The changes include modification of the sampling frequency to require annual monitoring. As discussed at the meeting samples may be obtained anytime during the calendar year, with the Discharge Monitoring Report (DMR) due every year on January 30th for the previous years monitoring. Attached is the NPDES permit No NC0081957 issued June 19, 2000, based on your March 1, 1999 application and addendums. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated December 6, 1983. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS - Final During the period beginning on the effective date of the permit and lasting until expiration, the Permittee is authorized to discharge once -through cooling water from outfall(s) serial number 001, 002, 005, 006 and 007. In no case should the receiving stream temperature exceed 32 °C due to the facility's operation. Temperature of the effluent may be obtained anywhere downstream of the heat exchanger effluent that is representative of the discharge. 2 The pH of the effluent shall not be less than 6.0 standard units nor greater than 9.0 standard units, unless ambient river conditions prevent compliance with this range. The Permittee shall obtain authorization from the Division prior to the use of any chemical additive in the discharge. The permittee shall notify the Director in writing at least ninety (90) days prior to instituting the use of any additional additive in the discharge, which may be toxic to aquatic life (other than additives previously approved by the division). Such notification shall include the completion of a Biocide Worksheet Form 101 (if applicable), a copy of the MSDS for the additive, and a map indicating the discharge point and receiving stream. Monitoring results obtained during the calendar year shall be recorded and reported on a Discharge Monitoring Report (DMR) form and postmarked no later than January 30th following the completed reporting period. The first DMR is due January 30' 2001. Samples obtained for monitoring purposes may be collected anytime during the calendar year. There shall be no discharge of floating solids or visible foam (other than trace amounts) in the effluent, unless ambient river conditions prevent compliance. A (2). Confirmation that a visual inspection was conducted shall be recorded in the operating log for the facility and provided to the Division upon request. 2. The pH of the effluent shall not be less than 6.0 standard units or greater than 9.0 standard units, unless ambient river conditions prevent compliance with this range. 3. If the parameter has not be detected above the quantitation level for the respective parameter then the permittee may request that this parameter be removed from the permit. 4. Applies to total PCBs present and includes PCB 1242, 1254, 1221, 1232, 1248, 1260, and 1016. Best Management Practices (BMPs) must be employed to ensure that excessive pollutants are not discharged to the surface water of the state. These practices should include as a minimum, routine maintenance of the rope skimmer type oiUwater separator and cleaning accumulated sediment in the bottom of the sump annually. Chemical wheel pit cleaning is permitted on a monthly basis. When wheel pit cleaning occurs, the tailrace shall be inspected visually for foam and oil. Cleaning shall be conducted only with pre -approved solvents. Should the Permittee wish to change solvents, a written request should be made to the Division including the MSDS for the proposed solvent. Mechanical cleaning operations, which do not contribute any wastewater to the discharge are not limited by this permit. Non -discharging cleaning operations may be conducted as often as necessary to ensure safety and proper facility operation. The Permittee shall obtain authorization from the Division prior to the use of any chemical additive (i.e. biocides) in the discharge. The permittee shall notify the Director in writing at least ninety (90) days prior to instituting the use of any additional additive in the discharge, which may be toxic to aquatic life (other than additives previously approved by the division). Permit No. NC0081957 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A(3) Penstock Sump Drains — CORRECTIVE ACTION CONDITION Issuance of this permit is conditional upon the permitees adherence to the provisions contained in the corrective action letter concerning the clean out of the penstock sump drains. The permittee shall notify the Division no later than 90 days after completion of the provisions of this letter. Box 576 Badin, North Carolina 28009 NCDENR Subject: Permit No. NC0081957 Narrows Powerhouse Stanly County Dear Mr. McCaskill: The Division has reviewed the Yadkin Inc. comments received February 1, 2000 in response to the draft NPDES permit. The Division has considered the concerns raised and has modified the permit in accordance with current Division policy, all responses to concerns and revisions made to draft permit, NC0081957, are explained below: Comment #1: Yadkin Inc. request clarification regarding the Corrective Action Letter related to the discharge of sump water. Comment #2: Yadkin Inc. request clarification on the basis for discharge limits during both active and passive discharge of the sump water. Response to Comments 1 and 2: To clarify, the Corrective Action Letter addresses the