He is in the ,process of updating maps of the existing spray irrigation fields. This project, is scheduled to be completed within 30 days, at which time I will forward the information to your attention. Secondly, concerning the items listed on the second page of your correspondence, we presently have contractors looking at all three items and expect to have quotes within 90 days. Upon receipt of the quotes, the projects will be let and should be completed within 6 months. In response to the question on page 3 of your correspondence relating to the status of our recycling system, this morning I spoke to Tommy Langston, the Plant Manager. He informed me that the facility has begun practicing a water management and reduction program.The plant is already, seeing approximately 30% reduction in water usage. This program includes measures to maintain the levels of the lagoons by adding no more water -than the volume removed by irrigation. In evaluating the current water use at the facility and their ability to reduce usage, I have contacted an engineering firm in North Carolina, who has scheduled a site visit to ascertain what will be needed to design a new irrigation system on property already owned by the company. Once this determination and a cost projection are completed,' we expect the design to be completed within 4 months. At that time :we will be requesting a fast track permit for the construction. Upon approval we expect to have the construction completed within 8 to 12 months. Ross, Jr., Secretary Alan W. Klimek, P.E., Director A recent review of spray irrigation field monitoring data revealed several problem's that need immediate attention. According to the existing Permit the spray irrigation areas at the Turkey facility_ are divided into four zones, A,B,C & D for a total applicable acreage of 72.78 acres.A review of the division's monitoring data base raised questions regarding the compliance of the annual hydraulic limitations for various fields. =It appears based on data submitted that the hydraulic limits have been exceeded on some of the fields. I have personally `visited the site and to observe the problem and ,now have a better understanding of the current situation. It seems that the Permit issued` on November 2, '2001 has 'inaccurate spray: acreage. Based on our calculations measured on the ground and information submitted by your consultant, Soils and Materials Engineering (S&ME), the actual acreage utilized is approximately 102 acres. The specific zone identity and acreage in the existing Permit is inaccurate and confusing. It is my opinion that the sites initially permitted are being utilized. A segment of one of the zones was utilized as a borrow pit to enhance the structural integrity of the dam on the second stage lagoon. This letter requests that Allen Canning Company submit new maps with accurate acreage and zone identity for both your company and the Division of Water Quality. Our data base is indicating that your company is now in violation of the current Permit. The following items also need immediate attention: 1. In the original zone, there is a large depression that we were advised would be eliminated during the maintenance performed on the dam of the second stage lagoon. This was not performed. It has become a catch basin for rainwater, a maintenance problem which has resulted in loss of acreage in this zone. Please advise when this necessary maintenance item will be completed. 2. The pump station slid into the lagoon. This is considered an emergency maintenance item and should be corrected as soon as possible. A pump station has been rigged to spray irrigate wastewater, however, OSHA may be inspecting one day and find many safety. concerns. This needs prompt attention. 3. The Permit issued on November 2, 2001 calls for solid set irrigation system, with permanent piping hydrants, valves, etc. The only solid set system is the original field that was present when Allen Canning Company originally bought this facility. The maps that have been requested with accurate zones and acreage should reflect the reel irrigation layout that is being currently utilized. The main wastewater system should be permanent. The permanent wastewater conveyances are part of the issued Permit and need to be appropriately installed. The existing situation is a Permit violation that needs your immediate attention. Please provide a Plan of Action to this office for the above three items by March 30, 2005. Allen Canning Company. An exceedance of Groundwater Quality Standards at, or beyond the Compliance Boundary is, subject to immediate remediation action in addition to the penalty provisions applicable under General 'Statute 143- 215.6A(a)(1). 