Director
Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that any updated pages or addendums to the permit will now reference DEMLR as
the Division responsible for issuance of the permit. Additionally, the Department of Environment and
Natural Resources (DENR) has been renamed the Department of Environmental Quality (DEQ).
Permit Extension:
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any development
approval issued by the Division of Energy, Mineral and Land Resources under Article 21 of Chapter 143
of the General Statutes, which is current and valid at any point between January 1, 2008, and December
31, 2010. The law extends the effective period of any stormwater permit that was set to expire during this
time frame up to three (3) years from its current expiration date. On August 2, 2010, the Governor signed
Session Law 2010-177, which granted an extra year for an extension of up to four (4) years.
This permit shall be.effective from the date of issuance until September 28, 2019, which includes the
extensions, and shall be subject to the conditions and limitations as specified therein. Please pay special
attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP,
recordation of deed restrictions, certification of the BMP's, procedures for changing ownership,
transferring the permit, and renewing the permit. Failure to establish an adequate system for operation
and maintenance of the stormwater management system, to record deed restrictions, to certify the BMP,
to transfer the permit, or to renew the permit, will result in future compliance problems.
Permit Corrections:
1. Data in Previous Permit: The September 28, 2005 permit was designed for the I Oyr storm'
required by the county as well as the 1.0" storm required by the State. The pond calculations
have been re -run at 1.5" per the current regulations and the permit has been updated to reflect the
appropriate data. See Section I (6).
2. Permanent Pool Elevation: The 2005 supplement had a typo in the permanent pool elevation. It
was shown to be 29.17msl (the centerline of the drawdown pipe) as opposed to 29.00msl (the
invert of the pipe). This has been corrected. See Section I (6).
3. Permanent Pool Area: The 2005 supplement had a typo in the permanent pool area. It was
shown to be 13,310sf, but it should have showed 13,510sf. This has been corrected. See Section
1(6).

4. Permanent Pool Volume and Fountains: The permanent pool volume has been re -calculated and
determined to be 25,480cf. This is below the 30,000cf threshold where fountains are permitted,
and so that option has been removed from the permit. See Section II (5).
5. Temporary Pool Volume (Permitted Storage Volume): As a result of the permanent pool
elevation and area typos, the temporary pool volume was incorrectly determined to be 14,910cf.
It has been corrected to be 13,326cf. See Section I (6).
6. Clarifications:
a. PE Certification: The pond was certified on July 14, 2006. For clarification, the current
modification is not proposing any changes to the currently -installed pond. It is a
mathematical modification to allow more treatment credit for the pond as it is currently
installed. The pond will not have -to be re -certified following the modification. See "
Section II (7).
b. Depth and 6:1 Vegetated Shelf. The pond was permitted in 2005 with a depth of 3.0ft.
This was a maximum depth as opposed to the average depth calculation method required
today. The 3.Oft depth has been re -permitted because the pond did not have to increase in
size to accommodate the additional impervious area that it is now claiming credit for.
Similarly, the 6:1 shelf has been re -permitted. See Section I (6) and the permitted plans.
Permit Modification:
The Wilmington Regional Office received a complete, modified Stormwater Management Permit
Application for Hold Oil C-Store on March 23, 2016. Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title
15A NCAC 2H.1000 and Session Law 2008-211. We are forwarding modified Permit No. SW8 050840
dated April 5, 2016, for the construction, operation and maintenance of the BMP's and built -upon areas
associated with the subject project. The permit modification has been issued effective April 4, 2016.
Impervious Area: The 2006 permit approved 47,410sf of impervious area. Following corrected
re -calculations, the pond is now permitted for 108,824sf of impervious area.
2. Orifice: The drawdown orifice has increased from 1.0msl to 1.5msl
3. Plan Set: The plan set dated April 4, 2016 replaces all plan sheets previously permitted.
Name/Ownership Change:
On March 23, 2016, the DEMLR received a permit Name/Ownership Change Form from Holt Oil
Company, Inc for the subject project. This application was logged in on April 5, 2016, following the
permit modification on April 4, 2016. A file review and site inspection was performed on March 11,
2016 by DEMLR staff and the site is currently in compliance with the terms and conditions of the current
state stormwater permit. By acknowledging receipt of the permit, and by signing the Name/Ownership
Transfer form, you have accepted the responsibility for complying with the terms and conditions outlined
in this permit. The Division is hereby notifying you that permit SW8 050840 has been transferred on
April 5, 2016 and to remind you that this permit shall be effective until September 28, 2019, which
includes the extensions previously discussed. For your records, please find enclosed a copy of the
Name/Ownership Change form.

