wilmington Regional Office received a complete 8 year Stormwater Management Permit Renewal Application for
the subject project on September 2, 2021 The Division is hereby notifying you that permit SW8 060901 has been
renewed on September 5, 2021, and shall be effective until September 21, 2028 For your records, please find
enclosed a renewed, updated, and re -issued permit and a copy of the renewal application. Please keep this permit on
file at all tunes Please note that the renewed, updated, and re -issued permit does not impose new or different terns, it
merely restates some of the previous terms to provide you with a better understanding of your obligations under the
permit
The renewal and renssuance of this stormwater permit does not imply that the site is currently in compliance with the
terms and conditions of this state stormwater permit. The plans originally approved on September 21, 2006 and most
recently transferred on November 28, 2018, will remain in full force and effect in accordance with the regulations set
forth in Title 15A NCAC 2H 1000
This permit is subject to the conditions and limitations as specified therein Please pay special attention to the
conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed
restrictions, procedures for changes of ownership, transferring the permit, and renewing the permit Failure to establish
an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions,
to transfer the permit, or to renew the permit, will result in future compliance problems
If any parts, requirements, or lunnatnons contained in this permit are unacceptable, you have the tight to request an
adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAM The written
pennon must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within
thirty (30) days of receipt of this permit You should contact the OAH with all questions regarding the filing fee (if a

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of two (2) wet detention pond(s) in compliance with the
provisions of 15A NCAC 2H 1000 (hereafter referred to as the "stormwater rules') and the approved
stormwater management plans and specifications and other supporting data as attached and on file
with and approved by the Division of Energy, Mineral and Land Resources (the "Division" or
"DEMLR") and considered an enforceable part of this permit
This permit shall be effective from the date of issuance until September 21, 2028, and shall be subject
to the following specified conditions and limitations
I DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater described in
the application and other supporting data
This stormwater system has been approved for the management of stormwater runoff as
described in Section 15 of this permit The stormwater controls identified as Pond 9 for the
Sales Center and Pond 10 for the Wellness Center have been designed to handle the runoff
from 405,110 square feet and 240,000 square feet of built -upon area, respectively The total
impervious area is 645,100 square feet The tract development will be limited to the amount of
built -upon area
All stormwater collection and treatment systems must be located in either dedicated common
areas or recorded easements The final plats for the project will be recorded showing all such
required easements, in accordance with the approved plans

1 The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface
2 During construction, erosion shall be kept to a minimum and any eroded areas of the system
will be repaired immediately
3 Records of maintenance activities must be kept and made available upon request to
authorized personnel of DEMLR The records will indicate the date, activity, name of person
performing the work and what actions were taken
4 The facilities shall be constructed, operated and maintained in accordance with the provisions
of this permit, the approved plans and specifications, and the supporting documents attached
to this permit and on file with the Division
5 Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to
operation of this permitted facility, a certification must be received from an appropriate
designer for the system installed certifying that the permitted facility has been installed in
accordance with this permit, the approved plans and specifications, and other supporting
documentation Any deviations from the approved plans and specifications must be noted on
the Certification A modification may be required for those deviations

