This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994, or as subsequently amended. i Waste Flow and Characterization. The Division hereby renews this permit for a dormant facility without the benefit of flow or waste characterization. The Division understands that Wallace acquired the subject site from industry, and further understands that Wallace intends to resell it to industry, or ay utilize it to serve future customers discharging domestic wastes, commercial wastes, industrial w ties, or some combination thereof. Therefore, as a Special Condition to this permit, Wallace shall /submit an updated wastestream characte ' ation 90 days prior to startup, so that the Division may modify this permit, as appropriate t• t' a '' arge [see Special Condition, A.(3.)]. Prior to any discharge from this facility, the Town of Wallace must make formal request to the Division for Authorization to Construct (ATC), to include all appurtenant plans and specification for relocating this outfall (see NPDES web site for ATC guidance documents). The Division has made the following additional changes to your previous permit. • Weekly Average Ammonia Limit -- In cooperation with EPA Region 4 and in accordance with the Division's new ammonia policy, a Weekly Average ammonia limit has been added to the permit (see Effluent Limits and Monitoring Requirements). This permit includes a Monthly Average ammonia limit under summer flow conditions. Because the Division is finalizing a new standard for TRC and expects to introduce TRC limits in permits statewide in the near future, a TRC limit of 28 µg/L has been added to this permit. Prior to startup, the Division recommends that the Town of Wallace install de -chlorination facilities or evaluate alternate means of effluent disinfection. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing upon written request within thirty (30) days after receiving this letter. Your request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes, and must be filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding. This permit is not transferable except after notifying the Division of Water Quality. The Division may require modification, or revocation and re -issuance of this permit. This permit contains addition Special Conditions [see A. (3.), A. (4.) and A. (5.)]. NPDES Permit No. NC0003450 SUPPLEMENT OT EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A. (2.) CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 90%. The permit holder shall perform at a minimum, _quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure, performed as the first test of any single quarter, results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months, as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised - February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. (4.) RELOCATION OF OUTFALL 001 Relocating Outfall 001. Prior to any discharge from this facility, the Town of Wallace must make formal request to the Division for Authorization to Construct (ATC), to include all pertinent plans and specification for relocating this outfall, in accordance with applicable ATC and permitting Guidance Documents. Further discharge to Little Rockfish Creek is not permitted and any future discharge from this facility is contingent on relocating Outfall 001 to the Rockfish Creek mainstem (see permit map). A. (5) WASTE CHARACTERIZATION Waste Characterization. The Division renews the permit for a dormant facility without the benefit of waste characterization. Therefore, 90 days prior to startup, Wallace shall submit an updated wastestream characterization so that the Division may modify this permit, as appropriate. DENR / DWQ / NPDES Unit FACT SHEET FOR NPDES PERMIT DEVELOPMENT NPDES Permit NC0003450 INTRODUCTION The Town of Wallace (herein called Wallace or the permittee) acquired the former Stevcoknit Wastewater Treatment Plant (WWTP), herein called Wallace WWTP #2. This facility requires a National Pollutant Discharge Elimination System (NPDES) permit to dispose treated wastewater to the surface waters of the state. The permittee's 5-year NPDES permit expired January 31, 2002 and they have requested renewal from the Division of Water Quality (the Division). This Fact Sheet summarizes background information and rationale used by the Division's NPDES Unit to determine permit limits and monitoring conditions. This document also contains references to information sources relevant to this permit renewal (superscripted numbers in order of appearance, see References). FACILITY RECORDS REVIEW Facility Description. Wallace #2 WWTP (Table 1) is a 4.42 MGD treatment works (currently inactive) formerly permitted to Stevcoknit, Inc. utilizing a Grade IV activated -sludge facility to service textile wastes. The Town of Wallace intends to attract new industry or supplement its domestic service, but only as needed. Therefore this facility has not discharged since acquired in 1999. Activating this permit is contingent on relocating Outfall 001 to the main stem of Rockfish Creek. The treatment system utilizes flow equalization, dual aeration basins in parallel, two secondary clarifiers, chlorine disinfection, multimedia filters, backwash tank, post aeration tank, aerated sludge