Hi Brad,
The Division has reviewed your application for the above noted project and requires additional information in order to
complete our review. Please provide a response to the items below within 30 days of receipt of this email. Please note
that the application will be considered "on hold" until a complete response has been received.
1. As you are aware, this project is within the large NC Commerce Park. Pursuant to 404 and 401 authorizations
issued related to the infrastructure of the park, all future impacts may be considered cumulative to the overall
"project" of the NC Commerce Park We acknowledge that this application proposes a mitigation plan for the
current impacts as they are cumulative to previous impacts within the overall Commerce Park. The Division
would like to make it clear to all parties that this project is considered cumulative with the previous
projects. Files for previous project are accessible through our online electronic system.

2. Given that there has been a previous jurisdictional determination for this property as part of the larger NC
Commerce Park, and that it appears the current delineation is slightly different than the original one, the
Division requests that confirmation be provided by the USACE that the current delineation has been/will be
verified and replace the prior delineation.