The permittee shall at all times provide the operation and maintenance necessary to assure
the permitted stormwater system functions at the design condition The approved Operation
and Maintenance Plan must be followed in its entirety and maintenance must occur at the
scheduled intervals including, but not limited to
Semiannual scheduled inspections (every 6 months)
Sediment removal
Mowing and re -vegetation of slopes and the vegetated filter
Immediate repair of eroded areas
Maintenance of all slopes in accordance with approved plans and specifications
Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch
basins and piping
Access to the outlet structure must be available at all times
Decorative spray fountains are allowed in the pond, subject to the following criteria
a The minimum permanent pool volume is 30,000 cubic feet
b The fountain must draw its water from less than 2' below the permanent pool surface
c Separated units, where the nozzle, pump and intake are connected by tubing, may be
used only if they draw water from the surface in the deepest part of the pond
d The fountain may not be placed into the forebay
e The falling water from the fountain must be centered in the main pond, away from the
shoreline
f The maximum horsepower for a fountain in pond 9 is 1/6 horsepower and pond 10 is '
horsepower
If the stormwater system was used as an Erosion Control device, it must be restored to design
condition prior to operation as a stormwater treatment device, and prior to occupancy of the
facility
9 Access to the stormwater facilities for inspection and maintenance shall be maintained via
appropriate recorded easements at all times
10 The Director may notify the permittee when the permitted site does not meet one or more of
the minimum requirements of the permit Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the Director for modifying the site to meet
minimum requirements The permittee shall provide copies of revised plans and certification in
writing to the Director that the changes have been made
11 No person or entity, including the permittee, shall alter any component shown in the approved
plans and specifications Prior to the construction of any modification to the approved plans,
the permittee shall submit to the Director, and shall have received approval for modified plans,
specifications, and calculations including, but not limited to, those listed below For changes to
the project or SCM that impact the certifications, a new or updated certification(s), as
applicable, will be required and a copy must be submitted to the appropriate DEQ regional
office upon completion of the modification
a Any modification to the approved plans and specifications, regardless of size including
the SCM(s), BUA, details, etc
b Redesign or addition to the approved amount of BUA or to the drainage area
c Further development, subdivision, acquisition, lease or sale of any, all or part of the
project and/or property area as reported in the approved plans and specifications
d Altering, modifying, removing, relocating, redirecting, regrading, or resizing of any
component of the approved SCM(s), the stormwater collection system and/or
vegetative conveyance shown on the approved plan
e The construction of any allocated future BUA
f Adding the option to use permeable pavement or #57 stone within the lots as a
permeable surface The request may require a proposed amendment to the deed
restrictions and protective covenants for the subdivision to be submitted and recorded
g The construction of any permeable pavement, #57 stone area, public trails, or
landscaping material to be considered a permeable surface that were not included in
the approved plans and specifications
h Other modifications as determined by the Director

12 Prior to transfer of the permit, a file review and site inspection will be conducted by Division
personnel to ensure the permit conditions have been met and that the project and the on -site
stormwater system complies with the permit conditions Any items not in compliance must be
repaired, replaced restored, or resolved prior to the transfer Records of maintenance activities
performed to date may be requested
III GENERAL CONDITIONS
Any individual or entity found to be in noncompliance with the provisions of a stormwater
management permit or the requirements of the stormwater rules is subject to enforcement
procedures as set forth in NCGS 143 Article 21
The issuance of this permit does not preclude the permittee from complying with and obtaining
any other permits or approvals that are required for this development to take place, as
required by any statutes, rules, regulations, or ordinances, which may be imposed by any
other Local, State or Federal government agency having jurisdiction Any activities undertaken
at this site that cause a water quality violation or undertaken prior to receipt of the necessary
permits or approvals to do so are considered violations of NCGS 143-215 1, and subject to
enforcement procedures pursuant to NCGS 143-215 6
If the facilities fail to perform satisfactorily, the permittee shall take immediate corrective
actions This includes actions required by this Division and the stormwater rules such as the
construction of additional or replacement on -site stormwater systems These additional or
replacement measures shall receive a permit from the Division prior to construction
Permit Transfer This permit is not transferable to any person or entity except after notice to
and approval by the Director The permittee shall submit a completed and signed "Permit
Transfer Application Form" (available on the Division website) accompanied by the required
fee and supporting documentation as listed on the form, to the Division at least 60 days prior
to any one or more of the following events
a The sale or conveyance of the project area in whole or in part, except in the case of an
individual lot sale that is made subject to the recorded deed restrictions and protective
covenants,
b The assignment or conveyance of declarant rights to another individual or entity,
c The sale or conveyance of the common areas to a Homeowner's or Property Owner's
Association, subject to the requirements of NCGS 143-214 7(c2),
d Dissolution of the partnership, corporate, or LLC entity, subject to NCGS 55-14-05 or
NCGS 57D-6-07 and 08,
e Bankruptcy,
f Foreclosure, subject to the requirements of Session Law 2013-121,
Current Perm ittee Name or Address Changes The permittee shall submit a completed
"Permit Information Update Application Form" (available on the Division website) to the
Division within 30 days to making any one or more of the following changes
A name change of the current permittee,
A name change of the project,
A mailing address change of the permittee,
The permittee is responsible for compliance with all terms and conditions of this permit until
the Division approves the transfer request Neither the sale of the project, in whole or in part,
nor the conveyance of common area to a third party constitutes an approved transfer of the
permit
The permittee grants Division Staff permission to enter the property during normal business
hours to inspect all components of the permitted project
The permit issued shall continue in force and effect until the permittee files a request with the
Division for a permit modification, transfer, renewal, or rescission, however, these actions do
not stay any permit conditions