If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and
must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH
with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing process
at 6714 Mail Service Center, Raleigh, NC 27699-6714, or via telephone at 919-431-3000, or visit their
website at www.NCOAH.com. Unless such demands are made this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of a wet detention pond in compliance with
the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwa ter rules')
and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Energy,
Mineral and Land Resources and considered at part of this permit.
This permit shall be effective from the date of issuance until September 28, 2019, and
shall be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 of this permit. The stormwater control has been
designed to handle the runoff from 108,824 square feet of impervious area. This
includes 53,824 square feet of proposed impervious, and 55,000 square feet of
future impervious.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans. There is no built -upon area allotment for
future development.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.

4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DEMLR. The records will indicate the date,
activity, name of person, performing the work and what actions were taken.
5. Decorative spray fountains will not be allowed in the stormwater treatment
system because the permanent pool volume is below 30,000 cubic feet.
6. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations. This system was certified on
July 14, 2006. No physical changes are required for the pond under the April 4,
2016 modification, and so the existing certification is still valid. If the pond is
modified in the future such that physical changes are required, it will have to be
re -certified.
8. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
9. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
10. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
11. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
12. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
13. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the

Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Energy, Mineral and
Land Resources, accompanied by a completed name/ownership change form,
documentation from the parties involved, and other supporting materials as may
be appropriate. The approval of this request will be considered on its merits and
may or may not be approved. The permittee is responsible for compliance with
all permit conditions until such time as the Division approves the transfer
request.
Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Energy, Mineral
and Land Resources, in accordance with North Carolina General Statute 143-
215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DEQ Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.
10. If the use of permeable pavement is desired, this permit must be modified to add
the permeable pavement conditions.
11. The permittee shall submit a permit renewal application request at least 180
days prior to the expiration date of this permit. The renewal request must include
the applicable documentation and the processing fee.

III. REQUIRED ITEMS
A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.
1. This completed and signed form. This certification must be completed and signed by both the
current permit holder and the new applicant if this is a change of ownership.
2. Legal documentation of the property transfer to a new owner.
3. A copy of any recorded deed restrictions, covenants, or easements, if required by the permit.
4. The designer's certification (DWQ Engineer and Designer Certification Forms are available from
each DWQ Regional office), if required by the permit and if not already submitted to DWQ.
5. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability
company, or other corporate entity, provide documentation showing the authority of the named
representative to act on behalf of the proposed permittee.
6. The $40.00 processing fee. If this is an initial transfer from the original permittee the processing
fee is not required. Subsequent ownership transfers will require the $40.00 processing fee.

submitted to the appropriate DEMLR Office. (The appropriate office may be found by locating project on the

BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided
as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and

In the instances where the applicant is different than the property owner, it is the responsibility of the property
owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring

One other thing, I have looked over the plans, application, and supporting documents that I submitted and can't find
anything that reports the existing or proposed permanent pool depth being reduced to 2.9' per your comment in 2.e.ii.
The only discrepancies I came up with were:
• 1 reported a reduction in the temporary pool depth from the originally planned/certified depth of 1.00' to
0.90'. This is based on my own field measurements back in January between the invert of the 4" PVC state
drawdown pipe and the bottom of the slot. In reality, the pond was staged up a little when I was there and
between feeling around in the water with the tape measure for the PVC invert and trying not to fall in the water,
I got a few measurements between 0.9' and 1.0'. 1 took the most conservative measurement to be on the safe
side.
I reported the RCP outfall pipe invert of 28.85 instead of the 29.00 that was reported on the original
plans. Again, this is based on my own field measurements back in January and could be subject to some
error. I'm content the invert is about 0.1' lower than the 29.00 PVC invert. Either way, this has no bearing on
the permanent pool elevation, which is controlled by the invert of the 4" PVC state drawdown.
I did find an error on the outlet structure detail on the plans I submitted in January. The bottom of slot was
reported as 30.00 and the top of box was reported as 29.90. The elevations reported in the pond profile were
correct and I have fixed the outfall detail. Again, this error would not have yielded a 2.9' deep permanent pool.
I've attached the January submittal if you'd like to refer to the PDFs instead of pulling the file. Please feel free to give
me a call to discuss if I am missing something.

