Good afternoon April and Ryan,
I am emailing on behalf of our client, the Town of Chapel Hill, in regards to the previously permitted and under
construction Elliott Road Extension Project located in Chapel Hill, Orange County, NC (DWR# 20191250; SAW-2019-
0013). During a routine inspection, it was noted that water flowing out of the culvert extension has scoured the channel
and is undermining the culvert structure. In the original permit application, the Project proposed Permanent, No Loss of
Water stream impacts resulting from keyed-in rip rap along the banks at the culvert outlet; however, no rip rap was
anticipated to be needed in the streambed. A design revision has been made to protect the channel and culvert, prevent
further scour, and raise the streambed to pre-existing conditions through the addition of keyed-in rip rap in the
streambed at the culvert outlet. Since the Project had Permanent, No Loss of Water stream impacts permitted through
the section of the stream below the culvert outlet, the impact quantities listed in the permit have not changed. I am
sending over the revised plan sheet showing the updated rip rap hatching across the streambed at this culvert outlet
and the accompanying details for your records.
After discission with the USACE, it is Kimley-Horn’s understanding that a permit modification for these changes will not
be required considering that the proposed design changes have not resulted in a change to the previously permitted
impacts and the Project impacts will be constructed within the 12-month grace period following the 2017-2022
Nationwide Permit expiration. Please feel free to reach out with any questions you may have regarding this design