digestion, sludge thickening, and sludge drying beds. NC0003450 Page 1 COMPLIANCE REVIEW Staff Report. Wilmington Regional Office (WiRO) conducted an annual facility inspection and Steve West prepared a Staff Report dated October 29, 2001. WiRO noted that the Stevcoknit Fabrics Company transferred ownership to the Town of Wallace in 1999. As the time of inspection, the Division felt that the facility needed repairs to operate. Although concrete basins appeared in tact, above ground tanks needed painting, and electrical and mechanical components needed renovation. Division Records and Permittee's Renewal Application. Division records for Wallace #2 date from 1981. The current permit originally expired on July 31, 2001, but the Division extended the permit to January 31, 2002 to stagger intra-basin permit renewals. The permittee's request to renew the permit (NC Standard Form A) is dated July 25, 2001.1 Because this application predates August 1, 2001, the permittee is not required to collect additional Priority Pollutant Analysis (PPA) data to supplement the renewal application, per agreement with EPA. However, the Division has included a Special Condition to the permit requiring the permittee to collect PPA data annually (See Renewal Summary). Waste Load Allocation (WLA). The Division prepared the last WLA for the receiving stream in February 1996 and developed effluent limits and monitoring requirements considering an in -stream waste concentration (IWC) of 90 % at 5.0 MGD of industrial flow. This flow was modified to 4.42 MGD (September 27, 1999) and will be further revised at renewal as appropriate. Final discharge parameters and monitoring depend on future waste characterization as industrial, domestic, or some combination. The Division views the current limits and monitoring requirements appropriate for renewal except as outlined below (see Renewal Summary). Verifying Receiving Stream Conditions. This facility is proposed to discharge to Rockfish Creek [Stream Index 18-74 (29)], a Class C-Sw waterbody within the Cape Fear River Basin.$ Rockfish Creek appears on the Division's 303(d) list 5'6 and is listed as partial supporting (PS) based on habitat degradation and a historical listing for sediment based on biological impairment. The Division reviewed dissolved oxygen and temperature data upstream and downstream of the outfall (Wallace #2). Instream temperatures seemed seasonally appropriate. Dissolved Oxygen was recorded occasionally below the stream standard of 5.0 mg/L. Flows presented in Table 1 were derived at Wallace WWTP #2. DMR Effluent Data Review. The Division reviewed 45 months of DMRs (January 1999 through September 2002). Wallace #2's DMRs for this period consistently report no discharge. Total Residual Chlorine (TRC). Because the Division is finalizing a new standard for TRC and expects to introduce TRC limits in permits statewide in the near future, a TRC limit of 28 µg/L has been added to this permit. Prior to startup, the Division recommends that the Town of Wallace install de -chlorination facilities or evaluate alternate means of effluent disinfection. Whole Effluent Toxicity (WET) Testing and Ammonia. This municipality requires ammonia limits. Therefore, in cooperation with the EPA, the Division will include ammonia Weekly Averages for this renewal. The Division reviewed Wallace #2's quarterly Whole Effluent Toxicity records from January 1997 through September 2002 (a total of 21 quarterly tests). Wallace #2 shows no discharge for this reporting period. Fact Sheet Renewal -- `PLIES NC0003450 Page 2 Pretreatment Compliance. Wallace WWTP #2 is inactive and its status as a publicly owned treatment works (POTW) is undecided. Therefore, it does not receive influent from industry and has no Significant Industrial Users (SIUs). Therefore, the permittee is not required to implement a pretreatment program or Long Term Management Plan (LTMP), as specified by federal regulations 40 CFI( 403 and Title 15A NCAC 2H.0900 of state regulations. However, should industry need service in the future, the permittee must comply with this requirement. Chronic and Acute Reasonable Potential Analyses (RPA). Because there has been no discharge from this facility since before 1999, a list of pollutants of concern (POCs), has not been established. Therefore, the Division conducted no Reasonable Potential Analysis (RPA) for this renewal. POCs will be reevaluated upon receiving a proposed waste characterization from the permittee prior to startup. RENEWAL SUMMARY Prior to Startup • Relocating the Outfall — To activate this permit, the permittee must petition to approved an Authorization to Construct, a new outfall the previous Outfall 001 on Little Rockfish Creek to a new location on the mainstem of Rockfish Creek [See Special Condition A. (4.)]. • Proposed Waste Flow and Characterization — The permittee must submit for review (90-days prior to discharge) an accurate waste characterization of the intended discharge (industrial , domestic, or a combination thereof) for the Division 's approval and final adjustment of the Effluent Limits and Monitoring Requirements [See Special Condition A. (5.)]