situation where active pumping is used to remove sump water prior to discharging to a surface water body. Under normal operating conditions were sump water is passively discharging to the Yadkin River, the limitations and monitoring requirements stipulated on page A(2) for outfall 003 shall be followed. The basis for the limitations stipulated in the Corrective Action Letter are as follows: The limitations stipulated for lead, Cadmium, Chromium, Zinc, and Copper represent the r the Final Acute Values. These limitations were derived from the criteria developed by the EPA for protection of aquatic organisms to acute toxicity resulting from exposure to these toxicants. The PCB limitation was derived from the chronic standard established by the North Carolina Environmental commission. The Division has taken an environmentally conservative position by applying this chronic standard as an acute standard, not taking dilution into consideration. The reason for implementing the standard in this manner is the fate of PCBs in the environment. PCBs in soil and water are extremely slow to degradeYith no known processes other than slow degradation by microbial breakdown. Any PCBs discharged to the river are likely to be transported downriver or deposited onto the sediment at the bottom of the river where they are likely to remain and accumulate. The Yadkin River at the Falls Powerhouse has a classification of WS-IV and B CA. Permit No. NC0081957 Narrows Powerhouse Page 2 Because there is a high risk of human exposure, the Division has used an environmentally conservative approach to establishing the conditions under which the discharge may occur. Comment #3: The Effluent Limitations and Monitoring Page A(1) only references outfalls 001, 002 and 005, but does not include cooling water outfalls 006 and 007. Response: The outfalls referenced on the Effluent Limitations and Monitoring Page A(1) in the draft permit, represent the actual physical outfalls present at the facility. The final permit has been modified to include outfalls 006 and 007 this will to allow Yadkin Inc. to obtain samples at a location other than at the actual outfall, since sample retrieval at the outfall is not practical. Comment #4: Clarification of the pH monitoring requirement, since Yadkin Inc. does not add any chemical additives to the source water. Response: The hydrogen ion content of water is considered a generic measurement of water quality and as such is included as a condition of the general permit for hydroelectric facilities. Since the conditions of the general permit are considered minimum requirements, the semi-annual monitoring of pH, for outfalls 001, 002, 005, 006 and 007, and the quarterly monitoring of outfall 003, will remain as a condition for this permit. Comment #5: No monitoring frequencies for pH on the page A(2). Response: This was an oversight and the final permit has been corrected to include quarterly pH monitoring of water discharged through outfall 003. Comment #6: Clarification of the temperature monitoring requirement. The maximum temperature change across the generator is 25 °C with a ratio of cooling water discharge to generator discharge of 1:30,000. Therefore, the worst case temperature rise of the Yadkin River due to cooling water discharge would be 0.0083 °C, assuming an ambient water temperature of 20 °C. Response: As with pH, temperature is considered a generic measurement of water quality and as such is included as a condition of the general permit for hydroelectric facilities. Since the conditions of the general permit are considered minimum requirements, the semi-annual monitoring of temperature will remain as a condition for this permit. Comment #7: Yadkin Inc. request clarification as to the basis for establishing discharge limits for oil and grease at outfall 003. Response: The Narrows Powerhouse, like most hydroelectric facilities, incorporates lubrication into the routine maintenance for the facility. Because lubrication is common to hydroelectric facilities an oil and grease limit has been included as a condition of the general permit for hydroelectric facilities. Since the conditions of the general permit are considered minimum requirements, the oil and grease limit for outfall 003 will remain in the permit. Comment #8: The boiler plate language relating to increases in stream temperature on the Effluent Limitations and Monitoring Requirements Page A(1) needs to be prefaced with a footnote that instream monitoring is not required. Response: The intent of this limitation is not to require instream monitoring of temperature for reporting purposes. As with all limited and monitored parameters the required sampling location is specified in the Yadkin, Inc. Permit No. NC0081957 Narrows Powerhouse Page 3 permit. Please note that the Effluent Limitations and Monitoring Requirements Page specifies that temperature monitoring be conducted on the effluent and does not indicate that upstream or downstream sampling is required. Therefore, the facility is only required to monitor the temperature of the effluent for the outfalls referenced on the page A(1). Comment #9: Yadkin Inc. request that Discharge Monitoring Reports (DMR) submittal be waived. Response: Since Yadkin, Inc. request coverage under an individual NPDES permit, DMR reporting is required. Comment #10: