In accordance with the application for discharge permit received on December 1, 1999, the Division is
forwarding herewith the subject state - NPDES permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and
the U.S. Environmental Protection Agency dated December 6, 1983.
The attached NPDES permit is for a proposed conjunctive use facility to be constructed on the current
site of the Leland Industrial Park WWTP discharging under NPDES permit number NC0065676. The
Division must receive a request for permit rescission for the aforementioned permit prior to startup of the
proposed facility permitted herein.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter
150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail
Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made. this permit shall be
final and binding.
This permit does not affect the legal requirements to obtain other permits which may be required by
the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act, or any other Federal or Local governmental permits which may be required.

SUPPLEMENT TO EFFLUENT LIMITATIONS
AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A (3). ACUTE TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY)
The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North
Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single
Effluent Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall be performed as a
Fathead Minnow (Pimephales promelas) 24 hour static test. The effluent concentration at which there may be
at no time significant acute mortality is 90% (defined as treatment two in the procedure document). Effluent
samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste
treatment. The tests will be performed January, April. July, and October.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed. using the parameter code TGE6C.
Additionally, DWQ Form AT-2 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30
days after the end of' the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the
effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste
stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required,
the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating
the facility name. permit number. pipe number, county. and the month/year of the report with the notation of
"No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences
Branch at the address cited above.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will
begin immediately until such time that a single test is passed. Upon passing. this monthly test requirement will
revert to quarterly in the months specified above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test
requirement will revert to quarterly in the months specified above.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and
modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will require
immediate follow-up testing to be completed no later than the last day of the month following the month of the
initial monitoring.

It is the facility's intent to reuse, initially, up to 0.31 MGD as golf course irrigation water. Additional reuse opportuniti
will be implemented as they become available. After reuse, the receiving stream will see a 7 lb/day decrease in permitti
load with that number increasing as reuse increases.

The three WWTPs that are slated to come off line when the NE Brunswick Regional facility is constructed are listed
below:
1) Leland Industrial Park WWTP (NC0065676)
2) Clairmont WWTP (NC0058599)
3) Creekside Townhomes WWTP (NC0064700)
No other WWTPs are within a reasonable proximity of the proposed regional facility except for Belville's plant.
Belville has been given every opportunity to participate, but has declined at this time. It is feasible to anticipate that
the Belville plant may be incorporated into the County's regional system at some point in the future, but it is not
included in current planning and design.

Mark,
I mentioned on the final permit file that I was looking for additional
documentation before signing off on this permit. Here's my concern:
We are dealing with Wilmington in this area and we have existing low
D.O. levels in the river. We have told Wilmington that we will grant
them an expansion with no increase in loading.
What I could see them saying is that we're being inconsistent by issuing
a permit to NE Brunswick County as it constitutes an increase in
loading. Therefore, I need the permit to document the change in loading
to the system if this permit is issued. I believe (a while back) Jason
may have done some work regarding this issue that showed there wouldn't
be much of an increase caused by this plant if several smaller plants
were "regionalized" by this system. Anyhow, the fact sheet needs to be
clear about this issue and we need to prepare the documentation for the
eventuality (and likelihood) that Wilmington's consultants (Jason,
namely) will review this file to look for inconsistencies in our policy.

SUMMARY
Brunswick County has applied for a conjunctive use permit at the site of the existing Leland Industrial Park
WWTP (NC0065676). The permit will permit the discharge of up to 1.65 MGD into the Cape Fear River.
However, the facility is intending to reuse up to 0.31 MGD of treated wastewater on a nearby golf course. As
other reuse opportunities arise, they will be implemented.
Effluent page A(1) is the limitations page for the discharge to the river while page A(2) is the limitations page
governing the reuse water.
TOXICITY TESTING:
Acute, Pass/Fail at 90% - ordinarily, given the dilution afforded by the receiving stream, a chronic toxicity
testing requirement would be installed. Matt Matthews with Aquatic Toxicology was consulted regarding the
toxicity testing requirement. He recommended that an acute test be installed given the tidal nature of the
receiving stream flow.
COMPLIANCE SUMMARY:
This is a new facility. There is no compliance history.
INSTREAM MONITORING:
Instream monitoring is required for fecal coliform, dissolved oxygen, temperature and conductivity at the
locations of the existing Leland discharge.

