We find the plan to be acceptable with modifications and hereby issue this letter of Approval with Modifications. The Modifications Required for Approval are listed on the attached page. This plan approval shall expire three (3) years following the date of approval, if no land -disturbing activity has been undertaken, as is required by Title 15A NCAC 4B .0129. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (eNOI) form requesting a Certificate of Coverage (COC) under the NCGO10000 Construction General Permit. After the form is reviewed and found to be complete, you will receive a link with payment instructions for the $100 annual permit fee. After the fee is processed, you will receive the COC via email. As the Financially Responsible Party shown on the FRO form submitted for this project, you MUST obtain the COC prior to commencement of any land disturbing activity. The eNO1 form may be accessed at deq.nc.gov/NCGO1. Please direct questions about the eNOI form to the Storinwater Program staff in the Raleigh central office. If the owner/operator of this project changes in the future, the new responsible party must obtain a new COC. North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring protection of existing natural resources and adjoining properties. If, following the commencement of this project, it is determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this office may require revisions to the plan and implementation of the revisions to ensure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to this land - disturbing activity. This approval does not supersede any other permit or approval. In Phase 1 (Sheet C-2.02), a rock dam shall be installed in the existing channel located Southeast of Basin #1 and South of Diversion SB-1C. The rock dam shall be installed at the downstream edge of the disturbed limits. The rock dam shall have a minimum 3' height and a minimum 3' top crest width. The rock dam shall remain intact and functional into Phase 3 and/or until all upstream permanent fill slopes have been permanently stabilized. See attached construction detail. 2. Baffles in all basins shall be adequately spaced and installed in such a manner to obtain diffuse flow across the bottom of the basins. Some basins may require more than 3 baffles to achieve proper diffuse flow. Baffles should be installed perpendicular to the flow from the diversion berm outlets. 3. All low-water weir openings in the riser structure of Basin #1 shall be temporarily plugged until final BMP conversion. Basin #1 shall not be converted to the permanent BMP pond until all upstream areas have been adequately and permanently stabilized. Approval shall be obtained from DEMLR prior to converting basin. 4. Basin #2 shall have a minimum l' of elevation between the top of the riser and emergency spillway (EMS) and a minimum l' of elevation between EMS and top of dam. The top of the riser shall be at Elev. 653.0', as shown on the plans. Sufficient stabilization shall be provided below the EMS outlet at all times. An EMS shall be provided during the Phase 2 transition. 5. Basin #6 shall have a minimum 1' of elevation between the top of the riser and emergency spillway (EMS) and a minimum F of elevation between EMS and top of dam. The top of the riser shall be at Elev. 673.0', as shown on the plans. The embankment for this basin shall have a minimum 8' top crest width. 6. On Sheet C-2.03, the existing channel .shall not be disturbed until crews are ready to install the proposed 18" RCP under Jean Place Court. The culvert installation shall be conducted during periods of "no flow" in the channel and when no rain is forecast during the workdays necessary to complete the pipe installation. Upon pipe installation, rock pipe inlet protection and adequately sized outlet protection shall be provided. 7. If grass fails to stabilize grass -lined ditches/swales, the ditches/swales shall be stabilized with an adequately sized rip -rap liner. 8. The rock check dam basin excavation (Detail 7 on Sheet C-2.13) shall be installed prior to the removal of Basin #2. The remaining inlets shall be installed upon removal of Basin 42. The minimum required surface area shall be provided at each inlet per Detail 7 on Sheet C-2.13. The widths and lengths shall be adjusted accordingly. This excavation shall remain intact and functional until all upstream areas have been stabilized. Approval shall be obtained from DEMLR prior to removal of these excavated areas. Maintenance Inspect check dams and channels at least weekly and after each significant (1l2 inch or greater) rainfall event and repair immediately. Clean out sediment, straw, limbs, or other debris that could clog the channel when needed. Anticipate submergence and deposition above the check dam and erosion from high flows around the edges of the dam. Correct all damage immediately. If significant erosion occurs between dams, additional measures can be taken such as, installing a protective riprap liner in that portion of the channel (Practice 6.31, Riprap-line and Paved Channels). Remove sediment accumulated behind the dams as needed to prevent damage to channel vegetation, allow the channel to drain through the stone check dam, and prevent large flows from carrying sediment over the dam. Add stones to dams as needed to maintain design height and cross section.
