Subject: REQUEST FOR ADDITIONAL INFORMATION

On June 3, 2014, the Division of Water Resources (Division) received your application dated May
29, 2014, requesting a 401 Individual Water Quality Certification / Buffer Authorization from the
Division for the subject project. The Division has determined that your application is incomplete
and cannot be processed. The application is on -hold until all of the following information is
received:
1. Please provide more details regarding avoidance and minimization of wetland impacts for
this project. This Office believes that the road crossing labeled on the plans as permanent
wetland impact #1 can be moved north crossing the wetland at a narrower point and the
two lane divided roadway section could be tapered to an undivided two lane section
prior to the wetland to minimize the impacts to the wetland. Please revise the plans to
minimize the impacts or provide a detailed explanation of why this plan for the activity
cannot be practically accomplished, reduced or reconfigured to better minimize
disturbance to the wetlands including maps showing the alternatives discussed in
alternative analysis section of the application.
2. Please provide a plan for removal of the existing culvert including measures to restore the
stream channel to its original pattern, dimension, and profile and accomplish the work in
the dry.
3. Please clarify whether the Division of Energy, Mineral and Land Resources will require
riprap within any stream channels or wetlands as part of the Erosion & Sedimentation
Control Plan approval. If riprap is required, please enumerate and clearly label the
temporary and permanent impacts on the site plan and submit a channel restoration
detail. Riprap must be located below the stream bed elevation.

4. Please provide a full -sized plan sheet showing the entire site with its storm drainage
system, including every inlet, outlet and conveyance device. Please show how diffuse flow
requirements have been met at every proposed outlet location.
Pursuant to Title 15A NCAC 02H .0502(e) / 15A NCAC 02B [Neuse] .0233, the applicant shall furnish
all of the above requested information for the proper consideration of the application. If all of the
requested information is not received in writing within 30 calendar days of receipt of this letter,
the Division will be unable to approve the application and it will be returned. The return of this
project will necessitate reapplication to the Division for approval, including a complete application
package and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies of
all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service
Center, Raleigh, NC 27699 -1617.
Please be aware that you have no authorization under the Section 401 of the Clean Water
Act /Buffer Rules for this activity and any work done within waters of the state may be a violation
of North Carolina General Statutes and Administrative Code.
