Both the Corps Individual Permit and DWR Individual 401 WQC required mitigation for the
proposed impacts to wetlands, streams and jurisdictional RPW ditches. When the application,
dated 12/2/13, was originally submitted, the proposed mitigation plan consisted of the purchase of
all required mitigation from EEP. However, during the Public Notice, it was brought to our
attention that the North East Cape Fear Umbrella Mitigation Bank (NECFUMB) has credits
available within the project's HUC. However, NECFUMB does not have enough credits to cover
the entire mitigation requirements for the project. Therefore, in order to meet the Federal
Mitigation Final Rule and current state law, the permittee will be satisfy the required mitigation
through the purchase of a combination of credits from NECFUMB and EEP. Below is a
breakdown of the mitigation requirements and the updated mitigation plan for where the credits
will be purchased.

I have attached the mitigation invoices from both NECFUMB and EEP to this letter to document
that the mitigation credits have been reserved as specified above and are ready to be purchased.

The DWR Individual 401 WQC will need to be updated to specify the provision of'the mitigation,
as identified in the Updated Mitigation Plan table above
The Corps IP was issued wnth_a single "Compensatory Mitigation Responsibility Transfer Form"
referencing both EEP and NECFUMB as the providers, but did not specify the amount of
mitigation to be provided by each entity due the uncertainty of how much mitigation NECFUM
would have available when the I_P was issued, Please provide two separate Compensatory
Mitigation Responsibility Transfer Forms, with a form specific to NECFUMB and EEP with the
amount to be provided by each entity as specified in the table above Please note that EEP will
not, allow the applicant to purchase the reserved mitigation until they receive the Compensatory
Mitigation Responsibility Transfer Form specific to the mitigation to be provided by EEP
Once I have received the DWR Individual 401 WQC with the updated mitigation plan, as well as
the Compensatory Mitigation Responsibility Transfer Forms specific to EEP and NECFUMB, the
applicant will purchase the mitigation