9 Approved plans, application documents, supplements, calculations, operation and
maintenance agreement, and specifications for this project are incorporated by reference and
are enforceable parts of the permit A copy of this permit, application, supplements, operation
and maintenance agreement, and approved plans and specifications shall be maintained on
file by the permittee
10 Unless specified elsewhere, permanent seeding requirements for the on -site stormwater
system must follow the guidelines established in the North Carolina Erosion and Sediment
Control Planning and Design Manual
11 The issuance of this permit does not prohibit the Director from reopening and modifying the
permit, revoking and reissuing the permit, or terminating the permit for cause as allowed by the
laws, rules, and regulations contained in Title 15A NCAC 2H 1000 and NCGS 143-215 1 et al
12 A permit renewal request must be submitted at least 180 days prior to the expiration date of
this permit The renewal request must include the appropriate application, documentation and
the processing fee as outlined in Title 15A NCAC 02H 1045(3)

Important maintenance procedures
— Immediately after the wet detention basm is established, the plants on the
vegetated shelf and perimeter of the basin should be watered twice weekly if
needed, until the plants become established (commonly six weeks)
— No portion of the wet detention pond should be fertilized after the first initial
fertilization that is required to establish the plants on the vegetated shelf
— Stable groundcover should be maintained in the drainage area to reduce the
sediment load to the wet detention basin
— If the basin must be drained for an emergency or to perform maintenance, the
flushing of sediment through the emergency drain should be minimized to the
maximum extent practical
— Once a year, a dam safety expert should inspect the embankment

and regulations covering stormwater runoff, as these rules and regulations are amended from
time to time;
WHEREAS, in Section 10.11. Section 1012 and Section 19.1 of the Declaration,
the DECLARANT reserved the right to amend the Declaration and subject any portion of
Brunswick Forest to additional or modified stormwater restrictions, as and to the extent required
by the terms of any stormwater permit applicable to Brunswick Forest,
WHEREAS, the DECLARANT desires to amend the Declaration to clarify the
stormwater permits numbers as applicable to the various lots in Phase 6, Section 1 of
Brunswick Forest, and to revise and amend the maximum built upon area allocations, including
impervious surfaces, as the same were set out in the Prior Supplemental Declaration, and
NOW THEREFORE, in accordance with its rights under the Declaration (including
without lunitation Section 9.1. Section 1011. Section 1012. Section 191 thereof), the
DECLARANT does hereby supplement and amend the Declaration as follows
A. DECLARANT hereby supplements and amends Section 1012(a) of the Declaration as
follows (and only as to the property described herein).
"10.12 Site Coverage and Stormwater Runoff Rules.
(a) The following restrictions in this Paragraph 1012(a) shall apply only to Lots 1 -
56, Phase 6, Section 1 of Brunswick Forest (also known as "Evangeline Cottages at
Brunswick Forest"), as those lots are shown on plats recorded in the Brunswick County
Registry, which plats are incorporated herein by reference (as so recorded, the "Property').
(1) The covenants in this Paragraph 10.12(a) are intended to ensure ongoing
compliance with the respective state stormwater management permits described below, as
amended, as issued by the Division of Water Quality under NCAC 2H 1000 and any
subsequently issued permits or modifications thereof (each, a "Permit" and collectively, the
"Perms ') and may not be changed or deleted without the consent of the State of North Carolina,
Division of Water Quality, or its successor agency
(2) The State of North Carolina is made a beneficiary of the covenants
contained in this Paragraph 10.12(a) to the extent necessary to maintain compliance with the
Permit.
(3) These covenants are to run with the land and be binding on all persons and
parties claiming under them.
(4) Alteration of the drainage as provided in the Permits may not take place
without the concurrence of the Division of Water Quality, or its successor agency
(5) The maximum allowable built -upon area per Lot in the Property, in square
feet, is as listed below.

