Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). Please be aware that Little Troublesome Creek is listed as an impaired stream on North Carolina's 303(d) list. This means that the stream does not meet all water quality standards. The Division is working toward the improvement of water quality in Little Troublesome Creek. If the Division's current initiatives do not result in improved water quality, removal of discharges to Little Troublesome Creek may be necessary for the health of the stream. Although the Division believes urban runoff is the main cause of degradation to Little Troublesome Creek, we will continue to monitor compliance at your facility. If noncompliance with your permit's effluent limits is shown to be a direct cause of stream degradation, the Division will recommend removal of your facility's discharge. Your facility discharges to a nutrient -sensitive water (NSW). In 1997 the Clean Water Responsibility Act (House Bill 515) was enacted, with the intent to strengthen the control of nutrients from all discharges to NSW waters. Facilities permitted to discharge greater than 500,000 gallons per day (and any new or expanding facilities) will be subject to nutrient limitations for total nitrogen and total phosphorus according to House Bill 515 requirements. Since modifications to treatment systems are expensive and time consuming, it is highly recommended that you begin planning for this possibility now if a future expansion is anticipated at your facility. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. N. C. I collected the information below based on the assumption that the Willow Oak MHP in question is the one we have permitted. Willow Oak is one of several small domestic discharges involved with the same person apparently empowered to act as the owner. The permits include: NC0060259 WILLOW OAK, L.L.C. (Rockingham County) - expires 4/30/01 NC0065412 REA ENTERPRISES, LLC (Rockingham County) - expires 4/30/01 NC0022098 CEDAR VALLEY COMMUNITIES, LLC (Guilford County) - expires 6/30/01 NC0065358 HIDDEN FOREST ESTATES WWTP (Randolph County) - expires 8/31/01 NC0062278 BERKLEY OAKS, LLC (Gaston County) - expires 9/30/01 NC0056201 COUNTRYSIDE LLC/COUNTRYSIDE MHP (Randolph County) - expires 1/31/04 Three addresses have been given for the owner of these permits: 1423 North Great Neck Road, Suite 205 Virginia Beach, VA 23454 and 708-M South Battlefield Boulevard, Suite 102 Chesapeake, VA 23322 and 316% South Main Street, Suite 202 Royal Oak, Michigan 48067 The contact for all the facilities listed above is Michael J. Power. Mr. Power has faxed documents to Division personnel with the Chesapeake address on the letterhead, but with no company name. The Willow Oak (NC0060259) and Rea Enterprises (NC0065412) permit renewal applications were due on November 1, 2000. The Cedar Valley permit renewal application was due January 1, 2001. To date, none of these renewal applications have been submitted. Willow Oak's existing treatment works include a 2-cell lagoon with clarification and chlorine disinfection. I printed GKPR data for the period January 1999 - December 2000. A few highlights: BOD monthly averages of 7.83 mg/L (1999) and 5.0 mg/L (2000). NH3 as N monthly averages of 0.83 mg/L (1999) and 0.73 mg/L (2000). TRC has not been detected in the effluent in the past 2 years. Fecal coliform monthly averages of 9.8/100 ml (1999) and 1.4/100 ml (2000). Mike Myers of our Unit renewed NC0056201 last year. He may be able to give some more details on Mr. Power. That renewal was difficult as the facility discharges to a zero -flow stream and has a poor compliance history. Corey Basinger in the WSRO also dealt with that permit. An examination of the Cape Fear basin plan and the NPDES permit schedule has revealed that the existing expiration dates in Cape Fear NPDES permits do not coincide with the revised permit expiration dates for the basin. This discrepancy could create unnecessary delays in the processing of over 200 permit renewals. Accordingly, the Division is changing the permit expiration dates for NPDES permits in the Cape Fear river basin. This permit modification changes the expiration date of the subject permit in subbasin 30601 to April 30, 2001. Please find enclosed the revised permit cover page. Insert the new cover page into your permit and discard the old page. All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency. In accordance with the modification of the permit expiration date, the new due date for your renewal application was November 1, 2000. Renewal application are enclosed. If you require additional copies of the form, you may download it from the NPDES web site at http://h2o.enr.state.nc.us/NPDES/documents.html. You will need to download Short Form D. If you have already submitted a permit renewal form, there is no need to submit any other forms to the Division; the application will be processed during the renewal period for your subbasin.
