This project is designed to provide riparian buffer credits and nutrient offset credits for unavoidable impacts due to development within the Neuse River Basin, excluding the Falls Lake Watershed, United States Geological Survey (USGS) 8-digit Cataloging Unit 03020201 (Neuse 01) (Figure 1). This Bank Parcel Development Plan is in accordance with the Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295 and Nutrient Offset Credit Trading Rule 15A NCAC 02B .0703 and the RES 2021 Neuse UMBI. Li Parcel Location The Shady Grove Mitigation Project (Project) is located in Wayne County, approximately two and a half miles northwest of Mount Olive, NC (Figure 2). The Project consists of one parcel with 19.45 acres of conservation easement. The Project has a total drainage area of 108 acres and is located within a rural area (Figure 3). The land use within the project area is currently comprised of row crop production with pockets of disturbed forest (Figure 4). To access the Project from the town of Mount Olive, travel southwest of State Route 55 for approximately three and a half miles. Turn right onto Shady Grove Road, and continue for approximately three quarters of a mile, and the destination will be on the right. The latitude and longitude of the Project is 35.219357, -78.111898. 1.2 Parcel Overview The conservation easement of the Shady Grove Project will total approximately 19.45 acres and is comprised of two areas that can be accessed from Thunder Swamp Road or Shady Grove Road (Figure 2). Currently, the Project reaches and adjacent areas are in crop production or disturbed forest. The Project area has been used extensively for agricultural production for over 50 years (Figure 5). Water quality stressors currently affecting the Project include pollution from crop production, including the use of poultry compost as fertilization, and lack of forested riparian buffer (Figure 4). Current buffer conditions show minimal hardwood coverage as a product of the row crop coverage. The goal of the Project is to restore and preserve ecological function to the existing riparian areas by establishing appropriate plant communities while minimizing temporal and land disturbing impacts and permanently protecting the newly restored buffer in perpetuity through a conservation easement. Buffer and surrounding riparian area improvements will filter runoff from agricultural fields, thereby reducing nutrient and sediment loads to Project channels and provide water quality benefit to the overall watershed. The Project is comprised of two intermittent stream channels: DJ1 and DJ2; and three ditches: DJ3, DJ4, and DJ5 (Figure 4). All streams and ditches have clearly been straightened and are incised. The fifty -foot riparian buffer areas of only DJ1 were determined to be subject to the Neuse Riparian Buffer Rules (15A NCAC 02B .0714). The fifty -foot buffer areas of DJ2 were determined to not be subject to the Neuse Riparian Buffer Rules (15A NCAC 02B .0714). Whereas DJ3, DJ4, and DJ5 were determined to be a dllsay Grove Mitigation Project Bank Parcel Development Package Riparian Buffer Mitigation and Nutrient Offset 3 July 2022 and therefore not subject to the Neuse buffer protection rules ("non -subject"). Stream determinations were verified by the DWR site visit on September 23rd, 2020. Correspondence regarding this determination is in Appendix C. Riparian area mitigation efforts along the Project stream and ditch features will be accomplished through the planting, establishment, and protection of a hardwood forest community. The result will be a riparian area that functions to mitigate nutrient and sediment inputs from the surrounding uplands. The buffer mitigation plan proposed is being submitted for review under the Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295 and Nutrient Offset Credit Trading Rule 15A NCAC 02B .0703. In addition to traditional riparian restoration, the Project will also incorporate the alternative buffer mitigation options: riparian buffer preservation, as outlined in 15A NCAC 02B .0295 (o)(4) and (o)(5) and Restoration on Ditches as outlined in 15A NCAC 02B .0295 (o)(8). DWR staff performed an onsite viability assessment for buffer mitigation on September 23rd, 2020. Correspondence regarding this assessment is provided in Appendix C and dated March 3rd, 2021. These will be derived from restoration and preservation of the riparian buffer and surrounding riparian areas. The buffer restoration credits, and nutrient offset credits will be produced by establishing a native forested and herbaceous riparian plant community and protecting buffers in perpetuity with a conservation easement. For stream channels, buffers will have a minimum width of 50 feet and a maximum of 200 feet from the edge of the channels. For ditch features, the restored area will have a minimum width of at least 50 feet and extend to a maximum of 200 feet from the edge of the channel. However, only the first 50 feet will be eligible for riparian buffer credit and the 50 to 200 feet will be eligible for Nutrient offset. The new plant community will be established in conjunction with the treatment of any existing exotic or undesirable plant species. Figure 6 shows the Conceptual Design Plan for Buffer and Credit Determination Map, and Section 8 provides details of the mitigation determination on the Shady Grove Project. 