These allotted amounts include any built -upon area constructed within the Lot property
boundaries and that portion of the right-of-way between the front lot lines and the edge of the
pavement. Built -upon area includes, but is not limited to, structures, asphalt, concrete, gravel,
brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or
the water surface of swimming pools.
(6) All runoff from the built -upon areas on a Lot must dram into the permitted
stormwater system. This may be accomplished through providing roof drain gutters, which drain
to the street, grading the lot to drain toward the street, or grading perimeter swales directing them
into the pond or street. Lots that naturally drain into the stormwater system are not required to
provide these additional measures "
Be DECLARANT hereby confirms that the term "Lot(s)" used in Section 10.12 of
this Supplemental Declaration shall have the same meaning as the term "Unit(s)" as defined in
the Declaration.
C. DECLARANT hereby declares that Property (and all other properties heretofore or
hereafter subject to the Declaration) shall be held, sold, and conveyed subject to the Declaration,
as amended by this Supplemental Declaration, which covenants shall run with title to the some

deeds or other instruments) and which real property shall be subject to any covenants and
restrictions set forth in the deed transferring such property,
WHEREAS, the Master Declaration (including without limitation Sections 7 2, 12 1
and 12 2) provides that Declarant may designate certain portions of the Common Area as Limited
Common Area, by designation in the deed conveying such area to the Master Association, on a
subdivision plat, or by Supplemental Declaration, and that all costs associated with maintenance,
repair, replacement, and insurance of a Limited Common Area shall be a Neighborhood Expense
allocated among the Owners in the Neighborhood(s) to which the Limited Common Areas are
assigned, regardless of whether the Master Association may be responsible for performing such
maintenance,
WHEREAS, the Master Declaration (including without limitations Sections 5 2 and
7 2) provides that Master Association shall maintain the Area of Common Responsibility, except to
the extent that the Board of the Master Association resolves to assign to a Neighborhood
Association the costs of operating, maintaining, and insuring certain portions of the Area of
Common Responsibility within or adjacent to such Neighborhood, which assignment can be
made regardless of ownership and regardless of the fact that such maintenance may be performed
by the Master Association
WHEREAS, in accordance with the foregoing, Declarant desires to convey to
Master Association and Master Association desires to accept certain Common Areas and Limited
Common Areas in Brunswick Forest as described herein,
NOW, THEREFORE, Declarant, for and in consideration of the sum of Ten
dollars ($10 00) and other valuable consideration to it in hand paid by the Master Association,
the receipt of which is hereby acknowledged, has bargained and sold, and by these presents does
hereby bargain, sell and convey unto Master Association and its successors and assigns forever,
in fee simple, all that certain real property and appurtenances thereto located in Brunswick
County, North Carolina, as more particularly described in Exhibit A, attached hereto and
incorporated herein by reference (the "Property")
SUBJECT TO (i) restrictions, covenants, easements and encumbrances of record,
(n) ad valorem taxes for the current and all subsequent years, (in) matters which would be revealed
by a current, accurate physical survey of the Property, (iv) the terms, provisions, reservations, tights
of others, conditions and restrictions contained in the Master Declaration described above, as same
may be amended and/or supplemented from time to time, (v) the terms, provisions, reservations,
tights of others, conditions and restrictions contained in any Neighborhood Declaration as defined
in the Maier Declaration and as the same may be amended and/or supplemented from time to
time, but only to the extent the Property (or portion thereof) is located within such
Neighborhood, (vi) all governmental permits and regulations, including but not limited to
environmental, zoning, subdivision, building and land use statutes, ordinances and regulations
and all permit conditions of any federal, state or local entity, and (vii) all covenants and
restrictions described herein

