Background On April 6, 2022, the United States Supreme Court issued an order staying a lower court's vacatur of the Trump Administration's 2020 "Clean Water Act Section 401 Certification Rule" ("Federal Rule"). As a result of the United States Supreme Court order, the Trump Administration's Federal Rule has sprung back into effect. The proposed crossing is a 66-inch pipe, buried 1.0 foot. To minimize impacts to the stream, the driveway crosses the stream at a 90-degree skew and a headwall is being utilized on the upstream end. The topography from Heritage Drive is very steep. A 15% driveway slope and a vertical curve K value of 4 were utilized to determine the driveway profile across the creek. Additionally, 2:1 side slopes were used to minimize the pipe length and stream impacts. To prevent erosion downstream of the pipe, a Class I rip -rap outlet pad will be utilized downstream of the pipe. The US Fish and Wildlife Service (USFWS) Information, Planning, and Consultation (IPaC) system lists one aquatic species, the Cape Fear Shiner as a species that could potentially be affected by activities in this location, as accessed July 11, 2022 (USFWS 2022). The Cape Fear Shiner is not known from the project area; the closest known element occurrence is in the Haw River approximately 20 river miles (RM) downstream of the proposed development (EO 23811) first observed May 1993 and most recently in September 2007 (NCNHP 2022). Completed Survey Efforts The Aquatic Surveys targeting the Cape Fear Shiner surveys were conducted by Tim Savidge (Permit 22-ES0034), and Lizzy Stokes -Cawley on July 13, 2022. UT to Cane Creek Conditions The UT to Cane Creek at this location is approximately four to eight feet wide, with banks between one and two feet high that were primarily stable with little sign of erosion. At the time of the survey the entire width of the channel was completely dry, limited to small trickles. Scattered pools with water depths between 6 and 10 inches were the only portions of the channel that contained enough water to support fish species. The substrates within the pools were dominated by cobble, gravel and coarse sand. A thin layer of silt was present on top of substrate. The riparian buffer was significant, the left descending bank had an approximately 200-400 ft wooded buffer between the UT and the gravel drive of Heritage Drive, on the left descending bank the riparian buffer was wooded greater than 500 ft (Figure 1). Three Oaks Engineering threeoaksengineering.corn Cape Fear Shiner Survey Results The Cape Fear Shiner was not observed during survey efforts. A total of 458 seconds of electrofishing with two dip nets were used during the survey efforts. Efforts were concentrated in the pools. Two fish species, the Green Sunfish (Lepomis cyanellus) and Creek Chub (Semotilus atromaculatus) were observed, both species were abundant in the reach. Discussion The Cape Fear Shiner was not observed during the survey effort. The small size of the UT to Cane Creek and the lack of continuous flowing water indicates that it's likelihood in supporting the Cape Fear Shiner is very low. The fish observed in the UT indicates that the stream does support a fish population, however the suite of species that typically accompany the Cape Fear Shiner was not present.