1.2.1 Parcel Ownership The land required for the construction, management, and stewardship of this Project includes portions of the parcel listed in Table 1. EBX, LLC (an entity of RES) will obtain a conservation easement from the current landowner for the project area. The Mitigation Banking Conservation Easement Template for Buffer & Nutrient Offset Sites (provided by DWR with slight modifications) will be utilized to draft the site protection instrument. Once recorded, the secured easements will allow EBX to proceed with the Project development and protect the mitigation assets in perpetuity. Once finalized, a copy of the land protection instrument(s) will be included in Appendix B. Table 1. Class C waters are protected for uses such as secondary recreation, fishing, wildlife, fish consumption, aquatic life including propagation, survival and maintenance of biological integrity, and agriculture. Secondary recreation includes wading, boating, and other uses involving human body contact with water where such activities take place in an infrequent, unorganized, or incidental manner. NSW designation is intended for waters needing additional nutrient management due to being subject to excessive growth of microscopic or macroscopic vegetation (NCDWQ 2011). 2.1.2 Physiography and Soils The Project is located within the Rolling Coastal Plain Level IV ecoregion within the Southeastern Plains Level III ecoregion and is characterized by greater relief, elevation, and stream gradients compared to the Mid -Atlantic Coastal Plain to the east with better drained soils and a slightly cooler and shorter growing season. However, it is a productive agricultural region with typical crops of corn, soybeans, tobacco, cotton, sweet potatoes, peanuts, and wheat. (Griffith et al., 2002). Elevations range from 125 to 135 feet above mean sea level (NAD 83) based upon topographic survey (Figure 3). The Natural Resources Conservation Service (NRCS) depicts nine soil map units across the Project (Figure 7). The Project area is dominated by Kenansville loamy sand, with large areas of Bibb sandy loam and Lynchburg sandy loam, 0 to 2 percent slopes. The other six soil units make up smaller parts of the project area. The soil characteristics of these map units are summarized in Table 2. Table 2. Existing Vegetation Communities Currently, portions of each feature (DJ1, DJ2, DJ3, DJ4, and DJ5) lack a riparian buffer. In areas where the is no riparian buffer, row crop production extends to the edge of those features. Along the downstream portion of DJ1 there is a thin strip of forested canopy along the right buffer. Additionally, there is a narrow strip of trees at the downstream end of DJ2. Lastly, along the upstream portion of DJ3 on the left bank (east side) is wooded. Trees along these features consist of willow oak (Quercus phellos), red maple (Acer rubrum), sweet gum (Liquidambar styraciflua), and American sycamore (Platanus occidentalis). One exotic invasive species was observed within the project, Chinese privet (Ligustrum sinense). 8. Riparian Vegetation In general, all of the reaches and ditches within the Project do not function to their full potential. Current conditions demonstrate significant habitat degradation with a loss of stabilizing vegetation as a result of impacts from ongoing crop production. DJ1 runs through the wooded area in the middle of the project. For most of the reach, both banks have a riparian area except at the confluence with DJ5. Vegetation consists of willow oak, red maple, sweet gum, and American sycamore. DJ2 starts at the beginning of a small strip of trees, with its left bank wooded. The right bank abuts row crop production. Vegetation is similar to DJ1 with willow oak, red maple, and sweet gum as primary woody vegetation. The banks contain weedy, herbaceous vegetation as well. Shady Grove Mitigation Project Bank Parcel Development Package Riparian Buffer Mitigation and Nutrient Offset 6 July 2022 DJ3 starts at the tree line in the middle of the project and flows west. It was classified as a man-made ditch by DWR. DJ3 becomes DJ2 at the small stand of trees near the edge of the project. There is no riparian vegetation as it cuts through row crop fields. The banks contain weedy, herbaceous vegetation. DJ4 begins at the edge of the project and flows west before its confluence with DJ3. There is no riparian