Each Portion of the Property has been designated by Declarant on recorded plats and
on Exhibit A as either "Common Area" or "Limited Common Area", such designations to have the
meanings set forth in the Master Declaration The portions of the Property designated as Limited
Common Area are intended for the primary use and benefit of the owners and occupants of the
Neighborhood in which the Lunited Common Area is located or only the owners and occupants of
specific lots, if so designated by Declarant on a Recorded plat
It is the intent of the parties that such Property be exempt from taxation as
Common Area and/or Limited Common Area, subject to applicable law, but it is Master
Association's responsibility to file for any taxation exemptions or reclassifications
The Declarant reserves the right, on its own behalf and on behalf of the Board of
the Master Association, to assign maintenance responsibility and/or the costs of maintenance
responsibility for any portion of the Property to the Master Association and/or any Neighborhood
Assoctation(s) as further provided in the Master Declaration (including without limitation
Sections 5 2, 7 2, 121 and 12 2 thereof)
Further, notwithstanding any other provision in this deed and in addition to the
rights and privileges reserved unto the Declarant in the Master Declaration and/or other
agreements or instruments of record, Declarant hereby reserves unto itself, its successors and
assigns a perpetual, non-exclusive easement and right-of-way of ingress, egress and regress over,
under, across, through and within the Property, for the purposes of construction, maintenance,
repair, location, installation, inspection and operation of any improvements on the Property,
including the right to access and make reasonable use of any and all improvements or
appurtenances existing or to be constructed thereon in connection with the development of
Brunswick Forest
TO HAVE AND TO HOLD the above granted and described Property, together
with all and singular, the rights, privileges, easements, tenements and appurtenances thereunto
belonging or in anywise appertaining unto the said Master Association, its successors and
assigns, in fee simple, forever
And the Declarant, for itself, its successors and assigns, does covenant to and with
the said Master Association, its successors and assigns, that it is seized in fee of the Property,
that it has good right to sell and convey the same in fee simple; that the same is free and clear
from any and all restrictions, easements or encumbrances except those set forth above, and that it
will and its successors and assigns shall wan -ant and defend the title to the same against the
lawful claims and demands of any and all persons whomsoever

COVENANTS, CONDITIONS, AND RESTRICTIONS FOR BRUNSWICK FOREST
RESIDENTIAL PROPERTY ANNEXING REAL PROPERTY ("Supplemental Declaration") is
made this day of , 200_, by FUNSTON LAND & TIMBER, LLC, a limited
liability company organized and existing under the laws of the state of North Carolina
("DECLARANT")
WITNESSETH
WHEREAS, the DECLARANT heretofore executed that certain Master
Declaration of Covenants, Conditions, and Restrictions for Brunswick Forest Residential
Property and caused the same to be recorded in Book 2359, Page 362 and supplemented in Book
, Page in the Brunswick County Registry (hereinafter collectively referred to as
The "Declaration'),
WHEREAS, in Section 9 1 of the Declaration, the DECLARANT reserved the
right to annex additional properties to the Declaration by recording a Supplemental Declaration,
WHEREAS, the DECLARANT has developed additional property designated as
Phase , which the DECLARANT desires to be made subject to the Declaration, and

