Dear Bo Shi:
The Division of Energy, Mineral and Land Resources (DEMLR) has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stormwater Permitting form, received on June 29,
2022. The Division is unable to concur with your certification of no exposure.
Based on an inspection of your facility on July 15, 2022, Washington Regional Office staff found that
metal scrap recycling activities and/or materials on your site are exposed to precipitation events. The
existence of exposed scrap metal, wood pallets, and "roll off' type waste dumpsters on your site
disqualify this facility from a No -Exposure Certification. It is our recommendation that you are better
suited for coverage under General Permit NCG200000, Scrap Metal. The Division cannot grant your
requested exemption from permit coverage when industrial activities or materials are exposed. Please
apply for coverage under General Permit NCG200000 within 45 days of this letter.
