SUBJECT: NOTICE OF VIOLATION & NOTICE OF INTENT TO ENFORCE

Dear Permittee:
A review of the January and February 2022 self -monitoring reports for the subject facility
indicated the following recurring violations that warrant your immediate attention and
actions:
A. Failure to submit Non -Discharge Monthly Report (NDMR) and Non -Discharge
Application Report (NDAR) for the months of January (NOV-2022-PC-0428) and
February (NOV-2022-PC-0429) 2022 on or before the last day of the following
month per Permit Condition IV.6.
This is a chronic repeat violation previously noted in Notices of Violations with
Intent to Enforce dated July 21, 2022, January 7, 2022, November 4, 2021, June
29, 2021 and August 30, 2021; Notices of Violation with Intent to Enforce dated
November 18, 2020 and April 2, 2018; Notices of Violation dated May 4, 2020,
August 21, 2020, September 9, 2020, and October 28, 2020; and a Notice of
Deficiency dated January 23, 2019.
Our office is considering the pursuit of punitive sanctions for these violations.
Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars
($25,000.00) may be assessed against any person who violates or fails to act in
accordance with the terms, conditions, or requirements of any permit issued pursuant to
G.S. 143-215.1. If you wish to provide additional information regarding the noted violation,
request technical assistance, or discuss overall compliance please respond in writing
within ten (10) days after receipt of this Notice. A review of this information will be
conducted, and you will then be notified of any civil penalties that may be assessed

regarding the violations. If no response is received in this Office within the 10-day period,
a civil penalty assessment may be prepared.
Your written response should be sent to my attention at the address shown on the
letterhead. Be advised that should these violations continue, further enforcement actions
including civil penalty may result.