WHEREAS, in Section 10 11 of the Declaration, the DECLARANT reserved the
right to amend the Declaration and subject the Property to additional stormwater restrictions,
WHEREAS, the DECLARANT desires to amend the Declaration to clarify the
maximum built upon area, including impervious surfaces, applicable to the property being
annexed hereunder, and
NOW THEREFORE, in accordance with its rights under Section 9 1 and Section
10 11 of the Declaration, the DECLARANT does hereby amend the Declaration as follows
A. DECLARANT hereby subjects all of the property described in Exhibit A, attached
hereto and incorporated herein by reference ("the Property"), to the provisions of the Declaration
and annexes such real property into Brunswick Forest Residential Property
B DECLARANT hereby supplements Section 10 12(a) of the Declaration as follows
"10 12 Site Coverage and Stormwater Runoff Rules
(a) The following restrictions in this Paragraph 10 12(a) shall apply only to that
property described in Exhibit A, attached to this Supplemental Declaration and incorporated
herein by reference
(1) The covenants in this Paragraph 10 12(a) are intended to ensure ongoing
compliance with State Stormwater management Permit Number , as
issued by the Division of Water Quality (the "Permit"), and may not be changed or deleted
without the consent of the State of North Carolina, Division of Water Quality, or its successor
agency
(2) No more than 645,110 square feet of the total project to be constructed on
the property described in Exhibit A of this Supplemental Declaration shall be covered by
structures or impervious materials Impervious materials include asphalt, gravel, concrete, brick,
stone, slate or similar material but do not include wood decking or the water surface of
swimming pools
(3) Swales shall not be filled in, piped, or altered except as necessary to
provide driveway crossings
(4) Built -upon area in excess of the permitted amount requires a state
stormwater management permit modification prior to construction
(5) All permitted runoff from outparcels or future development shall be
directed into the permitted stormwater control system These connections to the stormwater
control system shall be performed in a manner that maintains the integrity and performance of
the system as permitted "

WHEREAS, Declarant is the owner of that certain tract of property located in Leland,
North Carolina, as more particularly described in Exhibit A attached hereto (the "Property")
[NOTE- Specify east or south or west village? It's an outparcel, so may not be required]
WHEREAS, the DECLARANT heretofore executed that certain Master Declaration of
Covenants, Conditions, and Restrictions for The Villages at Brunswick Forest and caused the
same to be recorded in Book 3275, Page 488 in the Brunswick County Registry (as the same has
been or may be amended and/or supplemented, the "Villages Declaration"),
WHEREAS, in Section 23 01 of the Villages Declaration, the DECLARANT reserved
the right to annex additional properties to the Villages Declaration by recording a Supplemental
Declaration, and in Article 18A of the Villages Declaration, the DECLARANT reserved the right

