Thank you for meeting with us on December 2, 2015, in Fayetteville to discuss our current Sager
Creek Vegetable Company, Turkey, NC process water lagoon freeboard limit challenges and our
proposal to develop a corrective action plan.
We very much appreciated your constructive input as well as all of the historical background
information that you provided for .our facility in the meeting. This input and 'background
information will be used by us in crafting and completing the necessary 'study tasks required for
development of our factory corrective action plan.
Pursuant to our meeting discussions this is to confirm that we seek to complete corrective actions
at our factory under the terms of a Special Order of Consent ("SOC"). We plan to file the required
application forms for you to develop the SOC on or before January 31, 2016.
Be assured that our goal is to develop and implement lastingcorrective actions at our factory that
will bring our systems back into full compliance with lagoon freeboard requirements on a year-
round basis.
We agree with you that our site is complex and for this reason we truly appreciate your open
willingness to work with us on the time frame for our study and the phasing of any necessary site
improvements that may be identified in our final corrective action plan.

Our corrective action plan will likely be complex and may include different processing of crops,
reduced plant production, modified Or new storage ponds, new spray irrigation fields, changes to
factory manufacturing practices, in -plant water flow reductions, or some combination of all of
these actions to bring systems back into hydraulic balance moving into future years.
Note that our consultant has already started to work on the design for upgrading our factory
domestic sanitary wastewater systems and we plan to submit the required permit application for
these new systems before March 1, 2016.
Please be assured that we are committed to 'correcting things at our factory and we look forward
to your input and support as we move forward to develop and implement our factory corrective
action plan.
