Thank you for your PCN, dated 6/28/2022, for the above referenced project. I have reviewed the information and need
clarification before proceeding with verifying the use of Regional General Permit (RGPP) 50 (https://saw-
reg.usace.army.mil/RGP/RGP50.pdf). Please submit the requested information below (via e-mail is fine) within 30 days
of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your
application withdrawn and close the file:
1) The cover letter references a "Type III Categorical Exclusion Action Classification Form", however this form does
not appear to have been included in the submittal.
2) Section 106: The PCN references a no survey required letter for Historic Properties, however only the
Archeological sites letter (appears to be attached twice) is included in the PCN submission. Please provide the no
survey required letter for Historic Properties.
3) Section 7: The cover letter of the PCN package includes a table of all listed species in the project action area,
including plant species that required recent surveys and several aquatic species with biological conclusions of
May Affect, Not Likely to Adversely Affect. Please provide any survey reports or other documentation pertaining
to the most recent surveys for Michaux sumac and Smooth coneflower, as well as documentation that the
Mussel PBO and Carolina madtom/NRWD PCO is being followed (e.g. correspondence with USFWS, in -lieu fee
payments made, method of determining the appropriate payment under each agreement, etc.).
4) Please confirm that compensatory mitigation for wetland impacts is proposed at a 2:1 mitigation to impact ratio.
If so, it appears that the cumulative 0.5337 acre of impacts would warrant the purchase of 1.0674 riparian non-
riverine wetland credits. However, the total amount of maximum wetland credits secured (0.7 from EBX and
0.24 from NCDMS per the cover letter) is 0.1274 credits short of the required amount. Please update the
compensatory mitigation proposal and availability accordingly.
5) The compensatory mitigation proposal for stream impacts appears to include purchased credits well in excess of
those needed for the 1-3306A project. Please advise if there are credit amounts from specific banks that you
propose to use. Otherwise, please note that the Corps will assign in-HUC credits preferentially based on
proximity of each bank to the project area (likely Bucher [03020201] and Benton Branch [03030002]).
6) Please advise if there is an intuitive repository for reference documents that may aid in my evaluation, including
NRTRs and addenda, Section 106 and Section 7 correspondence, NEPA Documents, project commitments, etc. If
not, please provide the most updated documents for use in my evaluation.