WHEREAS, Declarant is also the declarant under that certain Master Declaration of
Covenants, Conditions and Restrictions for Brunswick Forest Residential Property recorded in
Book 2359, Page 362, Brunswick County Registry (as amended or supplemented, the
"Residential Declaration"), regarding a development known as Brunswick Forest (the
"Development"),
WHEREAS, under the Residential Declaration, the applicable provisions of this
document shall be deemed a Cost Sharing Agreement (as defined in the Residential Declaration),
WHEREAS, the Property is intended to drain to stormwater facilities and a pond
located within the Development, such facilities and pond, together with any and all drainage
easements or stormwater holding, detention and/or retention ponds contemplated in the
stormwater permit described in this Agreement, and all shared drainage tunes, pipes, and
equipment associated therewith (collectively the "Drainage Facilities"), being as further
described in the Villages Declaration and/or the Residential Declaration and related maps and
plats thereof,
WHEREAS, this Supplemental Declaration is also to (1) grant the Property a non-
exclusive easement over, across, under, and through portions of the Common Area and Master
Common Area (as defined in the Villages Declaration and the Residential Declaration), for the
purposes of draining, storing, and retaining storm and surface water into the applicable Drainage
Facilities, (2) provide for the allocation of expenses of maintenance and administration of the
Drainage Facilities, (3) memorialize certain stormwater restrictions applicable to the Property
and the Drainage Facilities, and (4) provide for certain use restrictions applicable to the Property,
NOW THEREFORE, in accordance with its rights under Section 23 01 of the Villages
Declaration, the DECLARANT does hereby supplement the Villages Declaration as follows, and
also declares that the Property shall be held, developed, improved, leased, sold, transferred,
conveyed and occupied subject to the following restrictions, easements and agreements, all of
which shall run with the title to the property and shall be binding on all parties having any right,
title or interest therein, along with their heirs, successors and assigns, and which shall inure to the
benefit of each owner thereof
1 Annexation DECLARANT hereby subjects all of the Property to the provisions
of the Villages Declaration and annexes such Property into The Villages at Brunswick Forest as
a deemed Outparcel Lot
2 Use Restriction on Annexed Property, Dance Studio Facility The Property shall
be operated as a dance studio facility No other use of the Property shall be made without the
written consent of Declarant, which consent may be withheld in the sole discretion of Declarant
Notwithstanding anything to the contrary herein, the following uses are expressly prohibited
those items set forth in the Villages Declaration, any medical use, any primary use for a business
of self storage services, and any residential or commercial property brokerage, including, without
limitation, any sales, purchases, leasing, or lusting of residential or commercial lots or property,
and any related broker, sales agent or realtor activities

(a) Grant of Easement. Subject to the terms of this Supplemental Declaration,
Declarant does hereby reserve, give, grant, bargain, sell, and convey unto the owner of the
Property (the "Owner"), its successors and assigns, a perpetual, non-exclusive right, privilege,
and easement on, over, across, under, and through the Drainage Facilities and the Common
Areas of the Development and Master Common Areas of the Villages Property, for the purposes
of draining, storing, and retaining storm and surface water from the Property, as the same may
hereafter be improved
(b) General Easement Conditions No owner of the Property shall construct any
Improvements or take any other actions that will interfere with or Impede the use of the foregoing
easements by any other authorized party
(c) Costs of Maintenance of Drainage Facilities All costs and expenses
incurred in connection with the surface water quality and the annual pond bank maintenance of
the Drainage Facilities that actually serve the Property (the "Drainage Costs") shall be shared by
the Owner as follows as to the Property, the amount assessed by either the Master Association
or the Villages Association (as defined in the Residential Declaration and the Villages
Declaration), as applicable, for such Drainage Costs shall be calculated and assessed by either
the Villages Association or the Master Association (as applicable for the party handling such
maintenance), by taking the total Drainage Costs and multiplying such amount by a fraction
having as its numerator a number equal to the total acreage of such Property (as shown by
recorded plat) and as its denominator a number equal to the total number of acres served by the
Drainage Facilities (including the pond commonly known as Stormwater Pond Number 9), such
total number of acres being, as of the date of this Supplemental Declaration, 14 40 acres The
Owner shall also be solely responsible for any pipes, lines, or other equipment installed that is
solely for the transport or movement of storm or surface water from the Property
Notwithstanding anything to the contrary in this Supplemental Declaration, in the event any costs
or expenses (or portion thereof) are incurred as a result of any act (including, without limitation,
construction -related activities) or negligence of the Owner or its employees, contractors or
agents, the Owner shall be solely responsible for such costs or expenses (or portion thereof)
4 Stormwater Run Off Rules The Property shall be subject to the State of North
Carolina rules and regulations concerning stormwater runoff as these rules and regulations may
be amended from time to time Without limiting the foregoing, Declarant or its designee,
including the Architectural Review Committee, reserves the right to impose additional
restrictions upon the Property as to the extent required by the terms of the stormwater permit for
the Drainage Facilities issued by the State of North Carolina Such additional restrictions may be
imposed by Declarant by the recording of a Supplemental Declaration, and no joinder or consent
of any owner or person shall be required on such Supplemental Declaration While most of the
Lots in the Villages drain to a different stormwater pond than the pond the Property is intended
to drain to, the following shall apply to the Property, and the permit referenced below shall apply
to the Property in lieu of the permit referenced in the Villages Declaration)
(a) This covenant is intended to ensure ongoing compliance with State
Stormwater management Permit Number SW8 060901 PR, as issued by the Division of Water
Quality under NCAC 2H 1000 and any subsequently issued permits or modifications

