When the application, dated 12/2/13, was originally submitted, the proposed mitigation plan consisted of the purchase of all required mitigation from EEP. However, during the Public Notice, it was brought to our attention that the North East Cape Fear Umbrella Mitigation Bank (NECFUMB) has credits available within the project's HUC. However, NECFUMB does not have enough credits to cover the entire mitigation requirements for the project. Therefore, in order to meet the Federal Mitigation Final Rule and current state law, the permittee will be satisfy the required mitigation through the purchase of a combination of credits from NECFUMB and EEP. Below is a breakdown of the mitigation requirements and the updated mitigation plan for where the credits will be purchased.
