Director Division of Water Quality June 26, 2006 Ms. Jonna A. Stein Chemical Specialties, Inc. P. O. Box 1330 Harrisburg, NC 28075 Subject: Waiver of Monthly Reporting Requirement Chemical Specialties, Inc. WWTP NPDES Permit NC0006351 Cabarrus County Dear Ms. Stein: Title 15A of the North Carolina Administrative Code, Subchapter 2B, Section .0506 enumerates specific reporting requirements applicable to holders of NPDES permits issued by the State of North Carolina. 15A NCAC 2B .0506 (a)(1)(E) states that permittees must continue to submit monthly discharge monitoring reports (DMRs) to the Division of Water Quality, even when there is no discharge from the facility during the reporting period. This requirement may be waived by the Director of the Division of Water Quality during extended periods of no discharge. I have reviewed your correspondence of June 12, 2006 that described the current status of the Chemical Specialties, Inc. (CSI) WWTP. You note the facility has not experienced a discharge since June 2003 due to low production. This situation is not expected to change in the foreseeable future. Additionally, rainfall amounts in the area have been low enough such that evaporation has exceeded precipitation in the lagoon, and kept its level from rising due to any non -industrial contribution. Though the system does not have potential to discharge at this time, CSI plans to continue to inspect the lagoon's perimeter on at least a weekly basis and would notify the Division of any change in its status. CSI has certified operators on its staff who would be able to quickly respond to any changing circumstances. After reviewing the facility's file and considering the recommendation of the staff of the Mooresville Regional Office, I have agreed to waive the requirement to submit monthly DMRs for the subject facility, effective with the July 2006 DMR. Additionally, I hereby waive the requirement for operator visitation at this facility. Please keep the Surface Water Protection Section of the Mooresville Regional Office apprised of any pertinent developments that arise regarding the future use of this facility. Please be aware that if the facility exhibits a potential for discharge of treated wastewater, visitation, monitoring and reporting must resume as required by the terms of the permit and North Carolina's environmental laws.