(b) The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the stormwater management permit
(c) These covenants are to run with the land and be binding on all persons and
parties claiming under them
(d) The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division of Water Quality
(e) Alteration of the drainage as shown on the approved plan may not take
place without the concurrence of the State of North Carolina, Division of Water Quality
(f) The maximum built -upon area for the Property is forty-five percent (45%)
of the Property area This allotted amount includes any built -upon area constructed within the
property boundaries and that portion of the right-of-way between the front lot Imes and the edge
of the pavement Built -upon area includes, but is not limited to, structures, asphalt, concrete,
gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood
decking, or the water surface of swimming pools
(g) All runoff on the Property must drain into the permitted system This may
be accomplished by sheet -flowing the runoff into the road ditch, or collecting it in pipes and
discharging the pipe into the road ditch
(h) Built -upon area in excess of the permitted amount will require a permit
modification
(1) If not owned by the permittee, the Owner shall submit a separate offsite
stormwater management permit application package to the Division of Water Quality and receive
a permit prior to any construction on the Property
0) Declarant reserves the right in its sole discretion as state stormwater
permits are modified to recalculate and redesignate maximum built upon areas as set forth in (f)
above, provided such recalculations and redesignations are in accordance with state stormwater
permits In addition, if any property as finally constructed does not use its allocated built upon
area, Declarant shall have the sole right to reclaim such excess allotment and reallocate it to
remaining properties in its sole discretion, provided such recalculations and redesignations are in
accordance with state stormwater rules
5 Severabihty The invalidity of any one of the provisions of this Supplemental
Declaration or any portion thereof shall not affect the remaining portions thereof and this
Supplemental Declaration shall be construed as if such covenant, agreement, condition or
provision had not been inserted herein Whenever possible, each provision of this Supplemental
Declaration will be interpreted in such a manner as to be effective and valid under applicable
law, but if any provision of this Supplemental Declaration is held to be prohibited by or invalid
under applicable law, such provision will be ineffective only to the extent of such prohibition or
invalidity, without invalidating the remainder of this Supplemental Declaration

6 Remedies for Breach, Lien Rights The terms and conditions of this
Supplemental Declaration shall be enforceable by any party hereto and by the Villages
Association and/or Master Association, as applicable In addition, to the extent any Drainage
Costs or other items required to be paid under this Supplemental Declaration are not specified as
assessments under the Villages Declaration or the Residential Declaration, and such amounts are
not paid within 30 days after when due, they shall bear interest at the rate of 12% per annum, and
Declarant and such Association shall have the right to secure such unpaid amounts, plus any
costs of collection and reasonable attorneys' fees, by the recordation of a lien against the
Property (provided that any such lien shall be subordinate to any then -existing third -party
financing encumbering the applicable Owner's parcel)
DECLARANT hereby declares that the Property shall be held, sold, and conveyed
subject to the Villages Declaration, as amended by this Supplemental Declaration, and the other
rights and obligations contained in this Supplemental Declaration, which covenants shall run
with title to the Property and shall be binding on all parties having any right, title, or interest in
the Property or any part thereof, and shall inure to the benefit of each owner thereof
EXCEPT AS AMENDED AND SUPPLEMENTED HEREIN, the Villages Declaration
shall be and remain in full force and effect
