Division personnel have reviewed and approved your application for renewal of
the subject permit. Accordingly, we are forwarding the attached NPDES discharge
permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and
the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently
amended) .
As requested during the public comment period the sample types were
corrected in the permit. The final permit includes Effluent Limitations and Monitoring
Requirements for the Duckweed Treatment System. Once the Duckweed Treatment
System is completed and it starts operations modified limits for Total Suspended
Solids will take effect. In addition the sample type for BOD, TSS, ammonia, Total
Nitrogen and Total Phosphorus will change to composite.
If any parts, measurement frequencies or sampling requirements contained in
this permit are unacceptable to you, you have the right to an adjudicatory hearing
upon written request within thirty (30) days following receipt of this letter. This
request must be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings
(6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the
Division. The Division may require modification or revocation and reissuance of the
permit. This permit does not affect the legal requirements to obtain other permits
which may be required by the Division of Water Quality or permits required by the
Division of Land Resources, the Coastal Area Management Act or any other Federal or
Local governmental permit that may be required.

1. Continue to operate an existing 0.060 MGD treatment plant located on Highway 123, North
of Hookerton, Greene County and consisting of:
• influent bar screen
• three cell lagoon with adjustable effluent baffles and a small surface aerator in the
third cell
2. Upon completion of construction pursuant to Authorization to Construct 025712ACB,
operate a 0.060 MGD Duckweed Treatment System at the same location consisting of:
• Influent bar screen
• Influent Lagoon with pump station at overflow
• Duckweed Treatment System consisting of twelve (12) 30' x 100' x 4' deep
concrete basins, supernatant and recycle pumps, and duckweed collection troughs,
waste pump and chiller
• Effluent polishing filter
• Two -bank UV disinfection system
• Effluent and Stormwater pump station; and
2. Discharge from said treatment works, through outfall 001, into Contentnea Creek, a Class C-
Swamp NSW waters in the Neuse River Basin, at the location specified on the attached map.

Summary:
The Town of Hookerton submitted an application for the renewal of NPDES permit NC0025712 on January 15,
2003. The existing permit included a special condition to repair the aerator in the third lagoon. A second
special condition required the town to extend its outfall to the Creek. The town confirmed that both conditions
have been met. No other changes have occurred at the facility.
Facility Description:
The wastewater treatment facility consists of an influent bar screen, a three cell lagoon with adjustable weir
and an aerator in the third cell. The Town of Hookerton started construction of the modifications to the
wastewater treatment facility approved by an ATC issued August 24, 2001. The modified treatment system will
utilize the existing bar screen and the first lagoon. The new construction consists of a Duckweed Treatment
System including 12- 30' x 100' x 4' deep concrete basins, supernatant and recycle pumps, and duckweed
collection troughs, waste pump and chiller, an effluent polishing filter, two -bank UV disinfection system and
effluent and stormwater pump station. Construction is expected to be finished by November of 2004.
Basin Plan:
Contentnea Creek is listed as supporting from Wiggins Mill Dam to the Neuse River confluence.
Pre -Treatment:
Hookerton has no Significant Industrial Users.
DMR Review:
DMR data were reviewed for the period of January 2002 to December 2003. The facility does not discharge
continuously. In 2002 and 2003 they discharged only four months each year.
Compliance Summary:
The facility received the following Notices of Violations: Weekly and monthly limit violations of Fecal Coliform
in July 2000, monthly limit violation of Fecal Coliform in September 2000, weekly and monthly limit violations of

Fecal Coliform in April 2002, effluent monitoring frequency violations on April 2001, violation of the monthly
average limits for BOD and TSS for April 2001, BOD monthly average violation in October 2000
The Town is under an SOC for the construction period with relaxed limits for BOD, TSS and Fecal Coliform.
SUMMARY OF PROPOSED CHANGES
• A footnote was added to the effluent limitations and monitoring requirements to clarify that
monitoring for Total Residual Chlorine is only required if chlorine or a derivative is used for
disinfection. At present the town does not use chlorine for disinfection. To meet the TRC policy
adopted in April 2003, a daily maximum limit of 28 mg/I was added for total residual chlorine.
Facilities that didn't have TRC limits will get limits at permit renewal time.
• Conductivity monitoring was removed from the permit requirements. Facilities treating 100 %
domestic flow are not required to monitor conductivity.

Effluent Limitations and Monitoring Requirements:
A limits page was added to the permit with limits for the Duckweed Treatment System. TSS limits of 30 mg/I
monthly average and 45 mg/I daily maximum were implemented. TSS limits in the current permit apply to the
lagoon system. The Duckweed system is expected to meet TSS limits of < 8 mg/I. All other limits in the draft
permit will remain unchanged.

