NASH Wendell Falls, LLC (Wendell Falls) submits the following request to identify Chris
Huysman of Wetland and Natural Resource Consultants (WNR) as an Authorized Agent
for the Wendell Falls project located in Wendell, NC. Furthermore, please accept this
acknowledgement that Wendell Falls intends to comply with all conditions with the
issued 404 and corresponding 401 Water Quality Certification.
For your reference, I have included a copy of the Army Corp permit dated June 6, 2014,

Dear Mr. Mumford:
Reference is made to your request, dated April 22, 2014, by your agent, Mr. Chris
Huysman with Wetland and Natural Resource Consultants, Inc., for a modification to the
Department of the Army (DA) permit, which authorized permanent impacts to 0.16 acre of
open water, 2,354 linear feet of perennial channel, 581 linear feet of intermittent stream
channel and 3.24 acres of wetlands. In addition, the permit authorized temporary impacts to
0.2 acres of wetlands and 625 linear feet of stream channels for utility line construction
associated with the development and construction of Wendell Falls Development.
Specifically, the project site is located on the west side of Martin Pond Road (SR 2503),
2,600 feet north of the intersection of Martin Pond Road and Poole Road (SR 1007), in
Wendell, Wake County, North Carolina. The site is comprised of approximately 1,300
acres and is found at Latitude and Longitude in decimal degrees of 35.7694621 N and
78.4220719 W. The project contains unnamed tributaries of Mark's Creek within the Neuse
River Basin (HUC 03020201).
Specifically, your proposal involves the elimination of two road crossings in order to
re -habilitate a failing dam, which will be utilized as a source of irrigation for 15 acres on
the property. These proposed modifications to the dam and pond will result in permanent
impacts to 135 linear feet of stream channel below the existing embankment for
modifications to the pond's embankment fill, proposed plunge pool and temporary
construction activities. Your proposal also involves that an additional 45 linear feet of
intermittent stream channel will be flooded once the dam's rehabilitation is complete. In
addition to the stream impacts, your proposal involves a total of 0.06 acres of temporary
impacts to jurisdictional wetlands (0.03 acre for the embankment and 0.03 acre for the
plunge pool). Furthermore, instead of providing compensatory mitigation for the
unavoidable jurisdictional impacts, you propose to abandon your initial proposal to

construct two road crossings (R1 and R7), which had 135 linear feet of stream impacts and
0.11 acre of wetland impacts, respectively. We have considered your proposal and are
hereby modifying the permit per the attached plans. Please be reminded that you must
abide by all remaining conditions of the current permit, which expires December 31, 2022.