8. In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the disposal systems midway between .the Compliance Boundary and the perimeter of, the waste disposal area. GWS-RO Reviewer: Billy Meyers Allen Canning Company of Turkey, NC (formerly Green Giant and Joan of Arc) is proposing to expand its industrial wastewater treatment capacity from 0.300 mgd to 0.415 mgd by adding spray irrigation facilities. No other treatment improvements are proposed in this expansion request. Several concerns exist relative to this expansion: a. The proposed expansion is based on capacity of existing treatment units incorrectly described in the existing permit. Specifically, the existing permit, in the 4`'' line names ".... three acre (50 million gallon) final settling lagoon .......". We believe that this treatment `lagoon' actually contains only 5 million gallons (if that much) and the permit should be corrected accordingly. b. This same `final settling lagoon' receives canning wastewaters which are typically organically loaded with over 4001bs BODS /acre (a more reasonable value that would effect organic treatment might be 40 lbs BOD/acre) with possibly low nutrient and oxygen availability thus preventing in -basin aerobic organic assimilation. Odors, solids accumulation and noxious conditions prevail in this earthen basin, including the potential to seep into the local groundwater system. C. The existing (Area A) and proposed spray fields (Areas B, C and D) are located up gradient to several groundwater receptors, specifically, a water supply well for an adjacent house and Mill Run Creek. Therefore, it is proposed that one additional monitoring well be installed (MW-4) and placed near the railroad embankment, cross gradient to the proposed area " C " as shown on the attached map. An additional well (MW-3) has all ready been placed between areas "D" and the Mill Run Creek. d. The applicant is proposing "seasonal" use of area " D " along with pre -monitoring to Page 1 of 5 insure that more than three feet separation exists between the land surface and the groundwater table before land spraying. From a `calculation standpoint', we concur with this approach used by the applicant to size the irrigation system. The effect is to limit these bottomland soils (Area D) to no more than 43 inches of spray water per year. In a like manner, the Areas B and C soils are to receive no more than 62 inches per year and Area A, no more than 78 inches per year. However, from a `use standpoint', and in lieu of "seasonal restrictions", we propose that the operator merely insure that a depth to water table exceeds 3_ feet within'twenty-four hours before. applying spray to Area D. In other words, if drought conditions occurred in December (a normal "seasonal restrictions" month) and the water table were measured to be more than 3 feet below the surface at MW-3, then the applicant could -spray (providing an adequate land cover exists) to drain storage before what could be a potentially wet spring. "Seasonal Restrictions" might otherwise cause this to be an enforceable action subject to civil penalty, rather than a wise operating procedure. The Groundwater Section has reviewed the subject permit modification application and recommends reissuance of the permit with the following conditions: (1) Within 90 days -of permit issuance, 1 additional monitor well (3 currently exist; 2 from the old spray area and 1 from the lithologic studies in support of this permit) shall be installed to monitor groundwater quality. The well shall be constructed such that the water ' level in the well is never above or below the screened (open) portion of the well at any time during the year. The general location and name for the well is marked on Attachment A as MW-4. The monitoring well shall be located at the review boundary, constructed in accordance with this permit, and approved by the Fayetteville Regional Office. The well must be constructed by a North Carolina Certified Well Contractor, the property owner, or the property lessee according to General Statutes 87-94.4(b)(2). If construction is not performed by a Certified Well Contractor, the property owner or lessee must physically perform the actual well construction activities and the well(s) must meet the North Carolina Well Construction Standards (15A NCAC 2C .0100). (2)' Monitor wells (MW-3, and MW-4) shall be sampled initially after construction (and prior to waste disposal operations in the new fields) and thereafter every March, July and November (sampling to be done within 1 to 7 days following application of spray disposal) for the following parameters: Chemical Oxygen Demand, Total Organic Carbon (TOC), Total Dissolved Solid, pH, Nitrate, Chloride, Sulfate. If animal grazing is used on the spray fields, then fecal coliforms must be reported also. Monitor wells MW-1 and MW-2 shall be sampled on this same frequency and parameter list. (3) The measurement of water levels must be made prior to sampling for the remaining. parameters. The depth to water in each well shall be measured from the surveyed point on the top of the casing. (4) The measuring points (top of well casing) of all monitoring wells shall be surveyed to Page 2 of 5 provide the relative elevation of the measuring point for each monitoring well. (5) If TOC concentrations greater than 10 mg/l are detected in any downgradient monitoring well, additional sampling and analysis must be conducted to identify the individual constituents comprising this TOC concentration. If the TOC concentration as measured in the background monitor well exceeds 1Q mg/l, this concentration will be taken to represent the naturally occurring TOC concentration. Any exceedances of ' this naturally occurring TOC concentration in the