Since it is impractical to obtain samples at the point of discharge, Yadkin Inc. request approval for sampling at the closest point to discharge where a representative sample can practically be obtained. Response: The Division agrees that this is a reasonable request and included the phrase, "E — Effluent or the point closest to discharge where a representative sample of the discharge can feasibly be obtained." to allow for sampling at the sump upstream of the discharge. Comment #11 and #12: On the Effluent Limitations and Monitoring Page A(1) there is no sample type listed for flow monitoring and Effluent Limitations and Monitoring Page A(2) has no monitoring frequency or sample type listed for flow monitoring. Response: These errors have been corrected in the final permit. Comments received other than those from the Permittee: Comment #13: The question was raised to the absence of individual toxicant monitoring during passive discharge from the sump. Response: The Division has found that there is no reasonable potential for the Narrows Powerhouse to exceed the chronic standard for lead, chromium, chromium, and PCBs or the action level for copper and Zinc. A limit for these parameters will not be included as a condition for the permit. However, it is Division policy to include monitoring as a condition for the permit. Therefore, monitoring of the toxicants listed above will be required as a condition for the permit. If after one year the listed parameters have not been detected then Yadkin Inc. may request that these parameters be removed from the permit. Box 576 Badin, North Carolina 28009 AlirA NCDENR Subject: Corrective Action Letter Permit No. NC0081957 Narrows Powerhouse Stanly County Dear Mr. McCaskill: The purpose of this letter is to clarify the Division's position regarding the discharge of the sump water at the Narrows Powerhouse. The Narrows Powerhouse is a hydroelectric facility located in Stanly County North Carolina. Stormwater, which is deposited on the penstocks, collects in sumps located along the east foundation of the hydroelectric facility. Water samples collected February 26, 1999 and March 15, 1999 revealed that the sediment deposited in the sumps contain levels of PCBs and heavy metals. Samples were also collected on the water above the sediment and revealed the presence of heavy metals (i.e. Pb). A subsequent analysis of the water above the sediment, collected on September 21,1999, detected lead and PCB at 0.045 mg/I and 0.357 ug/l, respectively. Based on the latest findings, the Division suggests that Yadkin Inc. evaluate disposal methods other than discharge. The Division recognizes that the cost associated with alternative disposal methods make discharging an attractive alternative and the Division may permit the discharge provided that either of the following two options are followed. Option One: Prior to discharge Yadkin Inc. must obtain two samples from the sump. One sample shall represent the upper third of the water column and one sample shall represent the bottom third of the water column. The concentration of PCB in the sump water shall be determined using either EPA Method 8082 or EPA Method 608. Upon determination that the contaminant levels are below those listed above, the sump water may be discharged until the water level in the lower sump is'h the full water level. Option Two: Prior to discharge the sump water shall receive appropriate treatment to remove the contaminants previously mentioned. The treatment technology employed shall be a proven technology for removal of the listed contaminants and approved by the Division prior to implementation. After receiving the appropriate treatment, discharge of the sump water is permitted until the water level in the lower sump is depressed to'h the full water level. Box 576 Badin, North Carolina 28009 USA NPDES Draft Permit Comments Yadkin, Inc Yadkin, Inc has applied for coverage under an individual NPDES permit for this facility rather than a general permit because of conditions in the general permit which they feel are unwarranted for this operation. The following summarizes the comments, as well as, our understanding of the agencies position based on our discussions during our 10/19/99 meeting, as well as, subsequent phone conversations. Ji. Yadkin requests clarification regarding the corrective action letter dated 12/23/99 related to the discharge of sump water. There are two potential scenarios for discharging the sump water: A) Actively pumping the water with a sump pump directly to the river B) Passively discharging the water via gravity flow through the draft tube inlet into the Unit #4 penstock. (i.e. — stormwater causing intermittent discharges of sump water.) As per my 1/4/99 phone conversation with Mr. Mike Myers, it is our understanding that the letter is addressing scenario A) whereby we would be actively pumping the water and have to meet the conditions stated in the letter, and not scenario B) which is occurring on an ongoing basis, for which the stated conditions in the letter do not apply. 12. Yadkin requests clarification as to the basis for established discharge limits during circumstances in which active pumping of sump water directly to the river occurs. Similarly, Yadkin requests clarification as to the requirements which have to be met .