The Town has verbally requested to modify their SOC Attachment A. The Town is part
of the Neuse River Sampling Coalition and their present monitoring requirements are
different than the other Municipalities in the coalition. The coalition has hired a
company to pull samples for them and the monitoring requirements are similar in nature
except for the Town of Hookerton's. The Town is collecting samples at different time
periods, which has become a financial burden. They have requested that their sampling
intervals be similar to their counterparts. This office has modified Attachment A to
correspond with their draft permit, which should have the same monitoring time intervals
as their counterparts.

Pursuant to amended North Carolina General Statute 143-215.3D. effective January 1, 1999, water
quality fees have been revised to include an annual fee for any permit covered under a Special Order
by Consent in addition to the annual fee for the permit. The County will he subject to a fee of S250.00
on a yearly basis while under this order. in addition to an annual permit fee of S715.00. The Town

Pursuant to provisions of North Carolina General Statutes (G.S.) 143-215.2, this Special Order
by Consent is entered into by the Town of Hookerton, hereinafter referred to as the Town, and
the North Carolina Environmental Management Commission, an agency of the State of North
Carolina created by G.S. 143B-282, and hereinafter referred to as the Commission:
1. The Town and the Commission hereby stipulate the following:
(a) The Town holds North Carolina NPDES Permit Number NC0025712 for operation of
an existing wastewater treatment works and for making an outlet therefrom for treated
wastewater to Contentnea Creek, Class C-Swamp NSW waters of this State in the
Neuse River Basin, but is unable to consistently comply with final effluent limitations for
BOD, TSS, and Fecal Coliform as set forth in NPDES Permit Number NC0025712.
Compliance will require preparation of plans and specifications for construction and
operation of additional treatment and collection works.
(b) Noncompliance with final effluent limitations constitutes causing and contributing to
pollution of the waters of this State named above, and the Town is within the
jurisdiction of the Commission as set forth in G.S. Chapter 143, Article 21.
(c) The Town has secured a grant or has otherwise secured financing for planning, design,
or construction of a new or improved waste disposal system which, once properly
constructed and properly operated and maintained, should be sufficient to adequately
treat wastewater presently being discharged and the additional wastewater desired to be
discharged, to the extent the Town will be able to comply with final effluent permit .
limitations.
(d) Since this Special Order is by Consent, neither party will file a petition for a contested
case or for judicial review concerning its terms.
2. The Town desiring to comply with the Permit identified in paragraph 1(a) above, hereby
agrees to do the following:
a) Undertake the following activities in accordance with the indicated time schedule:
1) On or before July 14, 2003 begin construction. (Met)
2) On or before November 1, 2004 complete construction.

(b)
3) On or before March 1, 2005 achieve compliance with all final permit effluent
limitations.
4) Provide the Washington Regional Office with quarterly progress reports.
Reports are due within 30 days following the end of each calendar quarter. The next
report is due October 31, 2003 for the July through September 2003 quarter.
The Town shall comply with all terms and conditions of the permit except those effluent
limitations identified in paragraph 1(a) above. See Attachment (A) for all monitoring
requirements and effluent limitations. The Permittee may also be required to monitor for
other parameters as deemed necessary by the Director in future permits or administrative
letters.
(c) During the time in which this Special Order by Consent is effective, the Town shall
comply with interim effluent limitations as contained in Attachment (A).
Under this Special Order by Consent, ONLY the parameters listed below have been
modified from the most current NPDES Permit currently in effect.

(d) No later than fourteen (14) calendar days after any date identified for accomplishment of
any activity listed in 2(a) above, submit to the Director of DWQ written notice of
compliance or noncompliance therewith. In the case of noncompliance. the notice shall
include a statement of the reason(s) for noncompliance. remedial action(s) taken, and a
statement identifying the extent to which subsequent dates or times for accomplishment
of listed activities may be affected.
Develop and adopt sewer use ordinance limitations for non -conventional pollutants.
Implement the pretreatment program as approved by the Director, including the
enforcement of both categorical pretreatment standards and local limits.
Identify any Infiltration and Inflow problems associated with the facility and establish a
program to correct.

3. The Town agrees that unless excused under paragraph four (4), the Town will pay the
Director of DWQ, by check payable to the North Carolina Department of Environment,
Health and Natural Resources, stipulated penalties according to the following schedule for
failure to meet deadlines set out in paragraphs 2(a) and 2(c), or failure to attain compliance
with the effluent limitations/monitoring requirements contained in Attachment (A).