downgradient wells shall be subject to the additional sampling and analysis as described above. (6) All reports and documentation (MW-1, 2,3 and 4) shall be mailed to the following address: Groundwater Section Permits and Compliance.Unit 1636 Mail Service Center Raleigh, NC 27699-1636 (7) The results of the sampling and analysis must be received on Form GW-59 (Groundwater Quality Monitoring: Compliance Report Form) by the Groundwater Section (address listed. above), on or before the last working day of the month following the sampling month. The data of all groundwater sampling analyses required by the permit conditions must be reported using the most recent GW-59 form along with'attached copies of the laboratory analyses. The updated forms can be downloaded using the following internet website: http:// w.ehnr.state.nc.us/. (8) For the initial sampling of the wells MW-3 and MW-4, the permittee shall submit a copy of the OW-1 Form (Well Completion Form) with the Compliance Monitoring -Form (GW-59) for each well to the address listed in the "Reporting. / Documentation" section of the Groundwater Requirements. Initial Compliance Monitoring Forms that do not include copies of the GW-1 form will be returned to the permittee without being processed. Failure to submit these forms as required. by this permit may result in the initiation of enforcement activities pursuant to NC General Statutes 143-215.6. (9) Any laboratory selected to analyze parameters must be Division of Water Quality (DWQ) certified for those parameters required. (10) Any additional groundwater quality monitoring, as deemed necessary by the Division, shall be provided. (11) The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in 15A NCAC 2L, Groundwater Classifications and Standards. The Compliance Boundary is for the disposal system individually permitted after December 31, 1983 is established at either (1) 250 feet from the waste disposal area, or (2) 50, feet within the property boundary, whichever is closest to the waste disposal area. An exceedarice of Groundwater Quality Standards at or beyond the Compliance Boundary is subj ect to immediate remediation action in addition to the penalty provisions applicable under General Statute 143-215.6A(a)(1). 'Page 3 of 5 (12) In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the disposal systems midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of standards at the Review Boundary shall require remediation action on the part of the permittee. (13) All wells that are constructed for purposes of groundwater monitoring shall be constructed in accordance with 15A NCAC 2C .0108 (Standards of Construction for Wells Other than Water Supply) and any other state and local laws and regulations pertaining to well construction. (14) The Fayetteville Regional Office, telephone number (910) 486-1541 shall be notified at least forty-eight (48) hours prior to the construction of any monitoring well so that an inspection can be made of the monitoring well location. Such notification to the regional groundwater supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding state holidays. (15) Within sixty (60) days of completion of all monitoring wells; the permittee shall submit two original copies of a scaled topographic map (scale no greater than 1": 100') signed by a technician specialist that indicates all of the following information: A. the location and identity of each monitoring well, B. the location of all components of the waste disposal system, C. the location of all property boundaries, D. the latitude and longitude of the established horizontal control monument, E. the relative elevation of the top of the well casing (which shall be known as the "measuring. point"), and F. the depth of water below the measuring point at the time the measuring point is established. This survey shall be conducted using approved practices outlined in North Carolina General Statutes Chapter 89C and the North Carolina Administrative Code Title 21, Chapter 56. The surveyor shall establish a horizontal control monument on the property of the waste disposal system and determine the latitude and longitude of this horizontal control monument to a horizontal positional accuracy of +/-10 feet. All other features listed in a. through e. above shall be surveyed relative to this horizontal control monument. The positional accuracy of features listed in a. through e. above shall have a ratio of precision not to exceed an error of closure of 1 foot per 10,000 feet of perimeter of the survey. Any features located by the radial method will be located from a minimum of two points. Horizontal control monuments shall be installed in such a manner and made of such materials that the monument will not be destroyed due to activities that may take place on the property. The map shall also be surveyed using the North American Datum of 1983 coordinate system and shall indicate the datum on the map. All bearings or azimuths shall be based on either the true or NAD 83 grid meridian. If a Global Positioning System (GPS) is used to determine the latitude and longitude of the horizontal control monument, a GPS receiver that has the capability to perform differential GPS shall be used and