FINDING OF NO SIGNIFICANT IMPACT (FNSI)
Title VI of the amended Clean Water Act requires the review and approval of environmental
information prior to the construction of publicly -owned wastewater treatment facilities
financed by the State Revolving Fund (SRF). The proposed project will be financially
supported by a loan from the SRF, as well as additional funding sources listed below. The
project has been evaluated for compliance with the North Carolina Environmental Policy
Act and determined to be a major agency action which will affect the environment.

conjunctive permit allowing a discharge when reuse
(irrigation and/or cooling) is not a viable option. Install a
collection and transport system (gravity lines, force mains,
and lift stations) to serve the towns of Leland and Navassa
and the NBSD.
Total Project Cost; $27,140,468
Project Funds: Funding sources will consist of an EPA Hardship Grant,
State Revolving Fund, Clean Water Bonds, and local funds.
The review process indicated that significant adverse environmental impacts should not
occur if mitigative measures are implemented, and an environmental impact statement (EIS)
vvili not be required. The decision was based on information in the facilities plan, a public
hearing document, and reviews by governmental agencies. An environmental assessment
supporting this action is attached. This FNSI completes the environmental review record,
which is available for inspection at the State Clearinghouse.
No administrative action will be taken on the proposed project for at least thirty days after
the FNSI has been published in the North Carolina Environmental Bulletin.

ENVIRONMENTAL ASSESSMENT
A. Proposed Facilities and Actions
Figure 1 provides a general description of the project area- Figures 2a-2d indicate more
specific locations of the proposed collection/transport and treatment facilities.
collection/Transport Facilities. The NBSD, towns of Leland and Navassa, and Brunswick
County will be responsible for the installation of collection/transport facilities to convey the
wastewater to a regional treatment plant. The NBSD and Brunswick County will be
responsible for providing collection/transport facilities for those areas that are outside the
town boundaries for Leland and Navassa. The sewer facilities for the NBSD will include
approximately 136,486 1.f. of 8- to 12-inch interceptors, 500 manholes, 16 lift stations with
generators, and 54,006 1.f. of 4- to 8-inch force mains. The town of Leland will provide a
collection/transport system consisting of 63,4101.f. of 8- to 12-inch gravity sewers, 337
manholes, 4 lift stations with generators, and 4,285 1.f. of 4-inch force mains. Navassa will
install 45;961 1.f. of 8- to 10-inch gravity sewers and 167 manholes, 4 lift stations with
generators, and 5,7281.E of 4-inch force mains. Brunswick County will install common
collection facilities consisting of 1,300 1.f. of 8-inch gravity lines, 7 manholes, 3 lift stations
with generators, and 7,4351.f of 4- to $-inch.force mains. Brunswick County will also be
responsible for installing 23,170 1.f. of 16-inch force main to convey the reclaimed water to
the sources for spray irrigation and/or coaling.
Treatment Facilities. This portion of the project will include constructing a 1.65 mgd
activated sludge treatment facility. Treatment components will include headworks
consisting of screening and grit removal equipment along with a flow measuring device, a
three -stage anaerobic basin and dual oxidation ditches to provide activated sludge treatment
and biological nutrient removal, dual clarifiers, continuous backwash upflow sand filters,
and an ultraviolet disinfection system. Additional requirements will consist of yard piping,
instruments, electrical controls, site preparation, and supplemental standby power. A
conjunctive permit will allow the treated effluent to be used primarily for golf course
irrigation and industrial applications. The effluent will be discharged into the Cape Fear
River when circumstances preclude the treated wastewater from being reused. Compliance
with 40 CFR, Part 503 will be achieved via thermophilic aerobic digestion of the sludge.
Production of Class A biosolids will permit the distribution of the soil enhancing product to
governments, homeowners, and landscape companies.