4. The Town and the Commission agree stipulated penalties are not due if the Town satisfies the
Division of Water Quality noncompliance was caused solely by:
a. An act of God;
b. An act of war;
c. An intentional act or omission of a third party, but this defense shall not be available if
the act or omission is that of an employee or agent of the defendant or if the act or
omission occurs in connection with a contractual relationship with the Permittee;
d. An extraordinary event beyond the Permittee's control. Contractor delays or failure to
obtain funding will not be considered as events beyond the Permittee's control; or
e. Any combination of the above causes.
Failure within thirty (30) days of receipt of written demand to pay the penalties, or challenge
them by a contested case petition pursuant to G.S. 150B-23, will be grounds for a collection
action, which the Attorney General is hereby authorized to initiate. The only issue in such an
action will be whether the thirty (30) days has elapsed.
5. This Special Order by Consent and any terms, conditions and interim effluent limitations
contained herein, hereby supersede any and all previous Special Orders, Enforcement
Compliance Schedule Letters, terms, conditions, and limitations contained therein issued in
connection with NPDES Permit No. NC0025712. In the event of an NPDES Permit
modification or renewal, any effluent limitations or monitoring requirements contained therein
shall supersede those contained in Attachment (A) of this Special Order by Consent, except as
modified and contained in paragraph 2.(c) above.

6. Noncompliance with the terms of this Special Order by Consent are subject to enforcement
action in addition to the above stipulated penalties, including injunctive relief pursuant to G.S.
143-215.6.(C).
7. The Permittee, upon signature of this Special Order by Consent, will be expected to comply
with all schedule dates, terms, and conditions of this document.
8. This Special Order by Consent shall expire June 1, 2005.

On April. 1.4, 2003 the Town received notification that the USDA Rural
Development loan and grant Has approved.

loan documents were recorded in the Greene County Courthouse.
July 2, 2003, Inco, Inc., Contractor was notified that approved contract
will commence on July 14, 2003.
• Construction began on July 14, 2003 and scheduled to he completed in 12
months.

2003 contract deadline to March 31, 2004. As previously mentioned, the USDA

with news media coverage, to recognize all those individuals and funding

Project Description
Town of Hookerton
Wastewater Treatment Plant Modifications
The Town of Hookerton currently utilizes a three -lagoon wastewater treatment
system. This system does not currently treat the effluent from the Town of
Hookerton to acceptable levels in accordance with the permitted standards for
BOD and TSS (or TSR) during summer months. The state has mandated that
the Town of Hookerton develop a solution that would treat the effluent to
allowable nutrient limits. As a result the Town of Hookerton has contracted with
The East Group, P.A., to design a wastewater treatment facility upgrade, which
will use a unique nutrient -removal technology using duckweed.
The proposed project consists of modifications to the Town of Hookerton's
existing Wastewater Treatment Facility as indicated below:
1. An earthen berm that will span between existing lagoons #1 and #3 and
will protect the site from the 100-year flood event.
2. A storm water pump station that will be constructed within the bermed
area to capture and remove accumulation of stormwater during a storm
event and also to prevent flooding of the system.
3. 12-nutrient removal basins, which include a concrete chamber and a
greenhouse cover, will be constructed to house the duckweed. These
chambers will have a surface area of approximately 0.9 acres and will
provide over 18 days of retention at the current flow rate of 40,000 gpd.
Effluent from lagoon #1 will enter these basins where the growing
duckweed will absorb the nutrients from the effluent as the primary
treatment.
4. The dual -chamber recycle/sand filter will provide secondary treatment as
the effluent from the basins are pumped from the basins to the filters
and then to an effluent pump station.
5. An effluent pump station will be constructed to discharge treated effluent
to lagoon #2 for discharge to the Contentnea Creek as permitted.
A portion of the duckweed within the basins will be harvested daily and pumped
to a screen filter for storage and removal off site.
The process for treatment in the proposed system is as follows:
Effluent from the Town of Hookerton will enter into Lagoon #1 and pass into the
nutrient removal basins. In the nutrient removal basins the growing duckweed
will absorb nutrients from the effluent. Treated effluent is then pumped to the
recycle/sandfilter basin for filtration. Once effluent is filtered, it is pumped into
lagoon #2 and then gravity flows to lagoon #3 for discharge into Contentnea
Creek as permitted.