vegetation, and the banks contain weedy, herbaceous vegetation. DJ5 starts near the edge of the project parcel and flows west. Most of the reach has no riparian buffer area except in the middle where there is a small buffer. DJ5 confluences with DJ1 near the chicken houses and has a riparian buffer area on the right bank only. According to the United States Fish and Wildlife IPAC database review tool (USFWS 2022) and the self -certification process conducted by RES and submitted to the USFWS on April 14, 2021. Threatened and endangered species included in the Official Species list include the Red -cockaded woodpecker (Picoides borealis), Neuse River Waterdog (Necturus lewisi), Carolina Madtom (Noturus furiosus), and the Monarch Butterfly (Danaus plexippus). The Shady Grove Mitigation Project does not contain any suitable habitat for the Red -cockaded woodpecker, the Neuse River Waterdog, nor the Carolina Madtom. A self -certification letter was sent to USFWS (on April 14th, 2021). A copy of this letter is enclosed. No response was provided by USFWS which is typical as the certification letter (provided) is their official response unless they do not concur with the determination. This consultation can be found in Appendix C. The Fish and Wildlife Coordination Act requires consultation with state fish and wildlife agencies when "waters of any stream or other body of water are proposed or authorized, permitted or licensed to be impounded, diverted, or otherwise controlled or modified. The North Carolina Wildlife Resources Commission (NCWRC) was consulted, did not comment on any state or federally listed species; however, they did recommend the use of biodegradable and wildlife -friendly sediment and erosion control devices and to treat invasive species as part of the Project. Documentation is included in Appendix C. 3.2 Cultural Resources A review of North Carolina State Historic Preservation Office (SHPO) GIS Web Service (accessed July 7, 2022) database did not reveal any registered occurrences within the Project area. Correspondence can be found in Appendix C. 3.3 Federal Emergency Management Agency (FEMA)/ Hydrologic Trespass The Project is not within a mapped FEMA Regulatory Floodway or 100-year floodplain (Figure 4). The adjacent land use will not be affected by the proposed design, and no detrimental impacts are expected beyond the easement limits. No grading activities are proposed in the floodplain, so a floodplain development permit will not be required. No hydraulic modeling is proposed for this project. 3.4 Clean Water Act - Section 401/404 Due to the nature of this project, there will be no 401/404 permit required. 3.5 Additional Environmental Considerations A Phase I Environmental Assessment was completed for the Parcel, through an EDR report in July 2021. The report can be found in Appendix D. Neither the target property nor the adjacent properties were listed in any of the Federal, State, or Tribal environmental databases searched by report, and the supporting Environmental Data Resources (EDR) report. There were no known or potentially hazardous waste sites identified within or immediately adjacent to the project area. Shady Grove Mitigation Project Bank Parcel Development Package Riparian Buffer Mitigation and Nutrient Offset 9 July 2022 The ditch feature, DJ3, meets criteria for riparian buffer restoration according to Rule 15A NCAC 02B .0295 (o) (8) in the following ways: (A) DJ3 drains directly to reach DJ2, an intermittent stream. (B) The stream (DJ2) and DJ3, including their confluence, will be protected by a contiguous, perpetual conservation easement that will prevent any future maintenance or manipulation of the ditches. (C) Stormwater runoff and overland flow drain toward the ditches. (D) DJ3 is less than three feet deep (as measured before and during the DWR buffer viability site visit. (E) The entire length of each ditch has been in place prior to the effective date of the Neuse Buffer Rule (see Figure 5). Additionally, the watershed (DA) draining to the ditch was delineated (Figure 3) and determined to be at least four times (multiplier of 4) larger than the restored area along their corresponding ditches, as expressed in the following calculations: • DJ3: (17 ac. DA) / (1.16 ac. restored area) = 14.66 multiplier 4 RIPARIAN RESTORATION AND PRESERVATION IMPLEMENTATION PLAN Riparian buffer areas adjacent to streams and ditch features are shown in Figure 6 and were determined by the DWR in the letter dated March 3rd, 2021 (Appendix A). 