B. Existing Environment
Topography a,d Soils. The service area covers a portion of Brunswick County, the towns
of Navassa and Leland, and the areas outside the two towns that are under the jurisdiction of
the NBSD. Elevations range from sea level to 45 feet above mean sea level. Soil series
include upland soils that are suitable for development to hydric soils that are unsuitable for
septic tank drainfields. Soil suitability has been identified as the most important constraint
to development. A high water table and flood -prone areas are also factors that restrict
development throughout Brunswick County.
Surface W_ __a*er. Brunswick County is located in the Cape rear River Basin. The Brunswick
and Cape Fear Rivers, both Class SC, are the major streams in the area. Storgon, Jackeys
and Mill Branch Creeks are minor streams with C-CW designation. Cartwheel Branch is
another minor stream with a designation of Class SC -SW. There are three wastewater
treatment package plants (Leland Industrial Park, Clairmont, Creekside Townhomes) with
discharges to surface waters in the area. Biological sampling in the lower Cape Fear River
has shown the water to have significant amounts of habitat utilized as nursery areas by a
wide variety of aquatic organisms. Instream monitoring data indicate the lower Cape Fear
River is subject to regular occurrences of dissolved oxygen Ievels that are below the state's
water quality standard of 5.0 rngll. The data also show that violations are often sustained for
extended periods during the summer.
Water Supply. Potable water is supplied primarily to the area by the NBSD.
C. Existing Wastewater Faciliti
The existing area is comprised of approximately 21 square miles and includes the towns of
Leland and Navassa, a portion of Brunswick County, and unincorporated areas following the
boundaries of the NBSD. With the exception of the 0.027 mgd package treatment plant,
which serves 26 townhomes with one gravity sewer and an effluent discharge into Jackeys
Creek, on -site systems are utilized to handle residential wastewater in northeastern
Brunswick County. The 0.10 mgd Clairmont package plant receives wastewater fromi25
commercial establishments, and the effluent is pumped to the Brunswick River. The Leland
Industrial Park operates a package treatment plant at a reduced capacity of 0.05 mgd, and the
effluent is discharged into the Cape Fear River.

D. ntd_floffiraps1 ctions
Brunswick County's appeal to seasonal visitors and permanent residents has resulted in an
annual average population growth rate of approximately 3.7 percent since 1970. This type
of growth is projected to continue in, the future. Almost all of the residential developments
rely upon septic tanks and nitrification drainfields to process the wastewater. In spite of the
rapid growth in the area, the Brunswick County Board of Health has indicated that
approximately 95 percent of the area has limitations which include the presence of a high
water table, restrictive horizons, and a poor soil structure. There are a significant number of
failing septic tanks in some locations, and the lack of action represents a threat to water
quality and public health. Additionally, the package treatment plants will be eliminated to
improve water quality. Therefore, the proposed regional collection/transport and treatment
system needs to be constructed to provide an adequate method of processing wastewater that
will be reclaimed for irrigation and cooling purposes. If a situation arises in which the
treated effluent cannot be reclaimed, the NPDES permit will allow the effluent to be
discharged into the Cape Fear River. Speculative effluent limitations (summer/winter) for
the proposed treatment plant are BOD5 5/10 mg/1, TSS=30 mg/1, NH3-N—I/2 mg/1, Fecal
Coliform=200/100 ml, Dissolved Oxygen=5 nagl1, pH=6.0-9.0 SU, and Residual
Chlorine-13 /4l. Toxicity monitoring will be undertaken to assure protection of surface
waters.
E. Alternatives Analysis
The various participating local units of government desire to develop a regional
collection/transport and treatment system to eliminate a potential public health problem and
to protect water quality. Accordingly, a facilities plan was prepared and several alternatives
were evaluated. The "no -action" alternative would require continued use of septic tank
drainfields in poor soils and package treatment plants with surface discharges. This
alternative is unacceptable. An optimum operation will not achieve the desired objective
because adequate collection and treatment facilities are not available to accommodate the
existing and projected population. An evaluation of collection methods consisted of a septic
tank effluent pump (STEP) system and a conventional gravity sewer system. The preferred
choice is to install a gravity sewer collection system and transport the wastewater throughout
the system with the necessary lift stations. The next step in the evaluation of alternatives
was to select the most cost-effective method of treating the wastewater. Consideration was
given to collecting the wastewater from the various areas and installing a force main to
transport the flow to one of Wilmington's treatment plants. This alternative was rejected
because the city of Wilmington would haw to make substantial changes in constructing
treatment capacity to accommodate the flow from northeastern Brunswick County. A land