Thank you for your letter of August 12, 2002 regarding the potential for
additional funding from the Clean Water Management Trust Fund to assist the Town of
Hookerton with its Duckweed Wastewater Treatment Project. CWMTF provided a grant
of up to S790,000 to the Town to construct an innovative duckweed wastewater treatment
system in 1999 (CWMTF Project #1999A-502).
As I pointed out in my letter of July 2, 2002, CWMTF will not be able to respond
to the Town's request for additional funds until after the General Assembly appropriates
additional funds to CWMTF later this year. Last February Governor Easley cut
CWMTF's budget by S20.8 million to help balance the State's 2001-02 budget.
Consequently CWMTF has been unable to fund many projects that the Board of Trustees
approved last year. The Board of Trustees' first priority is to provide funds to projects
approved last year.
CWMTF's Infrastructure/Wastewater Committee and Board of Trustees will meet
October 27-28, 2002 in Montgomery County. I will put the Town's request on the
committee's agenda. Please send a formal request and revised budget to my attention no
later than October 4, 2002. Final decisions — subject to the appropriation of funds — will
be made on November 13, 2002 in Raleigh.
Your letter of August 12 asked if CWMTF would reimburse the Town for "after
the fact" expenses. Yes, in rare circumstances — subject to approval by the Board of
Trustees — CWIvITF will reimburse a local government for expenses it incurred before a

I am respectfully requesting in writing as committed by telephone, the
questions I asked the last time we discussed the potential for any further
funding for our Duckweed Waste Water Treatment Project.
First, please again accept the acknowledgment that the Town of Hookerton's
elected officials and it's citizens greatly appreciate everything the CWMTF
has already done for us.
We are aware of the announced state wide budget dilemma and its impact
preventing any possible immediate ability for CWMTF to commit additional grant
funding. With that knowledge, I respectfully ask, has CWMTF ever, or could or
would they ever, consider after the fact grant funding to enable a
municipality to pay a delayed project debt?
We have a subcontractor within the low bid for Hookerton's Duckweed Waste
Water Treatment Project indicating a willingness to delay his payment for
services and materials up to at least 10 years. There would be interest based
on the actual delayed payment period at a rate to be negotiated. This
agreement could be an enabler for the Town to proceed with construction. Our
remaining funding need (even after applying an approved loan commitment to the
Town of Hookerton for $117,000 from the GTP Development Commission through
Greene County) is $244,644 which includes a 10% contingency addition to the
low bid of $1,546,949.
As I stated to you on the phone, a significant portion of Hookerton's existing'
469 citizens (many of which are seniors) would probably not live long enough
to see the end of a long term debt service for our community. Reference to a

long term debt service is with an assumption that we would qualify through LGC
if we committed to try to borrow the remaining funds needed.
Please consider whether the CWMTF could commit additional grant funds for this
project which would not have to be drawn upon for several years.

its meeting on October 28, 2002. The Board did not approve the Town's request for
additional funding.
The original project budget was $1.14 million and is now nearly $1.8 million.
CWMTF supported the original $1.14 million project because it would have been a goad
investment of CWMTF funds to help demonstrate the potential usefulness of this
technology for small systems in North Carolina. As you know, duckweed wastewater
treatment technology is not proven in North Carolina. Now that the project costs have
increased to nearly $1.8 million, there are other proven technologies and other
alternatives that become more economical than the proposed system. For this reason, the
Board did not approve the Town's request.
CWMTF urges the Town to seek private investors or seek a low -interest loan
from the US Department of Agriculture to finance to the additional $249,644.

was recently extended to Sept. 30, 2003 to allow the Town time to secure other funding.

15A NCAC 02B .0226 EXEMPTIONS FROM SURFACE WATER QUALITY STANDARDS
Variances from applicable standards, revisions to water quality standards or site -specific water quality
standards may be granted by the Commission on a case -by -case basis pursuant to G.S. 143-215.3(e),
143-214.3 or 143-214.1. A listing of existing variances shall be maintained and made available to the
public by the Division. Exemptions established pursuant to this Rule shall be reviewed as part of the
Triennial Review of Water Quality Standards conducted pursuant to 40 CFR 131.10(g).