4.1 Parcel Preparation Preparation at the Project will involve spraying crops and exotic invasive species, clearing undesirable scrub -shrub vegetation, contoured ripping, soil amendments, seeding, and planting. Additionally, there is some trash and debris in the riparian buffer, this will be removed as part of the buffer restoration activities. Soil amendments will be provided across the entire planted area based on the results of soil fertility tests. The soils fertility tests will be based on soil samples collected within proposed riparian restoration areas across the site. A seed mix will be chosen to maximize successful herbaceous growth in all riparian areas while also incorporating valuable pollinator species. All riparian planting areas will be ripped prior to tree planting. The proposed seed mix will be sown via no -till drill or broadcast depending on the time of year. This will provide temporary and permanent ground cover for soil stabilization, wildlife forage, and reduction of sediment loss during rain events. This process should provide favorable soil conditions for plant growth. Bare root plantings and live stakes shall be planted according to detail shown in the planting plan (Section 4.3). 4.2 Methods Riparian buffer mitigation activities will include restoration, preservation, and nutrient offset along streams and viable ditches. All restoration areas were determined by the viability assessment by DWR (Appendix A). Shady Grove Mitigation Project Bank Parcel Development Package Riparian Buffer Mitigation and Nutrient Offset 10 July 2022 4.2.1 Riparian Restoration and Nutrient Offset Activities - Streams For stream channels, the Project will provide riparian buffer restoration in accordance with the Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295 (n). Nutrient offset credits generated from the riparian restoration activities will comply with the Nutrient Offset Credit Trading Rule 15A NCAC 02B .0703. Restoration and nutrient offset activities will include the planting of bare root plantings as described in Section 4.3. These activities will begin from the tops of the existing stream banks and extend a minimum of 50 feet from the stream outward to a maximum of 200 feet perpendicular to the stream channel (Figure 6). Restoration and nutrient offset will occur where cropland is currently present as well as selective areas of early successional, regenerating forest that lack suitable density and composition. There will be a credit deduction for untreated flow entering riparian buffer areas according to 15A NCAC 02B .0295 (I) (2) (3) and Buffer Interpretation/Clarification #2008-019 Memorandum dated 08/19/2008. Specifically, there is untreated flow that enters the project in three different areas. The beginning of DJ3 within the easement and the beginning of DJ4 in the easement. Therefore, where untreated flow enters the easement boundary, a 120° angle wedge, drawn 50 feet below the easement boundary, was removed from the associated buffer area for crediting purposes (Figure 6). 4.2.2 Riparian Preservation Activities — Streams There will be no parcel preparation activities done in the riparian buffer preservation areas, as allowed under Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295 (o). There are large areas of mature forest DJ1, DJ2 and Ditch DJ5 that will be protected in perpetuity by conservation easement, and no additional treatment or planting is planned for these areas of the project (Figure 6). Riparian preservation activities are in accordance with the alternative mitigation option of the Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295 (o) (4) and (o) (5). The project is in compliance with 15A NCAC 02B .0295 (o) (4) and (o)(5) by: • • The area meets the requirements of 15A NCAC 02R 0.0403(c) (7), (8), and (11) with no known structures, infrastructure, hazardous substances, solid waste, or encumbrances within the mitigation boundary (See Section 3.5 for EDR Radius Report summary). Mitigation credits for preservation are being requested on no more than 25% of the total area of buffer mitigation (See Table 6 for credit calculations). 4.2.3 Riparian Restoration Activities — Ditches The Project includes three nutrient viable ditches: DJ3, DJ4, and DJ5 (Figure 4). Only DJ3 is viable for buffer credit as discussed in the DWR buffer viability assessment and the Consolidated Buffer Rule 15A NCAC 02B .0703 (o) (8) (A, B, C, D, E). These ditches are proposed for nutrient offset crediting in accordance with Consolidated Buffer Rule 15A NCAC 02B .0703 and the DWR buffer viability assessment (Appendix A). As no channel work is proposed on these ditches, the only restoration activities will include the planting of bare root trees as described in Section 4.3. Riparian Restoration Activities for Buffer Restoration on DJ3 will begin at the top of bank and extend out to a maximum of 50 feet. Restoration activities on DJ3 for nutrient offset credits will begin at the 50 feet and extend to a maximum of 200 feet perpendicular to the ditch channel. For ditch features, DJ4 and DJ5, activities will begin from the tops of the ditch banks and Shady Grove Mitigation Project Bank Parcel Development Package Riparian Buffer Mitigation and Nutrient Offset 11 July 2022 extend a minimum of 50 feet from the ditch outward to a maximum of 200 feet perpendicular to the ditch channel (Figure 6). All these riparian areas are currently cropland (Figure 4). 