. Effluent Monitoring • Weekly Average Ammonia Limit — This permit includes a Monthly Average ammonia limit under summer flow conditions. Here's the situation: the Town of Wallace requested an ownership change for this permit earlier this year. It was a former textile plant with a 5 MGD permit. We required them to re-evaluate the treatment plant capacity and commit to relocating the outfall line from Little Rockfish Creek to Rockfish Creek below the confluence of the two creeks. The impaired stream segment is on Rockfish Creek upstream of this confluence. Therefore, no impaired streams were impacted and the permitting action did not constitute a new or expanding discharge. The permit modification for the ownership change reduced the permitted waste flow to approximately 4.2 MGD (that's from memory -- so, don't quote me on the exact number) and required them to relocate to the larger creek within two years. Of course, the permit was also modified to include standard requirements for a municipal system (85% removal of TSS and BOD5; concentration -based limits). Fish consumption advisories and impaired stream segments as a result of elevated mercury levels have been issued for several locations. NPDES permittees have worked with the state to reduce potential risks from this pollutant. including tasks associated with collecting and reporting more accurate data. The most commonly used laboratory analysis for total mercury (EPA Method 245.1) has a method detection level of 0.2 ug/1, while the current water quality standard is an order of magnitude lower at 0.012 ug/1. Thus, true compliance with the water quality standard could not be judged. A more recently approved laboratory method (EPA Method 1631) should produce a detection level below the water quality standard, which would allow the Division to assess potential water quality impacts from dischargers more accurately. Therefore. this letter serves as notification to your facility that effective September 1, 2003, you will be required to begin using EPA Method 1631 (or subsequent low-level mercury methods approved by EPA in 40 CFR 136) when analyzing for total mercury. Your facility is subject to this new requirement because either 1) your facility has a current total mercury limit in its NPDES permit that is <0.20 ug/1; or 2) your facility has limited instream dilution (i.e., the instream waste concentration (IWC) is >6%). This requirement complies with 15 A NCAC 2B.0505(e)(4), which requires that "test procedures must produce detection and reporting levels below the permit discharge requirements." Mercury Laboratory Analysis - EPA Method 1631 On June 22, 1999, the US EPA approved a new analytical method (EPA Method 1631) for measuring very low concentrations of mercury in water. Subsequent revisions to Method 1631 include Revision C (current approved method) and Draft Revision D (scheduled for promulgation in October 2002). Method 1631 has a minimum level of quantitation of 0.0005 ug/1 (0.5 ng/1), which is 400-times more sensitive than Method 245.1. The new method requires a clean laboratory environment which generally requires some lab retrofitting; thus, many permittees will likely contract a commercial lab to perform the analysis. Based on data compiled by Ohio EPA, commercial labs that are currently analyzing for EPA Method 1631 charge between $50-90 per sample. with turnaround times ranging from 5-28 days. Currently there is one commercial lab certified by North Carolina for EPA Method 1631. However, it is anticipated that several additional labs will also offer this analysis in the future as the demand for this method increases. When selecting a lab to perform low level mercury analyses, the permittee should review the lab's performance, experience, and reliability with the method, as well as cost considerations. Attachment A provides additional information on this method. Mercury Clean Sampling Techniques - EPA Method 1669 The greatest risk of contaminating the wastewater sample for low-level mercury analysis is during the sample collection effort. Thus, those facilities subject to EPA Method 1631 will also need to evaluate clean sampling recommendations provided in EPA Method 1669. Attachment A provides highlights on this method. NPDES Compliance All mercury monitoring data submitted to the Division will be reviewed for compliance with current effluent limits. If the permit contains monitoring only, the new method must still be used, and the need for a permit limit will be evaluated at a later date by comparing a statistical evaluation of the effluent data with the water quality standard and corresponding allowable effluent concentration. Therefore, the potential problem of sample contamination cannot be overemphasized, since it could result in NPDES effluent limits for total mercury, increased monitoring costs. and possibly unnecessary violations. All data submitted to the Division for NPDES compliance monitoring requirements are the responsibility of the permittee. Therefore, facilities subject to this new method are strongly encouraged to begin evaluating sampling methods and commercial labs before the deadline date, to ensure that field staff are properly trained in the use of "clean sampling" techniques. and sampling and lab procedures are fully developed to minimize sample contamination. artrfA