Hi Greg,
After doing a little research here is what I have found:
1. The facility has been in litigation for some time.
2. There are many unresolved issues related to the litigation.
3. Because of the litigation NCDEQ cannot process the permit request.
4. One available option: If the decision is to rescind the permit, (1) then the facility must be
completely shutdown, (2) All lagoons and other treatment units must be cleaned out, and
(3) the outfall(s) must be permanently plugged. However, because of the inflow to the
system resulting in periodic discharge this cannot happen. Therefore, all permit conditions
must be met before NCDEQ requirements are met for the NCDEQ to assess the viability
of permit rescission.
If you should have any questions and/or concerns please feel free to reach out to me at your earliest convenience.
Sincerely,
Douglas Dowden

Subject: NC0005312 - Permit Parameters Waiver Request
Mr. Poupart,
Please find the attached Permit Parameters Waiver Request for your review and consideration. Considering the
lack of influent and effluent flow at the wastewater treatment plant (WWTP) and the significant accrual of costs to
continue to staff and operate the facility, Duvaltex US, Inc. (Duvaltex) is requesting relief from certain parameters
of the NPDES permit. Please do not hesitate to contact me with any questions. We look forward to your
response.