4.2.4 Other Activities Other activities involved with the buffer mitigation component include localized livestaking. Live stakes will be planted on stream and ditch banks where stability is compromised. Additionally, debris removal will occur throughout the Project where present. 4.3 Planting Plan All riparian restoration areas will be planted from top of bank back at least 50 feet from project streams and viable ditches with bare root tree seedlings on a nine by six-foot spacing to achieve an initial density of approximately 807 trees per acre. Additionally, as mentioned in Section 4.1, the riparian restoration area will also be seeded with a combination of a temporary and permanent seed mix to provide the site an initial herbaceous cover. Planting of the Project where riparian buffer restoration and nutrient offset is being performed will meet the performance standards outlined in the Consolidated Buffer Rule 15A NCAC 02B .0295. The vegetation data will be collected no earlier than late August of each year. This includes treating invasive species and planting at least four species of native hardwood bare root trees. Mixed- Mesic Hardwood Forest (Coastal Plain subtype) (Schafale, 2012) will be the target community type and will be used for all areas within the Project. This community composition is highly diverse and is suitable given the Project's soil and landscape characteristics and will provide water quality and ecological benefits. The initial planting of bare root trees will occur before Spring 2023. The list of bare root tree species to be planted and their percentage of total species composition can be found in Table 3. Additionally, any live stake plantings as described in Section 4.2.4 will consist of black willow (Salix nigra) and silky dogwood (Corpus amomum). Table 3. Boundaries will be marked with signs identifying the property as a mitigation project and will include the name of the long-term steward and a contact number. Boundary markers disturbed, damaged, or destroyed will be repaired and/or replaced on an as needed basis. The easement boundary will be checked annually as part of monitoring activities and the conditions as well as any maintenance performed will be reported in the annual monitoring reports to DWR. The easement boundary will be marked before the DWR site visit for the Task 2 credit release. 5 MONITORING PLAN 5.1 Monitoring Protocol and Success Criteria Annual vegetation monitoring and visual assessments will be conducted. Riparian vegetation monitoring where riparian buffer mitigation credits are being generated will be based on the "Carolina Vegetation Survey -Ecosystem Enhancement Program Protocol for Recording Vegetation: Level 1-2 Plot Sampling Only Version 4.2". Annual vegetation monitoring will occur each year for a minimum of five years and will be conducted during the fall season with the first year occurring at least 6 months from initial planting. Monitoring plots will be installed a minimum of 100 meters squared in size and will cover at least two Shady Grove Mitigation Project Bank Parcel Development Package Riparian Buffer Mitigation and Nutrient Offset 13 July 2022 percent of the planted mitigation area. The planting area is 13.28 acres and there will be 11 vegetation plots measuring riparian buffer mitigation success. These plots will be randomly placed throughout the planted riparian restoration area and will be representative of the riparian community (Figure 9). The following data will be recorded for all trees in the plots: species, height, planting date (or volunteer), and grid location. All stems in plots will be flagged with flagging tape. The measures of vegetative success for the Project will be the survival of at least four native hardwood tree species, where no one species is greater than 50 percent of stems, at a density of at least 260 stems per acre at the end of Year 5. Native volunteer species may be included to meet the performance standards upon approval by DWR. Invasive and noxious species will be monitored and treated so that none become dominant or alter the desired community structure of the site. Photos will be taken at each vegetation plot each monitoring year and provided in the annual reports. Visual inspections and photos will be taken to ensure that applicable areas are being maintained and compliant. A visual assessment of the conservation easement will also be performed each year to confirm: • Easement markers are in good condition throughout the site; • no encroachment has occurred; • no invasive species occur in areas where invasive species were treated; • diffuse flow is being maintained in the conservation easement areas; and • there has not been any cutting, clearing, filling, grading, or similar activities that would negatively affect the functioning of the buffer. A summary of project monitoring and maintenance activities can be found in Table 5. Table 5. Vegetation maintenance activities will be documented and reported in annual monitoring reports. Vegetation maintenance will continue through the monitoring period. Invasive and Visual Nuisance Vegetation Assessment Invasive and noxious species will be monitored and treated so that none become dominant or alter the desired community structure of the Project. Locations of invasive and nuisance vegetation will be mapped. Boundary markers disturbed, damaged, or destroyed will be repaired and/or replaced on an as - needed basis. Easement monitoring and staking/ signage maintenance will continue in perpetuity as a stewardship activity. 5.2 Adaptive Management Plan and Project Maintenance Adaptive measures will be developed, or appropriate remedial actions taken if in the event that the site, or a specific component of the site, fails to achieve the defined success criteria. Remedial actions will be designed to achieve the success criteria specified in this Plan, and will include identification of the causes of failure, remedial design approach, work schedule, and monitoring criteria that will take into account physical and climatic conditions. Initial plant maintenance may include a one-time mowing, prior to initial planting to remove undesirable species. If mowing is deemed necessary by RES during the monitoring period, RES must first receive approval by DWR prior to any mowing activities to ensure that no buffer violations will be committed. Failure to receive approval to mow within the Neuse River buffer, as defined in Consolidated Buffer Rule 15A NCAC 02B .0714 by DWR, could result in Neuse River buffer violations and violations of the conservation easement. If necessary, RES will develop a species -specific control plan. Shady Grove Mitigation Project Bank Parcel Development Package Riparian Buffer Mitigation and Nutrient Offset 15 July 2022 6 LONG TERM MANAGEMENT PLAN The long-term stewardship plan for the site entails that the Project would be transferred to an approved conservation easement holder. EBX intends to assign this conservation easement to the North Carolina Department of Environmental Quality (NCDEQ) Stewardship program. The NCDEQ Stewardship program currently holds conservation easements for many North Carolina Division of Mitigation Service projects and is working to get approved as a conservation easement holder for DWR. The adjacent nature of these projects makes NCDEQ a good fit to manage both easements. In the unexpected situation that they are not approved, EBX will transfer the conservation easement to another approved easement holder. Once approved, NCDEQ Stewardship Program would serve as the conservation easement holder and entity responsible for long term stewardship of the Project. This party would conduct periodic inspection of the Project to ensure that restrictions required in the conservation easement are upheld. The NCDEQ Stewardship Program is developing an endowment system within the non -reverting, interest -bearing Conservation Lands Conservation Fund Account. The use of funds from the Endowment Account will be governed by North Carolina General Statute GS 113A-232(d)(3). Interest gained by the endowment fund may be used for the purpose of stewardship, monitoring, stewardship administration, and land transaction costs, if applicable. EBX, LLC will have a backup, in case stewardship with NCDEQ falls through. An engagement letter is being prepared and will be included in Appendix C once it is obtained. The Stewardship Program will periodically install signage to identify boundary markings as needed. Any livestock or associated fencing or permanent crossings will be the responsibility of the owner of the underlying fee to maintain. 7 FINANCIAL ASSURANCE The Sponsor will provide financial assurances in the form of Performance Bonds sufficient to assure one hundred percent (100%) completion of all mitigation work, required reporting and monitoring, and any remedial work required. Financial assurances will be payable at the direction of the DWR to its designee or to a standby trust. Financial assurances structured to provide funds to the DWR in the event of default by the Bank Sponsor are not acceptable. The initial performance bond will be in the amount of at least $150,000 and shall be able to cover 100% of the costs associated with construction of the riparian restoration areas. The monitoring bond shall be in the amount of at least $100,000 and shall be able to cover 100% of the costs associated with the monitoring and maintenance of the riparian restoration areas for five years. Performance bonds for monitoring shall be renewed to cover