�� under circmstances in which sump water is passively discharged via gravity flow through the draft tube inlet into the Unit #4 penstock. The stated limits or requirements to treat the water are overly restrictive and apparently do not take into consideration reasonable expectations of instream concentrations. The effluent limitations and monitoring requirements page A(1) only reference cooling water outfalls 001, 002, & 005, but do not include cooling water outfalls 006 & 007. You will recall that cooling water from from Unit 1(Outfall 001) & Unit 2 (Outfall 006) discharge at a common point, however, since they flow from different sources until they discharge outside the powerhouse, we listed them as different outfalls for purposes of clarity. The same situation exists with Unit 3 (Outfall 005) & Unit 4 (Outfall 007). They are generated from different sources, but exit the powerhouse at a common point. The reason for listing them as different outfalls is because the combined discharge cannot be accessed for monitoring purposes if monitoring is required. Can these outfalls be granted representative outfall status such that we only have to permit and/or monitor 1 or 2 of the discharges? If not, then they also need to be reflected on this page as permitted discharges. 2 cp)1/ NPDES Draft Permit Comments Yadkin, Inc N4. Yadkin requests clarification egarding the requirements to monitor the pH of cooling water and sump water. The Narrows Powerhouse is a hydroelectric facility located in Stanly County North Carolina. Stormwater, which is deposited on the penstocks, collects in sumps located along the east foundation of the hydroelectric facility. Water samples collected February 26, 1999 and March 15, 1999 revealed that the sediment deposited in the sumps contain levels of PCBs and heavy metals. Samples were also collected on the water above the sediment and revealed the presence of heavy metals (i.e. Pb). A subsequent analysis of the water above the sediment, collected on September 21,1999, detected lead and PCB at 0.045 mg/1 and 0.357 ug/1, respectively. Based on the latest findings, the Division suggests that Yadkin Inc. evaluate disposal methods other than discharge. The Division recognizes that the cost associated with alternative disposal methods make discharging an attractive alternative and the Division may permit the discharge provided that either of the following two options are followed. Option One: Prior to discharge Yadkin Inc. must obtain two samples from the sump. One sample shall represent the upper third of the water column and one sample shall represent the bottom third of the water column. The source of wastewater for outfalls 001,002, and 005 is once through cooling water, outfall 004 is a sump drain collecting runoff. The old permit stipulates that outfalls 001 through 003 be monitored (with no limits) for flow, temperature and total residual chlorine. No discharge monitoring reports have been required because of the use of BMPs. Outfall, 004, which collects runoff from the site has recently been found to contain elevated levels of heavy metals. The sediment that has accumulated in the sump has been analyzed and found to contain PCBs in addition to heavy metals. Because the discharge from this outfall is low and the receiving stream flow is large use of the mass balance equation allows large concentrations of the toxicants of concern. The '/z FAV values therefore govern the concentration of the pollutants in the discharge. The discharge of the contaminated sump water will be cover under a corrective action letter to Yadkin, Inc. The latest analytical data provided by Yadkin Inc. indicates that PCBs are also contained in the water. The latest analysis indicates that the concentration of PCBs in the sump water is 0.357 ug/1 with an freshwater human health standard of 0.000079 ug/1. Because of this most recent data, it is recommended that Yadkin Inc evaluate methods of disposal other than discharging. No AQ or GW concerns nor are hazardous materials utilized at this facility. PART IV - EVALUATION AND RECOMMENDATIONS The applicant, Yadkin, Inc. (a subsidiary of ALCOA), operates a powerhouse (dam) on the Yadkin River known as Narrows Powerhouse, which generates hydroelectric power used in ALCOA's aluminum manufacturing process. The dam was constructed in the early 1900s. Complex electrical generation machinery exist at this facility that requires cooling water during operation. There have been no changes to this facility with regards to the permitted outfalls since the Permit was last issued. One important change that should be included in the subject permit is the existence of an additional discharge from the sumps located along the east foundation of the hydroelectric generation building. These sumps receive stormwater that collects along the building's foundation and pumps the water into the process water stream that feeds Narrows Generator Unit No. 4. The stormwater comes into contact with the penstocks that serve the dam with water for electrical generation. Through the years, routine maintenance of the penstocks has included painting, which up until the past 2-3 decades involved the use of lead -based paint. Over time, this paint has continually flaked off, and was carried to the sumps during storm events. In a recent analysis, elevated levels of lead were