Accordingly, we hereby forward the attached NPDES discharge permit. We issue this permit pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency (EPA) dated October 15, 2007 (or as subsequently amended). Changes for Renewal. The Division updated your permit in accord with permitting strategies (amended in 2009) for potable water treatment plants (WTPs) applying conventional WTP treatment technology. We have also updated your facility description and site map, and have added test -method parameter codes for your convenience [see Section A. (1.)]. Whole Effluent Toxicity (WET) Test Failures - Special Condition A. (4). The Division notes that this facility has failed 14 of 20 quarterly WET tests. This failure history suggests that this facility's wastewater may be harmful to the aquatic environment, and the cause(s) of failure must be identified. The Division therefore may reopen this permit, or request by letter that the Permittee take further action. This action may include additional metals testing, a Toxicity Identification Evaluation / Toxicity Reduction Evaluation (TIE/TRE), and additional evaluation of discharge alternatives and/or waste treatment alternatives [see Special Condition A. (4)]. A system -discharge evaluation should likely begin by establishing the receiving -stream flow and this facility's instream waste concentration (IWC), as the IWC relates directly to effluent dilution for WET testing. Modeling of the effluent dilution at this facility's point of discharge may allow for toxicity testing at a lower effluent concentration (the dilution concentration) which could result in passing the WET test. As of this permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements, terms, and provisions included herein. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS During the period beginning on the effective date of this permit and lasting until expiration, the Permittee is authorized to discharge from Outfall 001. Turbidity - Discharge from this facility shall not cause receiving -stream turbidity to exceed 50 NTU. If natural background turbidity exceeds 50 NTU, this discharge shall not increase receiving stream turbidity. 4. Parameter to be sampled concurrently with WET -test sampling. 5. Whole Effluent Toxicity (WET) testing conducted as Chronic [TGP3B] using Ceriodaphnia dubia, 7-day pass/fail @ 90% effluent concentration, during the months of February, May, August and November [see Section A. (2.)]. Conditions: • All samples collected shall accurately represent an effluent discharge event. • The Permittee shall discharge no floating solids or foam. • This permit includes a Special Condition regarding WET -test compliance [see Section A. (4.)]. Page 3 of 6 Permit NC0084425 A. (2.) CHRONIC TOXICITY PASS/FAIL MONITORING (QUARTERLY) The Permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent versions. The effluent concentration defined as treatment two in the procedure document is 90%. The testing shall be performed as a Ceriodaphnia dubia 7-day pass/fail test. The tests will be performed during the months of February, May, August and November. These months signify the first month of each three-month toxicity -testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Resources Environmental Sciences Section 1621 Mail Service Center Raleigh, N.C. 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of . the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. • Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required; the Permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year,of the report with the ....notation of."No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should -the Permittee fail to monitor during a month in which toxicity monitoring is required, then.monthly monitoringwill begin immediately. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above. Should .any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re -opened and modified to 'include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently than required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted. • NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. ELECTRONIC REPORTING - DISCHARGE MONITORING REPORTS Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and specify that, if a state does not establish a system to receive such submittals, then Permittees must -submit DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates that these regulations will be adopted and will begin implementing in 2013. NOTE: This special condition supplements or supersedes the following sections within Part II of this permit (Standard Conditions for NPDES Permits): • Section B. (11.) • Section D. (2.) • Section D. (6.) • • Section E. (5.) Signatory Requirements Reporting Records Retention Monitoring Reports 1. Reporting (Supersedes Part 11 Section D. (2.) and Section E. (5.) (a)1 Beginning no later than no later than February 28, 2015 (approximately 270 days from the effective - date of this permit), the Permittee shall begin reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted electronically using eDMR. The eDMR system allows permitted facilities to - enter monitoring data and submit DMRs electronically using the internet. Until such time that the