Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued. pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as
subsequently amended).
On December 2, 2006, Primary Energy's Mr. James Moore sent an e-mail requesting changes to the
terms included in the draft permit sent to you on November 22, 2006. The Division has reviewed the
requests, along with pertinent data from the Southport Plant, and has made the following changes to the
final permit:
Outfall 002
• The monitoring frequencies for Total Chromium and Total Zinc have been reduced to monthly.
• The sample types for Total Chromium and Total Zinc have been changed from composite to grab.
Outfall 004
• Monitoring for Salinity, Total Aluminum, Total Arsenic, Total Chloride, Total Copper, Total Iron,
Total Fluoride, and Total Zinc has been removed from the permit.
Monitoring frequencies for Temperature, Dissolved Oxygen, Total Dissolved Solids, Conductivity,
pH, and NH3-N have been reduced from monthly to quarterly.
The final permit also includes the following change from the existing permit, which was included on the
draft:
• The footnote for outfall 003 has been modified to require the facility to either report the results of a
126 Priority Pollutants analysis on an annual basis or submit a statement certifying that none of those
compounds were used in plant processes during the preceding year. N Carolina

The Division is unable to grant your requests for elimination of monitoring for Free Available Chlorine
and modification of the Biocide Use Approval Condition.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or
Local governmental permit that may be required.

In compliance with the provisions of North Carolina General Statute 143-215.1, other lawful
standards and regulations promulgated and adopted by the North Carolina Environmental
Management Commission, and the Federal Water Pollution Control Act, as amended,
Primary Energy of North Carolina LLC - Southport
is hereby authorized to discharge wastewater from a facility located at
Primary Energy of North Carolina LLC — Southport
1281 Powerhouse Drive S.E., Southport
Brunswick County
to receiving waters designated as the Atlantic Ocean below the Cape Fear River Basin via
Progress Energy's Brunswick Steam Electric Plant's (BSEP) discharge canal, in accordance with
effluent limitations, monitoring requirements, and other conditions set forth in Parts I, If, III, and
IV hereof.
This permit shall become effective April 1, 2007.
This permit and authorization to discharge shall expire at midnight on November 30, 2011.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are
hereby revoked, and as of this issuance, any previously issued permit bearing this number is no
longer effective. Therefore, the exclusive authority to operate and discharge from this facility
arises under the permit conditions, requirements, terms, and provisions described herein.
Primary Energy of North Carolina LLC - Southport
is hereby authorized to:.
1. Continue to operate a wastewater treatment system for coal -pile runoff, sump -water
discharge, and low -volume wastewater (internal Outfall 001); cooling tower blowdown
(internal Outfall 002); and reverse -osmosis wastewater discharge (internal Outfall 004)
located at Primary Energy of North Carolina, LLC, Southport Plant, 1281 Powerhouse Drive,
S.E., Southport, Brunswick County; and
2. Discharge from said treatment works through Outfall 003, via the Brunswick Steam Electric
Plant's discharge canal (at a location specified on the attached map) into the Atlantic Ocean,
a Class SB waterbody below the mouth of the Cape Fear River Basin.

1. Neither free available chlorine (FAC) nor total residual chlorine (TRC) may be discharged
from any single generating unit for more than two hours in any single day: Not more than one
unit may discharge FAC or TRC at any one time unless the permittee can demonstrate to the
Division of Water Quality that units cannot operate at or below this level of chlorination.
Limitations for chlorine are instantaneous average and instantaneous maximum. Monitoring
will be required only during those weeks when chlorination occurs.

1. The Permittee must monitor these parameters only if the permittee adds these materials for
cooling tower maintenance [40CFR 423.13 (d)(1)]. There shall be no detectable amounts of
the 126 priority pollutants (40CrR 423, Appendix A) contained in chemicals added to the
cooling towers except for Total Chromium and Total Zinc (covered under biocide approvals).
If no annual analysis is performed for the 126 Priority Pollutants, the facility must, at a
minimum, submit a statement on an annual basis certifying that none of the 126 Priority
Pollutants are added during manufacture, maintenance or treatment processes.
Final discharge shall contain no floating solids or foam visible in other than trace amounts.