application system was investigated and determined not to be the most feasible solution for
processing wastewater in the area. Another alternative consisted of constructing a treatment
plant with a surface discharge. This alternative was not the preferred option since a reusable
resource would not be available for beneficial purposes. A final alternative consisted of
constructing a tertiary treatment plant with a conjunctive permit allowing a discharge into
the Cape Fear River when the treated effluent cannot be reclaimed for irrigation and/or
cooling purposes. This is the selected alternative.
F. E nviron►meutal Consequences, N_ its' ative Measures
Approximately 95 percent of the proposed collection/transport system will be installed along
existing street and road rights -of -way. The remaining segments will traverse upland and
swamp forests, marsh areas, and cultivated fields and lawns. Construction of the proposed
sewer lines will require clearing approximately 4.58 acres of forested land. Sewer line
construction activities will also require stream crossings at 28 sites. Seven of the stream
crossings are off -road and the remaining are roadside crossings, The proposed regional
treatment plant will be located adjacent to the existing Leland Industrial Park treatment
plant. Approximately four acres of a five -acre tract will be cleared of pine dominated mixed
hardwood forest to construct the regional treatment plant. The Department of Cultural
Resources has determined that the proposedproject should not have an adverse impact on
architectural, historical, and archaeological resources. The U.S. Fish and Wildlife Service
has been provided additional information about the potential impact of the proposed project
on threatened and endangered species. The Service concurs that the requirements of Section
7 of the Endangered Species Act have been met. The proposed project will have a minimal
impact on wetlands. Installation of the proposed facilities will be covered under a
Nationwide permit to be issued by the U.S. Army Corps of Engineers. The Division of
Coastal Management must also evaluate a permit to address the potential impacts to areas of
environmental concern. The Division of Forest Resources does not object to the proposed
project. North Carolina's Wildlife Resources Commission (WRC) evaluated the proposed
plan and requested additional information about the potential impacts to fish and wildlife.
Accordingly, WRC requested that the following recommendations be implemented, where
applicable, for minimizing direct adverse impacts to fish and wildlife resources:
1. Stream and wetland crossings should be perpendicular to streams and located at the
nearest points possible.
2. Sewer lines at stream crossings should be elevated on bridges or piers when possible.

3. Disturbed wetlands should be returned to the original contours and the sites should be
planted with wetland vegetation.
4. Sewer line construction in wetlands should be avoided during the growing season to
the maximum extent practicable.
The Wildlife Resource Commission also expressed some concerns about the secon4ary and
cumulative effects of the proposed project. Brunswick County, towns of Leland and
Navassa, and the NBSD have agreed to the following:
1. Acquire the small sandhill community that provides habitat for the gopher frog and
the northern pine snake and utilize the land as a park or natural area.
2. Develop and implement a stormwater management plan for the service area.
3. Investigate the feasibility of adopting programs and ordinances to protect stream
corridors and riparian buffers.
4. Develop a growth management plan, unified development ordinance, engineering
standard specifications, and water supply watershed ordinance, as described in
Section 5.3 of the Environmental Assessment (EA) dated May 28, 1999 and prepared
by Robert J. Goldstein & Associates, Inc.
Brunswick County will take the lead role in being responsible for providing the WRC with
appropriate documents that demonstrate actions to control secondary and cumulative
environmental impacts.
G. tic Participation, Sources Consulted
A public hearing was held March 22, 1999 to discuss the proposed project. The hearing
covered problems of the existing septic tank systems, existing problems with the package

facilities, user charges for the selected alternative, methods of effluent disposal, and the
responsibility of each unit of government for operating the regional collection and treatment
system. No opposition to the proposed project has been expressed. A typical NBSD
customer using 5,000 gallons of water will pay approximately $41.00 per month for sewer
service. A typical customer from the towns of Leland and Navassa will pay monthly
approximately $43.00 and $35.00, respectively.
