REQUEST FOR MORE INFORMATION
Dear Mr. Kanner:
On September 10, 2007, the Division of Water Quality (DWQ) received your After-the-Fact application
dated August 21, 2007, to fill or otherwise impact 0.06 acres of 404/Wetland (0.02 acres of fill impact,
0.04 acres of flooding impacts), to construct the proposed pond for stormwater retention and as a amenity
pond. The DWQ has determined that your application was incomplete and/or, provided inaccurate
information as discussed below. The DWQ will require additional information in order to process your
application to impact protected wetlands and/or streams on the subject property. Therefore, unless we
receive five copies of the additional information requested below, we will have to move toward denial of
your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete
until we receive this additional information. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
1. Please provide a copy of the Buncombe County Soil Survey with the project boundaries clearly
shown.
2. Please verify that the U.S. Army Corps of Engineers will allow the permitting of a stormwater
device in a 404/wetland.
3. Please re-submit your site plans on full plan sheets at a scale of no smaller than 1 "=50', clearly
indicating contour lines and proposed impounded area (normal pond level elevation and depth) in
plan and profile view.
4. Please provide cross section details showing the provisions for aquatic life passage.
5. Please locate all isolated or non-isolated wetlands, streams, and other Waters of the State as
overlays on the. site plan.

6. Please provide structural design drawings and details for the dam, including the plan and profile
views illustrating the height, toe, materials, and spillway.
Please submit a minimum water release plan for the proposed dam. The plan must include a
written explanation of the specific discharge rate and mechanism to provide for each required
release. The plan must also include any design specifications, details and calculations to show
that the release shall be achieved in the given conditions. The plan shall also include monitoring
that ensures compliance. The plan and any associated facilities, once approved, must be in place
and implemented upon the completion of the dam.
8. Please provide monitoring data from similar projects in your county demonstrating that the
proposed pond will not violate water quality standards in regards to temperature, dissolved
oxygen and iron.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter, your project will be withdrawn
and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