A. (5). USE OF BIOCIDES — SPECIAL CONDITION
The Pennittee shall obtain authorization from the Division prior to using any biocide in the
cooling water that may be toxic to aquatic life. The Permittee shall notify the Director in writing
no later than 90 days prior to using any biocide not already approved for this facility. The
Permittee shall provide such notification by completing a Biocide Worksheet, Form 101 to
include a map indicating the receiving stream and the effluent discharge point. Concentrations of
additives to biocides such as chromium, copper, or zinc shall not exceed applicable water quality
standards or action levels in the receiving stream, as determined by calculations using the Biocide
Work Sheet, Form 101 and the Supplemental Analysis Worksheet.

If the facility is using a chlorine derivative as their biocide, then this is covered under their permit because they are required to monitor for Total Chlorine. If the biocide is
something other than a chlorine product, then they would have to submit a Biocide 101 form.

levels based on testing by the chemical manufacturers and reported in

First of all, most of us here would agree with your characterization of
this discharge as being unique, and that based upon its discharge into
the BSEP's effluent channel, its potential impact on the final receiving
waters is extremely small. However, this discharge is regulated
primarily by federal rules regarding discharges from facilities such as
yours. Even in a situation such as that at the Southport Plant, we have
no choice but to see the rules be applied, but we do have some
discretion in their application. In my mind, the rules are not
particularly stringent, and they reflect utilization of current technology.
All that being said, here are our responses to your requests...
_Outfall 002_
1. We are agreeable to reducing the monitoring for zinc and chromium
from 2/month to monthly. Based upon your description of the cooling
tower processes and maintenance, we are agreeable to changing the sample
type for these parameters from composite to grab, but remind you all
samples are to be representative of the discharge and caution that a
grab sample could have potential to place the facility in compliance
jeopardy with the limits.
Thank you. Your advice is sound. We expect that the Zn and Cr risk is very low. We
will have a plan in -place such as duplicate grab samples for back-up analysis should

the principal sample show a spike.
2. Because it is a federal requirement, we cannot remove the monitoring
for free available chlorine. We may be agreeable to reducing the
monitoring for this parameter from weekly to monthly, but we would like
one additional piece of information to help us make that decision. The
current permit and the one that has been drafted state that monitoring
for FAC is only required during weeks when chlorination occurs. How
often does chlorination occur? If it is typically less than a weekly
occurrence, there'd be little problem in formally reducing the frequency.
We typically chlorinate once per week. The chlorine system is automated. The sodium
hypochlorite solution injection dosage is calculated to complex the FAC resulting in
a discharge concentration below the permit limit of 0.1 ppm. Our procedures is to
test for FAC when clorinating.
_Outfall 004_
1. DWQ has reviewed the data you have submitted for outfall 004 to date.
In the new permit, the following parameters will be removed as
monitoring requirements:

2. The Biocide approval condition will have to remain as is, with
approval for biocide use granted by our Aquatic Toxicology Unit staff.
A possible solution suggeston for your consideration. Would it be possible to set-up
an automatic approval and use with a follow-up notification letter, provided the
chemical to be used is shown in our notification letter to your office to be BELOW
the manufacturer's biotoxicity concentration level in our discharge ? ( This in lieu
of pior submittal and waiting on a decision ? ) At a level below the Manufacturers
published biotox limit, and with the 7Q10 flow at approximately 2600+, there should
be absolutely no risk.