Application for Holt Oil C-Store on January 21, 2016.
Notice of Inspection:
On March 11, 2016, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected the project, located at 2675 Maco Road NE in Leland to determine the
status of compliance with the State Stormwater Management Permit Number SW8 050840 issued on
September 28, 2005. DEMLR file review and site inspection revealed that the site is in compliance with
the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance
Inspection Report" attached to this letter, which summarizes the findings of the recent inspection.
Request for Additional Information:
A preliminary in-depth review of that information has determined that the application is not complete.
The following information is needed to continue the stormwater review:
Permit Transfer: The current permit was issued on September 28, 2005 to Holt Oil Company,
Inc. The deed submitted (B3422/P1039, June 25, 2013) shows that the property is now owned by
Holt Real Estate Enterprises, Inc. You are the President of both companies, but permit ownership
has to formally transfer to Holt Real Estate Enterprises, Inc. Please submit a Name/Ownership
Change Form. This form is available on our website, http://deq.ne.gov/about/divisions/energy-
mineral-land-resources/energy-mineral-land-permits/stormwater-permits/forms. Please note that
an original signature is needed as opposed to a copy. There is no fee for the permit transfer
because this will be the first one. Since the site is in compliance, this is a formality but it is
required by law.
2. Plans
a. Complete Set: Please clarify which sheets from 2005 (if any) will be part of the approved
set.
b. Wetlands [per 15A NCAC 02H.1003(g)(5)): The 2005 plan did not indicate whether or
not wetlands were on the property as was required by regulations in place at the time.
There will now be 55,000sf of future impervious area. Please either delineate wetlands on
the plan or include a note that none exist so that it will be clear for future modifications or
revisions to this permit where the future impervious can be built.

c. Drainage Area [per 15A NCAC 02H. I 003(g)(5) and 02H. I 005(d)]: The 2005 plan did
not show the drainage area to the pond as was required by regulations in place at the time.
There will now be 55,000sf of future impervious area. Please show the drainage area on
the plans so that it will be clear for future modifications or revisions to this permit where
the future impervious can be built.
d. Topography [per 15A NCAC 02H.1003(g)(4)]: Please provide spot elevations along the
perimeter of the property supporting the drainage area. For instance, the new parking
spaces appear to flow from 35ms1 towards the 34ms] elevation in the direction of Maco
Road as opposed to towards the pond.
e. Data: Please clarify the proposed temporary pool elevation and associated pond depth. I
have summarized the data below:
i. 2005 Plans: The permanent pool elevation was incorrectly reported as the middle
of the drawdown pipe as opposed to the invert of the drawdown pipe. Also, the
bottom of the pond is shown on the plans to be at 26.Omsl. (It does not appear
that sediment storage was required in the 2005 pond.)

,/d Data in Previous Permit: The September 28, 2005 permit was designed for the 1 Oyr
storm required by the county rather than 1.0" storm required by the State. The pond
calculations have been re -run at 1.5" per the current regulations and the permit has been
updated to reflect the appropriate data. See Section 1 (6).
b. Permanent Pool Elevation: The 2005 supplement had a typo in the permanent pool
elevation. It was shown to be 29.17msl (the centerline of the drawdown pipe) as opposed
to 29.00msl (the invert of the pipe). This has been corrected. See Section I (6).
c. Permanent Pool Area: The 2005 supplement had a typo in the permanent pool area. It
was shown to be 13,31 Osf, but it should have showed 13,51 Osf. This has been corrected.
See Section 1 (6).

d. Permanent Pool Volume and Fountains: The permanent pool volume has been re-
calculated and determined to be 25,480cf. This is below the 30,OOOcf threshold where
fountains are permitted, and so that option has been removed from the permit. See
Section II (5). '
e. Temporary Pool Volume (Permitted Storage Volume): As a result of the permanent pool
elevation and area typos, the temporary pool volume was incorrectly determined to be
14,910cf. It has been corrected to be 13,326cf. See Section 1(6).
Please remember that a change to one number may have a domino effect on other numbers. Please check
all plans, calculations and forms to ensure that the numbers are consistent throughout.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received in this Office prior to April 15, 2016, or the application will be
returned as incomplete. The return of a project will necessitate resubmission of all required items,
including the application fee.
If you need additional time to submit the information, please mail, email or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information, which shall be no later than 30
days past the original due date. The Division is allowed 90 days from the receipt of a completed
application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation ofNCGS 143-215.1 and is subject to enforcement
action pursuant to NCGS 143-215.6A.