state's eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation (CROMERR), Permittees will be required to submit all discharge monitoring data to the state electronically using eDMR and will be required to complete the eDMR submission by printing, signing, and submitting one signed original and a copy of the computer printed eDMR to the following address: NC DENR / DWR / Information Processing Unit ATTENTION: Central Files I eD MR 1617 Mail Service Center Raleigh, North Carolina 27699-1617 If a Permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver -from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1.1, 2, 3) or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the mailing address above. Requests for temporary waivers from the NPDES electronic reporting requirements must be submitted in writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required under this permit to begin using eDMR. Temporary waivers shall be valid for twelve (12) months and shall thereupon expire. At such time, DMRs shall be submitted electronically to the Division unless the Permittee re -applies for and is granted a new temporary waiver by the Division. Signatory Requirements [Supplements Part IL Section B. (11.) (b) and supersedes Section B. (11.) fin" All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II, Section B. (11.)(a) or by a duly authorized representative of that person as described in Part II, Section B. (11.)(b). A person, and not a position, must be delegated signatory authority for eDMR reporting purposes. For eDMR submissions, the person signing and submitting the DMR mast obtain an eDMR user account and login credentials to access the eDMR system. These records or copies shall be maintained for a period of at least 3 years from the date of the report. This period may be extended by request of the Director at any time [40 CFR 122.41]. A. (4.) PERMIT RE -OPENER - WHOLE EFFLUENT TOXICITY MONITORING Whole Effluent Toxicity (WET) monitoring results indicate that this surface -water discharge may be toxic to the aquatic environment. The Division of Water Resources therefore may reopen this permit, or request by letter that the Permittee take further action. This action may include additional metals testing, a Toxicity Identification Evaluation / Toxicity Reduction Evaluation (TIE/TRE), and additional assessment of discharge alternatives and/or waste treatment alternatives. However, discharge rates vary greatly over a five-year period (max.1.144 MGD; min. 0.001 MGD). The Permittee corrected the draft -permit number of filters [20 to 26], and added to document their use of ferric sulfate [Fe2 SO4]; see Supp. to Permit Cover Sheet. Summary of Renewal Changes: 1. Describe the treatment process(es) for raw water Water is pumped from the Yadkin River into our three storage reservoirs going to our upper lake first and then released to the far end of the southern reservoir through a 42" water line and then it is released into our middle reservoir giving us the longest settling time possible. If needed for algae control we add aluminum sulfate as it goes into the reservoirs. The water is pumped from our off stream storage reservoirs to the plant where we add chlorine dioxide, sulfuric acid if needed for PH control, and ferric sulfate for our coagulation process. Chlorine is added for disinfection and iron/manganese control. After coagulation and sedimentation the water is filtered through our 26 mixed media filters. After filtration we add additional chlorine for disinfection , fluoride for prevention of dental cavities, caustic or lime for PH stabilization and zinc orthophosphate for corrosion control. Water goes into our 5 mg clearwell through a baffling system and then distributed to our other clearwell storage and pumped into our distribution system. 8. Describe the wastewater and treatment process(es) for wastewater generated by the facility. Wastewater from the pulsators and sedbasins go into a sludge thickener and wastewater is decanted out of the thickener into the existing lagoons. Backwash water from the filters is going into the lagoons at present but will shortly be going into 500,000 gallon clearwell taken out of service and modified to handle filter backwash and become part of the treatment process. Water will be decanted out of 500,000 gallon containment into lagoons and sludge will be pumped out of containment into the sludge thickener. The decant water from lagoons is allowed to return to the Yadkin River after it has been dechlorinated using calcium thiosulfate. Flow to the Yadkin is measured and tested. 15. Solid Handling Plan Solids generated in the 500,000 gallon containment from filter backwash will be pumped into sludge thickener. Solids in sludge thickener is transferred to our lagoons and then are land applied by an approved outside source. EMA Reseources, Inc. has handled land application for the past several years. Davidson Water, Inc. permit #WQ0031712. We have recently sent in plans for a screw press to DENR and have received all approvals. We hope to have a screw press in operation within six months giving us the ability to take solids to the Davidson County Landfill or any approved landfill as long as solids are 15% or greater.