found in analysis of the sump water and sludges that had settled into the bottom of the sumps. In addition to the existence of lead, PCBs and other constituents were found in the sludges as well. Yadkin proposes to remove the sludges for disposal in a hazardous waste landfill, however, the water located in the sumps must be removed before the sumps can be cleaned of the sludges. Therefore, prior to renewal of this permit, it will be necessary to determine whether or not this outfall can be effectively permitted considering the current layout of the site, the lack of available treatment, and the potential for elevated levels of pollutants to enter surface waters. The data indicate that there are PCB's present at a concentration of 0.357 ug/1 and total lead at a concentration of 0.045 mg/l. A copy of this information was provided to Mr. Mike Myers of the Division during his 10/19/99 visit to Badin to discuss the draft NPDES permit for the Narrows Powerhouse. The discharge consists primarily of stormwater that collects in sumps along the outside of the east foundation of the hydroelectric generation building. In order to prevent structural problems with the building and penstock foundations, the water has historically been removed by aspirating it into the process water stream which feeds the Narrows Unit #4 generator. The data consists of two separate water samples which were collected from the sumps beneath the Narrows penstocks, as well as, a sludge sample which was collected from sludge which was removed from the sumps beneath the penstocks. The first water sample collected on 2/26/99 was collected st bsequent to the sludge having been removed from the sumps. The water level in the sumps at that time was — 12". It is important to note that because of the low water level at the time of sampling, there was no discharge occurring, so the 2/26/99 sample was taken from standing water in the sump beneath the Unit #4 penstock, and not from the pump discharge. The second water sample collected on 3/15/99 was collected subsequent to a storm when the sumps were full with — 3 - 5 feet of standing water. Again, it is important to note that the sample was collected from standing water beneath the Unit #4 penstock, and not from the pump discharge since active pumping of the water has not occurred since the original discovery of contaminants in the water. You will note that the 3/15/99 water sample was also analyzed for Polychlorinated Biphenyls (PCB's) with concentrations detemined to be below the reported PQL's of 1.0 and 2.0 ug/1 for respective arochlors. The decision to analyze the water for PCB's was made after receiving the analytical results for the sludge which had been removed from the sumps and determined to have a PCB concentration of 22.4 mg/kg. You will also note that both of the P.O. Box 576 Badin, North Carolina 28009 USA water samples contained lead, as well as, other trace metals which has resulted from historical painting activities associated with the penstocks which have been maintained since the facility installation in the early 1900's. The water which is currently standing in the sumps gravity flows to the river through the aspiration inlet into the Unit #4 generator every time there is additional water deposited in the sumps from stormwater infiltration. In order to facilitate further cleaning of the sumps, Yadkin is requesting permission to pump the remaining water in the sumps to the river which is estimated to be — 30,000 - 50,000 gallons. Once this accomplished, an attempt will be made to further clean sediment from the sumps in an effort to reduce or eliminate any further contamination in this discharge. Additionally, Yadkin is requesting permission to continue to routinely pump accumulated stormwater from the sumps to the river to prevent any future structural problems with the foundations of the building and penstocks. We request you consider this matter on an expedited basis as 1) we have a Federal Energy Regulatory Commission (FERC) requirement that this water not be allowed to cover the penstock foundations as is the present condition and 2) we want to expedite removal of the remaining sediment to ensure the cleanest water possible be discharged to the stream. Since our discharges consist primarily of non -contact cooling water and the volume of water used to cool the turbines relative to the total discharge volume is so small, we question the necessity of boiler plate language in the current permits related to instream temperature rise. Also, since we are not adding anything to the cooling water which would alter the pH, we question the necessity of boiler plate language in the current permits related to pH. You will note that we have added an additional outfall at the Narrows Powerhouse (004). We are currently in the process of sampling the discharge and will be forwarding the data to you as an amendment to this application. Also, .please note that High Rock Powerhouse is actually located in Davidson County; however, during previous permit renewals, for consistency sake, permitting oversight has been provided from one regional office. Yadkin requests that this approach to permitting oversight be continued from one regional office. We do not produce sludge in our process; therefore, a sludge management plan is not included in the submittal.