15A NCAC 02B .0227 WATER QUALITY MANAGEMENT PLANS
(a) In implementing the water quality standards to protect the existing uses [as defined by Rule .0202 of
this Section] of the waters of the state or the water quality which supports those uses, the Commission shall
develop water quality management plans on a priority basis to attain, maintain or enhance water quality
throughout the state. Additional specific actions deemed necessary by the Commission to protect the water
quality or the existing uses of the waters of the state shall be specified in Paragraph (b) of this Rule. These
actions may include anything within the powers of the Commission. The Commission may also consider
local actions which have been taken to protect a waterbody in determining the appropriate protection
options to be incorporated into the water quality management plan.
(b) All waters determined by the Commission to be protected by a water quality management plan are
listed with specific actions as follows:
The Lockwoods Folly River Area (Lumber River Basin), which includes all waters of the lower
Lockwoods Folly River in an area extending north from the Intracoastal Waterway to a line extending from
Genoes Point to Mullet Creek, shall be protected by the specific actions described in Subparagraphs (1)
through (5) of this Paragraph.
(1) New development activities within 5750 of the mean high water line which require a
Sedimentation Erosion Control Plan or a CAMA major development permit must comply
with the low density option of the coastal Stormwater Runoff Disposal Rules [as
specified in 15A NCAC 2H .1005(2)(a)].
(2) New or expanded NPDES permits shall be issued only for non -domestic, non -industrial
process type discharges (such as non -industrial process cooling or seafood processing
discharges). A public hearing is mandatory for any proposed (new or expanded) NPDES
permit to this protected area.
(3) New non -discharge permits shall be required to meet reduced loading rates and increased
buffer zones, to be determined on a case -by -case basis.
(4) New or expanded marinas must be located in upland basin areas.
(5) No dredge or fill activities shall be allowed where significant shellfish or submerged
aquatic vegetation bed resources occur, except for maintenance dredging, such as that
required to maintain access to existing channels and facilities located within the protected
area or maintenance dredging for activities such as agriculture.

NON-TAR-PAMLICO BASIN ASSOCIATION MEMBERS
(a) All waters of the Tar -Pamlico River Basin have been supplementally classified nutrient sensitive waters
(NSW) pursuant to 15A NCAC 2B .0223. The following procedures are to be implemented in accordance
with 15A NCAC 2B .0223 in all waters of the Tar -Pamlico River Basin for those wastewater dischargers
who are not members of the Tar -Pamlico Basin Association; (b) Existing wastewater dischargers expanding to greater than 0.5 million gallons per day (MGD who are

not members of the Tar -Pamlico Basin Association, shall be required to offset their additional nutrient
loads by funding nonpoint source control programs approved by the Division of Wat€:. Quality prior to the
issuance of their NPDES permit and at each renewal. Nitrogen and phosphorus loads shall be offset at the
rate of 110 percent of the cost to implement BMPs designed to reduce that same load created by expanding
the discharge above 0.5 MGD. Equations for calculating the offset costs are:
(1) For an existing facility with permitted flow of less than or equd: to 0.5 MGD as of
December 8, 1994 expanding to greater than 0.5 MGD who is not a member of the Tar -
Pamlico Basin Association: x (BMPc x 1.1) where:

Payment = the nutrient offset payment ($);

was once a borrow pit and filled in when the excavation ended. It was not constructed to provide

3/5/01 Telecon with Tyndall Lewis, Town of Hookerton's Consultant 919-736-7630
Hookerton's outfall is to a small shallow creek, have been discharging there for 40 years.
Originally had a 1 cell lagoon, and two additional cells were added on later. Mr. Lewis, seems to think
there there is only one point of discharge from the system from the 3`d lagoon. Told him that when we
visited the site in May 2000, there were two outfalls , one from the lagoon system and one from the "pond"
or "stormwater pond". He says that there shouldn't be another pond, during wet weather times, a low area
may have filled up but there is no other pond. Also admitted that he had not been to the site in several
years, but will be visiting it soon and will see if there is another discharge.
The banks of Contentnea Creek are very unstable. Nothing to keep the pipe from filling back in. You run
the risk of it being undermined. The channel was a man made constructed ditch, trying to convey ww to
Contentnea Creek. Around the outfall is rip rap or used to be originally. During low flows, the channel is
more visible, but during wet weather its full of water . It's about 100 feet to the Creek from the outfall.
The Town's argument is that it would take a lot of money to stabilize an outfall directly into Contentnea
Creek. Boats could hit the outfall, the pipe is subject to be filled in, during flood conditions and this area
floods a lot. You would be putting the end of the pipe in an unstable location. To construct the outfall
would be difficult and costly for a small town of Hookerton.
Asked about it being an effluent channel, 1) the channel is completely on Hookerton's land, 2) should be no
other water other than effluent in the channel. An old drain had been plugged(?) 3) Doesn't know how we
could keep fish out. Its in a flood plain, the land goes under water. Unsure what you could construct to
keep fish out and what you construct may not allow them to escape if they are caught in the channel. Town
just doesn't see the benefit of extending the outfall. Have been discharging here for 40 years.
Mr. Lewis recommended a conference call tomorrow morning with the Town's ORC, for more discussion
about the outfalls.