all data collected by the GPS receiver will be differentially corrected. (16) Within thirty (30) days of completion of all well construction activities, a certification must be received from a professional engineer or a licensed geologist certifying that the monitoring wells are located and constructed in accordance with the Well Construction Standards (15A NCAC 2C) and this permit. This certificationshould be submitted with copies of the Well Completion Form (GW-1) for each well. Mail this certification and the associated GW-1 forms to the -Permits and the Compliance Unit, Groundwater Section, 1636 Mail Service Center, Raleigh, NC 27699-1636. (17) For the initial sampling of the well as specified elsewhere in the permit, the permittee shall submit a copy of the GW-1 Form (Well Completion Form) with'the Compliance Monitoring Form (GW-59) for that well. (formerly Allen Canning Company) has been working on developing a new spray irrigation site for handling of process wastewater from their vegetable processing operations in Turkey, NC (Sampson County). Consistent with the site approval process, a soils evaluation and hydrogeologic modeling has been completed. Even after significant work on the model, the hydrogeologic model suggests an inconceivably low acceptable irrigation rate (50,000 gallons per day on 115 acres or 0.016 inches/day or 5.8 inches/year). In contrast, the soils evaluation suggested about 72 inches/year. Current irrigation fields are permitted at 43 to 62 inches/year. Mr. Pohlig has indicated that the general soil typeat the Rowan Road propertytypically would support irrigation levels in the range of 26 to 30 inches and he was also surprised at the results of the modeling More importantly, he has indicated that there is an opportunity for DENR to give consideration of this site for spray irrigation despite what the current modeling results indicate. Per his recommendation, we would like to meet with DENR to discuss the approach and options for permitting this site. There is also an issue to resolve with the current nitrate levels in groundwater at the site in that they exceed standards based on the monitoring that has been conducted thus far. Aliens understands that irrigation systems are limited based on hydraulic and nutrient applications and would like to discuss the options given the pre-existing groundwater issue. Thus, we would like to schedule a meeting to work on the approach and options for permitting this site. This permit shall be effective from the date of issuance until July 31, 2011, shall void Permit No. WQ0004268 issued November 2, 2001, and shall be subject to the following specified conditions and limitations: I. PERFORMANCE STANDARDS 1. The surface irrigation facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters, which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or . failure of the irrigation area to adequately assimilate the wastewater, the Permittee shall take immediate corrective actions including those, actions that may be required by the Division of Water Quality, such as the construction of additional or replacement wastewater treatment and disposal facilities. 2-. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 3. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and in a manner approved by the Division. 4. ` Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited. 5. The following buffers shall be maintained: a) 400 feet between wetted area and any residence or, places of public assembly under separate ownership, b) 150 feet between wetted area and property lines, c) 100 feet between wetted area and wells, d) 100 feet between wetted area and drainage ways or surface water bodies, e) 50 feet between wetted area and public right of ways, f) 100 feet between treatment/storage units and any wells, and g) 50 feet between treatment units and property lines. Some of the buffers specified above may not have been included in previous permits for this waste treatment and disposal system. These buffers are not intended to prohibit or prevent modifications, which are required by the Division, to improve performance of the existing treatment facility. These buffers do, however, apply to modifications of the treatment and disposal facilities that are for the purpose of increasing the flow that is tributary to the facility. These buffers do apply to any expansion or modification of the irrigation areas and apply in instances in which the sale of property would cause any of the buffers now complied with, for the treatment and disposal facilities, to be violated. The applicant is advised that any modifications to the existing facilities will require a permit modification. 6. The spray irrigation sites shall be identified as follows: Site Acreage A 39.3 acres Existing B+C 24.4 acres Existing D 36.6 acres Existing Total: 100.3 acres H. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities shall be properly maintained and operated at all times. 2. Upon classification of the wastewater treatment and irrigation facilities by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Permittee shall designate and employ, a certified operator to be in responsible charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the facilities in accordance with 15A NCAC 8G .0201. The ORC shall visit the facilities in accordance with 15A NCAC 8G .0204 or as specified in this permit and shall comply with all other conditions specified in these rules. 