In accordance with the recently acquired Nationwide Permit #12 from the US Army
Corps of Engineers (USACE) for the subject project, and as requested by Mr. Chuck Cranford,
Assistant Regional Supervisor, Water Quality Regional Operations, Division of Water Resources
Asheville Regional Office, please accept the enclosed information in support of our request for a
modification to the existing 401 Water Quality Certification 20051216 for the subject project.
We have enclosed the following documents electronically on compact disc for your use:
• One (1) copy of the approved Nationwide 12 permit (Action ID 2010- 00378)
• One (1) copy of the Final Notice of Issuance and Conditions
• One (1) copy of a June 6, 2014 letter clarifying specific conditions in the NWP 12 permit
• One (1) Copy of the PCN form and attachments
• One (1) copy of the plans and sections for each individual impact in the NWP 12
• One (1) copy of the approved Biological Assessment dated January 17, 2014
• One (1) copy of the Biological Opinion dated May 28, 2014
Please note that we have already provided a hard copy of all of the above information to
Mr. Cranford for his use in reviewing this request.
We have also enclosed a check made payable to NCDENR in the amount of $540.000 for
the permit processing fee.