NCDENR N. Mark Bruce NPDES Mercury Requirement Page 3 of 3 ATTACHMENT A Summary of EPA Methods 1631/1669 Effluent samples collected for mercury may become contaminated by numerous routes, including: 1) metal - containing labware, reagents. containers, and sampling equipment; 2) improperly cleaned or stored equipment; and 3) atmospheric mercury inputs in dirt and dust. Even human contact can be a source of mercury contamination (e.g., mercury amalgam fillings in the mouths of lab/field personnel can contaminate samples directly exposed to exhalation). Thus, it is essential that every effort be made to minimize sample contamination during collection. The US EPA provides recommendations to minimize contamination during sample collection in EPA Method 1669: Sampling Ambient Water for Determination of Trace Metals at EPA Water Quality Criteria Levels. This guidance describes a "clean hands/dirty hands" sampling technique to collect mercury samples, which is ideally performed with two people. A designated "clean hands" sampler handles all operations involving direct contact with the sample bottle, while the "dirty hands" sampler is responsible for all activities that do not involve direct contact with the sample bottle. This team sampling technique is recommended as a means to minimize sample contamination. but is not required. The US EPA is developing a trace metal sampling guidance strictly for effluent collection (Method 1670). The permittee will need to evaluate the various sampling recommendations and develop a sampling strategy appropriate for their particular situation. The overall philosophy behind any mercury sampling strategy should be to ensure that any object or substance that contacts the sample is nonmetallic and free from any material that may contain metals, in order to produce a reliable mercury measurement. Requirements and recommendations for EPA Method 1631 and clean sampling for low level mercury include: • It is strongly recommended that the permittee discuss sample collection, preservation. and shipping requirements with their laboratory. to ensure that the most current requirements of Method 1631 will be met. There have been several revisions to EPA Method 1631, and Revision D is proposed. • Each laboratory must perform and meet the minimum requirements of Method 1631 Quality Control. • Effluent samples for mercury analysis must be collected in clean fluoropolymer or borosilicate glass containers. It is recommended that the permittee request appropriate clean sample bottles or a mercury sampling kit from their lab. • Method 1631 requires that a minimum of one field blank accompany each set of samples collected at a given site. The field blank is used to identify contamination from sample collection and transport. If mercury is present in the field blank at levels that would compromise reliable measurement of mercury in the wastewater sample, you should assume that the sample was contaminated during collection or transit, and you will need to eliminate any source of contamination that has been identified and possibly resample. Including the field blank, the permittee should budget for two samples per monitoring event. • Samples must be preserved or analyzed within 48-hours after collection. Samples do not need to be refrigerated/iced during shipment provided they are tightly capped, shipped overnight to the lab, and preserved or analyzed by the lab within 48 hours of collection (per Draft Revision D). • If the samples are preserved within 48 hours. then they have a maximum holding time of 90 days prior to analysis (per Draft Revision D). • Sampling personnel must wear clean, non -talc latex gloves during sample collection and handling. • EPA currently recommends that mercury samples for Method 1631 analysis be collected as grab samples, since automatic composite samplers may be subject to contamination and loss of mercury via volatilization. Therefore. the Division will allow permittees to collect single grab samples directly into lab -provided sample bottles for permit requirements. The grab sample must be representative of the discharge. • If the person collecting the sample cannot directly reach the wastewater stream, a pole -type sampler may be attached to the sample bottle to extend the reach for sample collection. The pole and bottle clamp should be made of plastic and/or stainless steel and the mouth of the bottle should be held facing upstream of the pole. The use of a transfer vessel should be avoided. • All sampling equipment must be nonmetallic. or free of material that may contain metals. All materials that will directly or indirectly contact the sample must be cleaned using the procedures in Method 1631. • To minimize atmospheric contamination, do not sample during rainy weather or when the wind could blow dust particles into the sample bottle. To minimize human contamination. do not breathe into the sample bottle if you have mercury amalgam fillings in your teeth. • Sampling personnel should be trained in techniques for sampling mercury at low levels. Sample collection via the "clean hands/dirty hands" technique is recommended. but not required. • Since Method 1631 is performance -based, there is some flexibility in Method requirements. • •