3. A suitable year round vegetative cover shall be maintained: 4. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. 5. Adequate measures shall be taken to prevent wastewater runoff from the irrigation field. 6. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 2 7. For fields identified as year round application sites, the application rate shall not exceed a cumulative loading of 62.36 inches over any twelve (12) month period at an instantaneous application rate not to exceed 0.25 inches per hour. 8. For fields identified as seasonal application sites, the application rate shall not exceed a cumulative ® loading of 42.98 inches over any twelve (12) month period at an instantaneous application rate not to exceed 0.25 inches per hour: 9. For sites A and B, the application rate shall not exceed a cumulative loading of 300 pounds of plant available nitrogen (PAN) during the active growing season of Coastal Bermuda grass and 50 pounds of PAN during the active growing season of any winter small grain overseeded crop. 10. For site C, the application rate shall not exceed a cumulative loading of 25.0 pounds of plant available nitrogen (PAN) during the active growing season of Fescue grass OR; a cumulative loading of 250 pounds of plant available nitrogen (PAN) during the active growing season of Coastal Bermuda grass and 50 pounds of PAN during the active growing season of any winter small grain overseeded crop. 11. No type of wastewater other than that from Allen Canning Company shall be irrigated onto the irrigation area. 12. No traffic or equipment shall be allowed on the disposal area except while installation occurs or while normal maintenance is being performed. 13. Public access to the land application sites shall be controlled during active site use. Such controls may include the posting of signs showing the activities being conducted at each site. 14. Freeboard in the settling lagoon and storage lagoon shall not be less than two feet at any time. 15. A protective vegetative cover shall be established and maintained on all earthen basin embankments (outside toe of embankment to maximum pumping elevation), berms, pipe runs, erosion control areas, and surface water diversions. Trees, shrubs, and other woody vegetation shall not be allowed to grow on the earthen basin dikes or embankments. Earthen basin embankment areas shall be kept mowed or otherwise controlled and accessible. III. MONITORING AND REPORTING REQUIREMENTS 1. Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 2. Influent flow shall be continuously monitored and daily flow values shall be reported on Form NDMR. The Permittee shall install an appropriate flow measurement device consistent with approved engineering and scientific practices to ensure the accuracy and reliability of influent flow measurement. Flow measurement devices selected shall be capable of measuring flows with a maximum deviation of less than 10 percent from true flow, accurately calibrated at a minimum of once per year, and maintained to ensure that the accuracy of the measurements is consistent with the accepted capability of that type of device. The Permittee shall keep records of flow measurement device calibration on file for a period of at least three years. At a minimum, data to be included in this documentation shall be: a. Date of flow measurement device calibration b. Name of person performing calibration c. Percent from true flow The'- effluent from the subject facilities shall be monitored by the Permittee at the . point prior to irrigation every March, July, and November for the following parameters: Flow MGD BOD5 Total Keldall Nitrogen (TKN) Nitrate -Nitrogen Phosphorous Arsenic Cadmium Calcium Chromium Ammonia Nitrogen PAN by Calculation Lead Magnesium Mercury Nickel Sodium Zinc % Solids pH 4. The Permittee tracking the amount of wastewater disposed shall maintain adequate records. These records shall include, but are not necessarily limited to, the following information: a. Date of irrigation, b. Volume of wastewater irrigated, c. Field irrigated, d. Length of time field is irrigated, e. Continuous weekly; monthly, and -year-to-date hydraulic (inches/acre) loadings for each field, f. Weather conditions, and g. Maintenance of cover crops. 5. Freeboard in the settling lagoon and storage lagoon shall be recorded weekly. 6. Three (3). copies of all monitoring data [as specified in Conditions III(2) and III(3)] on Form NDMR- 1 and three (3) copies of all operation and disposal records [as specified in Conditions III(4) and III(5)] on Form NDAR-1 shall be submitted on or before the last day of the following month. All information shall be submitted to the following address: Division of Water Quality Information Processing Unit 1617 Mail Service Center Raleigh, North Carolina 27699-1617 An annual representative soils analysis (Standard Soil Fertility Analysis) shall be conducted on each irrigation field and the results maintained .on file by the Permittee for a minimum of five years. The Standard Soil Fertility Analysis shall include, but is not necessarily limited to, the following parameters: Acidity Manganese Potassium Calcium Percent Humic Matter Sodium Copper pH Zinc Magnesium Base Saturation (by calculation) Phosphorus Cation Exchange Capacity Exchangeable Sodium Percentage An annual report shall be conducted by an agronomist on each spray field. The report shall address all current site management practices, recommended changes to management practices, and overall efficiency of each field to continue to accept wastewater irrigation at the rates established in this permit. 