PO Box 250, Siloam Springs, AR 72761 Dear Ms. Mushinski: After receiving your input concerning my site visit with Mr. Wells I have consulted with the Divisions permitting unit and issuing engineer. Their interpretation of permit conditions are as follows: 1. 415,000 qpd monthly average: This value does not refer to the amount of wastewater spray irrigated. It is listed in Attachment (A) under effluent characteristics as the flow in conduit, or through the treatment system. This refers to the facilities effluent discharge that reaches the (treatment process) stationary screens, screw presses, screw conveyors, etc., before it enters the 27 acre treated wastewater storage lagoon. Before the addition of the new fields (1 — 18a) the flow interpretation was. never an issue. The amount of flow the facility was allowed to produce (effluent) and then irrigate was the same numerical value. The actual amount that is now allowed to be sprayed on Allen's acreage (old fields and, new) has increased from 415,000 gpd monthly average, to 667,032 gallons per monthly average. The original 415,000 gpd monthly average was not changed with the addition of the new fields. This allows the original fields (A, B, C and D) to avoid falling under the 2T rules. If the original fields were shifted to the 2T regulations the allowable irrigation rates would shift froni theoretical yield rates to realistic yield rates. 2. Limits for Fields (A, B, C and D): I agree with your interpretation. Field A(1- 9) should have its application amounts totaled and reported as field A. This is not what is being reported. The monthly report (NDAR) makes no reference to field A, butreports it as Al — A9 and likewise for fields B, C and D. What we need is for Mr. Wells to continue to maintain his records just as he does but report the cumulative totals for fields A, B, C and D. Another option would be to submit a minor modification to change the; field names to what isbeing reported. I feel the first option is the easiest but either will work for us. The reporting method for the Rowan Road fields is fine. The last reporting issue is the new cumulative loading sheet that tracks PAN (plant available nitrogen). Each new field that falls under 2T regulation requires submission of this data. Mr. Wells has already been keeping this data and has access to therequired form. 3. Cover crop conditions on Rowan Road fields (1 -18a): The major concern here is that some of the new fields (1 -18a) being irrigated do not have a seasonal winter crop. This fact is supported by the monthly reports that indicate irrigation on fields that have been visually verified with only dormant coastal bermuda. If a seasonal winter crop was planted, the crop did not germinate. Mr. Wells has been informed of this issue and asked not to spray on fields without a seasonal winter crop to uptake the nutrients. look forward to discussing any of these items with you. It may include broadleaf herbicide applications and/or re - sprigging with coastal Bermuda grass. It will be necessary to stage the cover crop repairs/improvements so all the fields are not out of service at once. As soon as we work out a plan, we will let you know. In conclusion, we respectively disagree. on the interpretation of the -compliance point for the 415,000 gpd limit and how the loading limits on Field A, B, C, and D are applied. We appreciate you bringing these concerns to our attention and your willingness to discuss them.- It is our intention to comply with each and every requirement in the permit, but we would first like to confirm a few things on the items of concern. I would like to discuss these con cerns,with you, but thought it would be more productive to first e-mail our understanding and basis for how we had been interpreting it. 1) 415,000 gpd limit — Allens has always interpreted that the 415,000 gallons per day limitation is on a monthly average basis, based on wastewater irrigated. So, each day is not limited to 415,000 gallons per day, but the average for the month needs to be less than that. We note that this limit is listed in the table labeled "effluent characteristics", at sample point "WWTF effluent", and is listed alongside all the wastewater sample parameters that are collected of wastewater to .be irrigated (not the wastewater going to the lagoons). If the limit was based on wastewater generated at the plant, going to the wastewater system, shouldn't that be called "wastewater influent"? I've copied that table below. In contrast, Rowan Road has individual limits for each zone listed (Zone 1, 18a, etc.).