Thank you for allowing our NPDES Permit change suggestions input to
our Southport NPDES permit as part of the renewal process. The changes
which we discussed are listed below for your consideration.
The Southport Plant's discharge status has a somewhat unique status
which merits consideration in the NPDES Permit as we discussed. The
plant discharges its process effluent via its Outfall #003 to the
Progress Energy Brunswick Steam Electric (PEBSE) plant's discharge
canal. The BSE plant's discharge canal discharges into the Atlantic
Ocean. The reported canal flow is 1,700 million gallons per day. The
BSE daily volume flow ( 1,700,000,000 gallons per day ) was converted
to cubic feet per second for use as the 7Q10 factor ( 2630.3 ft3/sec
). Commingling of the Southport effluent into the BSE canal
effectively causes the Southport plant effluent to become
inconsequential in terms water quality or environmental impact.
We appreciate your approval of the chemical vendor certification for
the Priority Pollutants ( versus the annual testing ). We will use
this method to document no PPs in our effluent.
The NPDES permit changes which are submitting to the NCDENR DWQ to
consider are the following:

Primary Energy of North Carolina, LLC - Southport (formerly known as Cogentrix Southport) requires a
National Pollutant Discharge Elimination System (NPDES) permit to discharge treated wastewater to the
surface waters of the state. The permittee's 5-year NPDES permit for their Southport Plant expired
November 30, 2006 and they have requested renewal from the Division of Water Quality (the Division).
This Fact Sheet summarizes background information and rationale used by the Division's NPDES Unit to
determine permit limits and monitoring conditions.

Facility Description. Primary Energy - Southport is a coal-fired, power -generating facility designed to
produce 2,640 megawatts -hours per day. This facility utilizes cooling tower technology and currently
monitors discharge at four outfalls.
Outfall 001 is an internal outfall coal pile runoff.
Outfall 002 is an internal outfall for low volume wastewater and cooling tower blowdown water.
Outfall 004 is the most recently added internal outfall (added to the process in January 2006). It covers a
discharge of reverse osmosis process reject water.
Each of the above outfalls discharge to the Primary Energy — Southport facility's WWTP. Discharge
from the WWTP (Outfall 003) flows to the Brunswick Steam Electric Plant's (BSEP) discharge canal (not
waters of the state) and thence to the Atlantic Ocean.
Correspondence and Records
Verifying Existing Stream Conditions. This facility discharges to the Atlantic Ocean, a Class SB
waterbody downstream of the Cape Fear River Basin via the Progress Energy Brunswick Steam Electric
Plant's discharge canal. This area is not listed as "impaired" [not listed on the DWQ 303(d) list].
Effluent Monitoring and Data Review. This permit does not require instream monitoring.
Total Residual Chlorine (TRC). Because this facility discharges to BSEP's discharge canal (not waters
of the state) and because the BSEP's final outfall is monitored for TRC prior to discharging to the
Atlantic Ocean, this permit does not require TRC monitoring.
Waste Load Allocation (WLA). Records pertaining to this discharge date from 1985. The Division
prepared the last WLA for Outfalls 001, 002, and 003 in 1996 and developed effluent limits and
monitoring requirements considering applicable federal criteria and effluent canal discharge. The
Division views these limits and monitoring requirements appropriate for renewal except as modified
herein (see Renewal Approach Summary).
Whole Effluent Toxicity (WET) Test. Because this facility discharges to the Atlantic Ocean via
Brunswick Steam Electric Plant's (BSEP) discharge canal (not waters of the state), WET testing is not
required.
Renewal Application and Staff Report. The permittee submitted a renewal application on July 19,
2006. The Wilmington Regional Office conducted an inspection of the facility on August 17, 2006.
WIRO found the facility in compliance with the permit, in good operating condition, and recommended
that the NPDES Unit renew the permit in accordance with the Basin Plan.
Renewal Approach
Because this facility discharges into the BSEP discharge canal and from that into the Atlantic Ocean, the
Cape Fear river Basin permitting strategy does not apply to this discharge. The Division judges previous
permit limits and monitoring requirements to be appropriate for renewal considering recent data supplied
by the permittee indicating no significant changes in operations except as noted herein. Current limits and
monitoring are based on the application of the Steam Electric Power Generating Point Source Category
(40CFR 423). Under these federal guidelines, the Division considered the following technology -based