the next years monitoring period, with confirmation of renewal provided to DWR with each annual monitoring report when applicable. DWR reserves the right to alter the credit release schedule if monitoring reports are submitted without proof of bond renewals when applicable. Shady Grove Mitigation Project Bank Parcel Development Package Riparian Buffer Mitigation and Nutrient Offset 16 July 2022 8 MITIGATION POTENTIAL This Project has the potential to generate up to 82,575.900 ft2 (1.90 acres) riparian buffer mitigation credits and 25,777.945 Ibs of N for Nutrient offset credits (11.42 acres) within a 19.45-acre conservation easement as depicted in Figure 6. These will be derived from riparian buffer restoration. The riparian buffer mitigation credits generated will service the Neuse 01 watershed, Excluding the Falls Lake Watershed. Also, some of these buffer mitigation credits, where viable, can be converted to nutrient offset credit in accordance with the Nutrient Offset Credit Trading Rule, 15A NCAC 02B .0703. The total potential buffer mitigation credits and nutrient offset mitigation credits that the Shady Grove Mitigation Project will generate are summarized in Table 6 and the detailed Project credit breakdown, including buffer credits that are convertible to nutrient offset credit, utilizing the DWR "Project Credit Table Template (Updated February 2022),", is provided below. Furthermore, Figure 8 depicts riparian zones of 50, 100, and 200 feet from stream and ditch top of banks to demonstrate width requirements for crediting. There will be three credit ledgers for the project: Buffer Restoration, Buffer Preservation, and Nitrogen. Table 6. Site cannot be a Preservation Only site to comply with this rule. 3NC Division of Water Resources - Methodology and Calculations for determining Nutrient Reductions associated with Riparian Buffer Establishment 4Determinations made for this Site are determined based on the proposal provided in maps and figures submitted with the request. 5 All features proposed for buffer mitigation or nutrient offset, must have a planted conservation easement established that includes the tops of channel banks when being measured perpendicular and landward from the banks, even if no credit is viable within that riparian area. 6The area of the mitigation site on ephemeral channels shall comprise no more than 25 percent (25%) of the total area of buffer mitigation per 15A NCAC 02B .0295 (o)(7). Determinations provided in the table above were made using a proposed easement boundary showing proposed mitigation areas shown in Figure 3 and is initialed by Ms. Merritt on March 3, 2021. Other figures representing the proposal for the site in addition to Figure 3, are attached to this letter. Substantial changes to the proposed easement boundary could affect the Site's potential to generate buffer and nutrient offset credits. This letter does not constitute an approval of this Site to generate buffer and nutrient offset credits. Pursuant to 15A NCAC 02B .0295, a mitigation proposal and a mitigation plan shall be submitted to DWR for written approval prior to conducting any mitigation activities in riparian areas and/or surface waters for buffer mitigation credit. Pursuant to 15A NCAC 02B .0703, a proposal regarding a proposed nutrient load -reducing measure for nutrient offset credit shall be submitted to DWR for approval prior to any mitigation activities in riparian areas and/or surface waters. This will be accomplished through the planting, establishment, and protection of a hardwood forest community. The project area consists of row crop agriculture and minimal hardwood coverage. Surrounding site conditions include residential areas, agricultural land, and forest. This site is located north of the intersection of NC Highway 55 and Thunder Swamp Road, west of Mt Olive. The project area drains to Thunder Swamp in the Neuse River basin. Stream restoration projects often improve water quality and aquatic habitat. Establishing native, forested buffers in riparian areas will improve both aquatic and terrestrial habitats and provide a travel corridor for wildlife species. In addition to stringent best management practices for erosion and sediment control during construction, the NCWRC recommends the use of biodegradable and wildlife -friendly sediment and erosion control devices. Silt fencing, fiber rolls, and/or other products should have loose -weave netting that is made of natural fiber materials with movable joints between the vertical and horizontal twines. Silt fencing and similar products that have been reinforced with plastic or metal mesh should be avoided as they impede the movement of terrestrial wildlife species. Excessive silt and sediment loads can have detrimental effects on aquatic resources including destruction of spawning habitat, suffocation of eggs and clogging of gills.
