This letter is in response to your request for speculative effluent limits for the Oxford wastewater
treatment plant. Specifically, you requested an update of the speculative limits presented to the City
in a letter dated October 5, 1994. The plant currently has a permit to discharge 2.17 MGD of treated
domestic and industrial wastewater to Fishing Creek in the Tar Pamlico River Basin in Granville
County. Your former consultant requested speculative limits at 4 MGD at the current location
(through conversation with NPDES Unit staff).
We have reviewed the request and provide the following response. The speculative limits presented
here are based on our understanding of the proposal and of present environmental conditions. The
Division of Water Quality (DWQ) cannot guarantee that it will issue the City an NPDES permit to
expand its discharge of treated wastewater into waters of the State. Nor can we guarantee that the
effluent limitations and other requirements included in any permit will be exactly as presented here.
Final decisions on these matters will be made only after the Division evaluates a formal permit
application for the City's discharge and notices the proposal for public comment.
Environmental Assessments of New Projects and Expansions
Please be aware that the City will have to evaluate this project for environmental impacts before
applying for a permit modification. Anyone proposing to construct new or expanded waste treatment
facilities using public funds or public (state) lands must first prepare an environmental assessment
(EA) when wastewater flows (1) equal or exceed 0.5 MGD or (2) exceed one-third of the 7Q10 flow of the
receiving stream. DWQ will not accept a permit application for a project requiring an environmental
assessment until the Division has approved the EA and sent a Finding of No Significant Impact
(FONSI) to the state Clearinghouse for review and comment. As part of the EA, alternatives to
discharge, including a potential regional system, must be evaluated.

Speculative Effluent Limits
Based on the available information. tentative conventional limits for the proposed discharge of 4.0
MGD flow to Fishing Creek are listed in the attached table. The speculative limits are explained below.
Flow Limits. The flow will be limited to 4.0 MGD as requested by the City. This limit will be applied as
a monthly average.
BOD5 and NH3-N. The summer limits of 5 mg/1 (BOD5) and 1 mg/1 (NH3-N) for these parameters were
based on the potential impacts to the receiving stream for this size facility. This is a reduction from
the previous summer limits of 15 & 4 at the 2.17 MGD permitted flow. Fishing Creek is listed on
North Carolina's 303 (d) list of impaired water bodies and is deemed biologically impaired.
Additionally, incidences of dissolved oxygen levels below the water quality standard of 5 mg/1 have
been recorded below Oxford's discharge. The winter limits of 10 mg/1 (BOD5) and 2 mg/I (NH3-N) at
4.0 MGD are reduced from the previous winter limits of 30 & 8 at the 2.17 MGD permitted flow.
TSS. The limits for total suspended solids are standard for secondary treatment of municipal
wastewater.
Fecal Coliform, pH. The limits for fecal coliform bacteria and pH are derived to protect water quality in
the receiving stream and remain the same as in the previous permit.
Chlorine. The Division requires chlorine limits and dechlorination for all new or expanding
dischargers proposing the use of chlorine for disinfection. The process of chlorination/ dechlorination,
or an alternate form of disinfection such as ultraviolet radiation, should allow the facility to comply
with the total residual chlorine limit.
Chronic Toxicity Testing: The City's chronic toxicity limit for the 4.0 MGD flow will be Pass/Fail at
90%. This is the same percentage that is given in the current permit.
Nutrient parameters: Because the City of Oxford is a member of the Tar Pamlico Nutrient Trading
Association, limits for nutrients will not be required with the expansion. However, the City should be
aware that the Association is required to meet target levels for total nutrient reduction loads. Proper
planning for biological nutrient removal may be necessary.
Toxicant Parameters: Estimation of toxicant parameters will not be given with this speculative letter,
but will be submitted as appropriate with the draft NPDES permit.
This response to your inquiry should offer sufficient guidance for the City's treatment plant expansion.

Speculative limits were requested 7/29/99. Consultant confirmed via Mike M.
that Oxford wanted spec limits for 4 MGD. Speculative limits were previously
given 10/5/94.
Streamflows used for the 1994 speculative were reconfirmed and verified.
Fishing Creek is listed on Part 5 of the draft 303(d) list [biologically impaired].
Recent benthic assessment 5/99 rates the site as "poor" downstream (like
1990). Ambient stations downstream had some instances (esp. 1995) of DOs
below 5 mg/1. Oxford's self monitoring data also indicated both up and
downstream values less than 5 mg/l.
Although we would likely recommend no increase in loading with an expansion
to a 303d listed water body, with instances of DOs less than 5 mg/land
continued biological impairment we're recommended tertiary limits. No
modeling was performed (previous model was reviewed).

We only update the web page list on an annual basis, so it wasn't on
there yet. In May 1999 we sampled two sites below the WWTP at 1 and 6
miles below. No flow upstream. Got Poor 1 mile below and Fair at
second site. The Poor was same as we had gotten at that site in 1990,
and the Fair was down from Good -Fair found at the second site in 1997
and 1992, though it was Fair in 1990. So, in essence, not much has
changed in 10 years.