Additional Intermittent Waste Stream for Pipe Maintenance. In addition to requirements for cooling
tower blowdown at Outfall 002, the permittee has been given permission to discharge intermittent iron
residuals from pipe cleaning maintenance at a volume less than 5,000 gallons per year. Because of the
low relative waste volume, and the extreme dilution of this waste by the canal waters (1,700 MGD), the
Division has no objection to this discharge, but has transferred the 126 Priority Pollutants monitoring
requirements to Primary Energy's final outfall (see Final Outfall 003).
Outfall 004 In January 2006, the Division added internal outfall 004 to the permit for the discharge of
reverse -osmosis reject water. It was estimated that flow at Outfall 004 would not exceed 1.15 MGD or
about 30% of the source water needed for cooling (3.85 MGD). Like the older outfalls, this outfall
discharges to outfall 003. Monitoring for this outfall in the draft remained as was established in the
January 2006 permit modification. Determination of the parameters to be monitored was made following
an examination of laboratory analyses from reverse osmosis facilities across the state. The parameters for
which monitoring is currently required are:

The facility has provision within the permit to ask that monitoring for these parameters be reconsidered
after the results of 12 sampling events have been reported and evaluated. The facility made such request
following issuance of the draft permit.

There is no need for water -quality -based permit limits more stringent than technology -based limits
because the permittee discharges to the BSEP discharge canal (not waters of the state) with a final
discharge to the Atlantic Ocean. A Reasonable Potential Analysis was therefore not required to establish
pollutants of concern. However, when the facility was given permission to discharge wastewater from
pipe cleaning maintenance during the last permit cycle, the requirement for the 126 Priority Pollutants
analysis was placed with this outfall. The footnote with this requirement is being updated to ensure the
facility understands it must either submit the analysis on an annual basis or provide an annual certification
that none of the 126 Priority Pollutants are used in any processes that may reach the waste stream.
Renewal Summary/Changes to Draft Permit
Subsequent to the development of the draft permit, staff of Primary Energy contacted DWQ to ask for
modification of its proposed terms (the same as those found in the 2006 modification). Their request is
attached to this fact sheet. To answer the request, the division again reviewed applicable criteria
regulating the discharges and information that had become more complete with the passage of time. In
response, the division has seen fit to reduce monitoring frequencies for Total Chromium and Total Zinc at
outfall 002 to monthly. Applying the language included in the January 2006 modification which added
outfall 004, monitoring was removed for Salinity, Total Aluminum, Total Arsenic, Total Chloride, Total
Copper, Total Iron, Total Fluoride, and Total Zinc. Monitoring frequencies for Temperature, Dissolved
Oxygen, Total Dissolved Solids, Conductivity, pH, and NH3-N were reduced from monthly to quarterly.
Requirements for outfalls 001 and 003 remained as stated in the draft (and noted above)

Southport. Take Highway 87 south from Highway 133. Exit left on SR 1526 prior to the
Highway 211/87 intersection. Proceed to the end of SR 1526 and take a left on SR 1527,
Cogentrix is located approximately''/2 mile northward on SR 1527. Or From Wilmington
take 133 South (at Leland) to Southport. Take a left on Moore Street to Powerhouse Drive.

9. Receiving stream or affected surface waters: discharge is to the Brunswick Steam Electric
Plant 5.4 mile long cooling canal then to Caswell Beach pumping station to a point 2000 feet
off shore into the Atlantic Ocean.