4 s, _ 9. Noncompliance Notification: IV. The Permittee shall report by telephone to the Fayetteville Regional Office, telephone number (910) 433-3300, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. . Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any time that self -monitoring information indicates that the facility has gone out of compliance with its permit limitations. Occurrences outside normal business hours may also be reported to the Division's Emergency Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. GROUNDWATER REQUIREMENTS 1. Monitor wells MW-1, MW-2, MW-3, and MW-4 shall be sampled every March, July, and November for the following parameters: Water Level Total Organic Carbon (TOC) pH Chloride Chemical Oxygen Demand (COD) Total Dissolved Solids (TDS) Nitrate Sulfate The measurement of water levels must be made prior to sampling for the remaining parameters. The depth to water in each well shall be measured from the surveyed point on the top of the casing. The measuring points (top of well casing) of all monitoring wells shall be surveyed to provide the relative elevation of the measuring point for each monitoring well. If TOC concentrations greater than 10 mg/1 are detected in any downgradient monitoring well, additional sampling and analysis must be conducted to identify the individual constituents comprising this TOC concentration. If the TOC concentration as measured in the background monitor well exceeds 10 mg/1, this concentration will be taken to represent the naturally occurring TOC concentration. Any exceedances of this naturally occurring TOC concentration in the downgradient wells shall be subject to the additional sampling and analysis as described above. The results of the sampling and analysis must be received on Form GW-59 (Groundwater Quality Monitoring: Compliance Report Form) by the Division of Water Quality Information Processing Unit 1617 Mail Service Center Raleigh, North Carolina 27699- 1617 on or before the last working day of the month following the sampling month. The data of all groundwater sampling analyses required by the permit conditions must be reported using the most recent GW-59 form along with attached copies of the laboratory analyses. Any laboratory selected to analyze parameters must certified by the Division of Water Quality for those parameters. 6. Any additional groundwater quality monitoring, as. deemed necessary by the Division, shall be provided. 7. The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in 15A NCAC 2L, Groundwater Classifications and Standards. The Compliance Boundary for the disposal system. constructed prior to December '31, 1983 is established at either (1) 250 feet from the .waste disposal area, or (2) at the property boundary, whichever is closest to the waste disposal area. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundaryis subject to immediate remediation action in. addition' to the penalty provisions applicable under General Statute 143- 215.6A(a).(1). 8. In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the disposal systems midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of standards at the Review Boundary shall require remediation action on the part of the permittee. 9. No spray application of water activities shall be undertaken on field D when the seasonal high water table is less than three (3) feet below land surface. Verification of the water table elevation must be confirmed by water level readings obtained from monitor wells near the site or by using other acceptable means, within 24 hours prior to application of wastewater. V. INSPECTIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2. The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration, operator. errors and discharges which may cause or lead to the` release of wastes to the environment, a threat to human. health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three ,years from the date of the inspection and shall be made available upon request to _the Division or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS 1. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. t_ - 3. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143- 215.6A to 143-215.6C. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCGO10000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 211 .0500. 6. The Permittee shall retain a set of approved plans and specifications for the life of the project. 7. The Permittee must pay the annual administering and compliance fee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205 (c)(4). 8. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate.