Please find the attached application, plans, and supporting documents for the modification of the
subject stormwater permit to enable additional BUA at this site. The plan submitted reflects
6,414 sf of proposed BUA beyond the 47,410 sf that was permitted in 2005. In addition to this
proposed BUA, I have allocated a future reserve of 55,000 sf.
This pond was intended to treat the first 1" of runoff from the 47,410 of permitted BUA. This
should have resulted in a treatment volume of 4224 cf and temporary pool stage 0.35' above the
14,000 sf permanent pool. You should have calculations in your file to this effect. However, if
you refer to the table of design elements on the permit, you will see that the water quality storage
volume is reported as 14,910 of and the temporary pool stage is reported as 0.83' above the
permanent pool.
The culprit of these discrepancies is the wet detention basin supplement (SWU-102 Rev 3.99)
that I submitted along with the application. Apparently, I reported the stages and volumes
associated with the Brunswick County 10 year storm detention requirement and nobody caught
the error. The pond was built accordingly —with 090' of freeboard between the state drawdown
orifice and the slot —and certified. The pond was not overbuilt per se, as the additional storage
volume was being utilized to satisfy the Brunswick County detention requirement. It was,
however, under credited from the standpoint of BUA allocation. One other discrepancy 1 found
was the permanent pool elevation reported as 29.17' instead of the 29.00' elevation on the plans
and calculations. From my notes, it appears that the basis for this is related to the centerline of
the 4" drawdown pipe. It should be corrected as well. EREC E IVER

In an effort to correct the water quality storage volume, I am seeking to modify the permit to
match the capacity in the existing pond. Using a 1.5" design storm (which is conservative for the
47,410 sf of BUA permitted in 2005), the existing pond can accommodate the requested 108,824
sf of BUA without any modification to the pond or outlet structure. The only change needed is to
increase the size of the drawdown orifice from 1' to 1.5" to pass the additional volume in 3-5
days. I felt there was no need to calculate a split storage volume (47,410 sf existing at 1" +
61,414 sf proposed at 1.5") as the site cannot support the additional BUA that a less conservative
calculation would allow.
I have included a current pond supplement form. It is filled it out to reflect the discrepancies I
have discovered, however it should be noted that there are a couple of items on the current form
that were not applicable to 2005 ponds.

Project Summary
The purpose of this project is to expand the floor space of the existing convenience store
on the subject 3.65 acre site. Site improvements to facilitate the additional building area
include the removal of 5 existing parking spaces and the addition of 8 new parking
spaces.
Adjoinin€; Property
The site is bounded to the north and east by US 74 and NC 87, respectively. The
southwestern boundary is shared with a residential property.
Soils
Soils on site are mapped in the Brunswick County Soil Survey as Rains, Blanton, and
Baymeade.
Proposed Erosion and Sedimentation Control Practices
The limits of disturbance for this expansion is limited to the installation 8 new parking
spaces contiguous to the existing parking lot. The parking spaces shall be grading and
paved within 7 days. The graded areas immediately surrounding the new curbing shall
either be sodded or seeded within the same 7 day timeframe. Areas that are seeded shall
be stabilized with excelsior mat The total limits of disturbance is less than 2,500 sf.
Proposed Stormwater Management Practices
Stormwater runoff will continue to be directed towards the northwest corner of the
parking lot and conveyed to the forebay of the wet detention basin via a shallow
vegetated swale. The pond is designed to detain the first 1.5" of runoff and proves 90%
TSS removal. The drawdown orifice shall be upsized from 1.0" to 1.5" to account for the
increased water quality treatment volume.

Please find the attached engineer's certification for the stormwater pond at Maco
Road. I visited the site on 7/14/05 and am satisfied that the stormwater treatment
measures and the site itself are in compliance with the permit. The site, including the
pond side slopes has been recently seeded. Permanent vegetation has not been
established, as indicated on the certification. If this checklist item is going to hold up the
issuance of a certificate of occupancy, please notify me at your earliest convenience.