, c. Describe receiving stream features and pertinent downstream uses: Man made cooling
canal that is approximately 5 miles long.
10. Description of industrial discharger: Primary Energy uses coal and tire -derived fuel
("TDF"), and wood to produce steam. Electricity is generated from the steam. The steam is
used by a nearby company (ADM) and the electric output is sold to an energy company. The
facility currently operates six (6) coal /natural gas/No. 2 and No. 4 fuel oil/tire derived
fuel/palletized paper fuel/flyash briquette -fired steam, electric generating boilers with a heat
input capacity of 223 MMBtu/hr each. Supporting operations include storage and handling
systems, conveyors and shredding equipment.
PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS
1. a. Volume of wastewater to be permitted: 0.7 MGD Includes:
Process water (monthly average) 0.5 MGD
Stormwater (monthly average) varies
RO reject water 0.2 MGD
Total Monthly average 0.7 MGD but peak can exceed 1 MGD

c. Actual treatment capacity of the current facility? 0.5 MG
d. Date(s) and construction activities allowed by previous Authorizations to Construct
issued in the previous two years: None.
e. Description of existing treatment facility and wastestreams: 2 rectangular settling
lagoons used to settle solids from incoming waste streams and pH adjustment basin.
Outfalls 001, 002, and 004 are internal outfalls. Discharge Outfall to surface waters is
from Outfall 003. Coal pile runoff (Outfall 001) flows via a "V" ditch into an in-
service wastewater basin. Discharge from Cooling Towers 1 and 2 Blowdown (Outfall
002) is released into a discharge sump. Additives include sodium hypochlorite,
chemtreat CL-215, Chemtreat CL-40. RO reject water (0.2 MGD) discharges into a
30,000 gallon reject water holding tank. Additives to RO water backwash can be
Avista RoQuest 3000, sodium bisulfite, Avista Vitec 3000, Avista RoClean P303,
Avista RoClean L403, and Avista RoQuest 4000. The reject water tank overflow
discharges directly to the wastewater basins. The multimedia backwash and the RO
reject water combine to form Outfall 004. All process water discharges into an in-
service wastewater basin. Discharge from Outfall 001, Outfall 002, Outfall 004 and
process water are discharged into two 500,000-gallon wastewater basins. All facility
wastewater is then discharged through Outfall 003. The renewal application received
on July 24, 2006 indicates 0 gallons of sanitary waste. Sanitary waste is treated via
septic tank system permitted by Brunswick County Health Dept.

Possible toxic impacts to surface waters: Past analysis indicate arsenic, copper,
aluminum, zinc, barium, chromium, and lead concentrations at detectible limits in
Outfall 002 according to a staff report issued in 1992. Currently, boiler makeup water
is treated via RO.
h. Pretreatment Program (POTWs only): Not needed.
2. Residuals handling and utilization/disposal scheme: Sludge is cleaned from the settling
basins (as needed) and is returned to the coal pile for dewatering and possible reuse.
3. The compliance history for this facility within the past permit cycle is as follows:
No violations of permit effluent limitations in the past permit cycle.

PART IV - EVALUATION AND RECOMMENDATIONS
TSS daily maximum was raised in 2004 to 100 mg/L (Outfall 001), total chromium daily
max was lowered to 0.2 mg/, copper and barium deleted from permit in 2004 (Outfall 002)
and 126 PPA added to final outfall 003.
The draft permit appears to have included all the limits and monitoring frequencies specified
in the previous permit issued in June 2004. All of the permit limits and parameters required
of RO reject water has been included. Available chlorine in Outfall 002 may not be
necessary since this discharges to the Atlantic Ocean, likewise for total chloride in Outfall
004.
The Wilmington Regional office has no objections to reissuing permit no. NC0065099 in
accordance with the Cape Fear Basinwide permitting strategy provided no significant
adverse public comments are received. The nutrient monitoring requirements specified in
Lower Cape Fear Strategy does not apply to this discharger since the final discharge is to the
Atlantic Ocean.

Primary Energy Southport does not discharge any waste basin sludge into the discharge stream. Regarding the
check that was included with the NPDES application, I included it based on correspondence with Joe Corporon (see
insert)
Greg -- I checked our BIMS system and, as of this date/time, we have no renewal
application active. This means we have not yet logged in a check. Ask your people if
its in the mail, otherwise you need to send the usual hard copies and a check for
$715 App fee.
We later learned that the application had not been received. And, we sent the check with the application to insure all
requirements were met. If the check is not needed, please return it to our mailing address of:
