Dear Mr. Roberts:
Division personnel have reviewed and approved your application for renewal of the
subject permit. Accordingly. we are forwarding the attached NPDES discharge permit. The
Division has considered the concerns and comments made during the 30-day public notice
period and have modified the permit according to current Division policy. Responses to
comments and concerns are explained below:
Comment 1: As of March 8, 1999, Carolina Solite Corporation changed their legal name to
Solite Corporation. Solite Corporation requested that references to Carolina Solite in the
NPDES permit be changed to Solite Corporation.
Response: The name Carolina Solite Corporation has been modified to reflect the current legal
name of the permit holder.
Comment 2: The existing permit also designates the Rocky River as receiving waters.
However, this designation has been deleted from the draft permit. Solite Corporation inquired
as to how this affects the discharge from outfall 002, which discharges into Long Branch.
Response: Since outfall 002 discharges into Long Branch and not Rocky River, this
designation was removed from the permit. Solite Corporation is permitted to discharge quarry
dewatering wastewater into Long Branch, according to the conditions set forth in the NPDES
permit (NC0028169).
Comment 3: Solite Corporation request that the Supplement to Permit Cover Sheet be
modified to clarify the continued operation of the quarry dewatering system.
Response: The Supplement to Permit Cover Sheet has been modified accordingly.
Comment 4: Solite Corporation request that total suspended solids, chromium, and
manganese samples be grab.
Response: A review of the rate of discharge indicated that the flow from the facility is highly
intermittent and unpredictable. The yearly monthly average for flow was 0.0 MGD, 0.55 MGD,
0.21 MGD and 0.0 MGD for the period 1999 through 1996, respectively. The Division agrees
that composite sampling may place an undue hardship on the facility, therefore the total
suspended solids, chromium, and manganese sample type has been modified to permit grab

samples. However, grab samples must be taken within 30 minutes from when the discharge
begins.
Comment 5: Solite request that the sample type for acute toxicity monitoring also be modified
to permit grab samples.
Response: This was an error in the draft permit. Additionally, upon review it was determined
that the facility has conducted five toxicity tests with LC50 values greater than 100%.
Therefore, the frequency of acute toxicity testing has been modified to annual monitoring.
Comment 6: Solite request clarification regarding total suspended residue.
Response: Solite is correct total suspended residue is synonymous with total suspended
solids. The parameter code for total suspended solids is 00530.
Comment 7: Solite request deletion of conductivity monitoring, since there has been no
change in the permitted facility.
Response: Reported conductivity data was reviewed, since the downstream conductivity data
does not show elevated values conductivity monitoring has been removed from the permit.
This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this
permit are unacceptable to you, you have the right to an adjudicatory hearing upon written
request within thirty (30) days following receipt of this letter. This request must be in the form
of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and
filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The
Division may require modification or revocation and reissuance of the permit. This permit
does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal
Area Management Act or any other Federal or Local governmental permit that may be required.

3. The effluent shall not cause the turbidity of the receiving stream to exceed 50 NTU. If
natural background conditions in the receiving stream (upstream) are greater than 50
NTUs then the effluent shall not cause an increase in the turbidity of the receiving stream.
4. The temperature of the effluent shall not cause an increase in the temperature of the
receiving stream of more than 2.8 °C and in no case cause the ambient water temperature
to exceed 32 °C.
5. The pH of the effluent shall be with the range of 6.0 to 9.0 on the standard pH scale.
BMP Conditions
1. The permittee shall operate the facilities in a manner, which will minimize the impact on
the receiving water.
2. The permittee shall utilize sound management practices to ensure that contaminants do
not enter the surface waters as a result of blasting at the site.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

Part I A(2.) ACUTE TOXICITY MONITORING (ANNUAL)
The permittee shall conduct annual toxicity tests using protocols defined as definitive in E.P.A. Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine
Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test.
Effluent samples for self -monitoring purposes must be obtained below all waste treatment. The permittee will
conduct one test annually, with the annual period beginning in January of the calendar year of the effective date of
the permit. The annual test requirement must be performed and reported by June 30. If no discharge occurs by June
30, notification will be made to the Division by this date. Toxicity testing will be performed on the next discharge
event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit condition will
be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate
parameter code. Additionally, DWQ Form AT-1 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30 days
after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in
association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity
sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of
Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to
include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
suivival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-
up testing to be completed no later than the last day of the month following the month of the initial monitoring.

Our office has received the draft permit for the subject facility which was issued
February 16, 2000. Upon review of this draft, we noted that the sample type for toxicity
was incorrect. The effluent limitations page should be changed to show that grab samples
will be collected for acute toxicity. This would be consistent with the sample type that is
permitted for episodic discharges. Another error in this draft was the testing frequency for
acute toxicity. This facility has already performed five toxicity tests which resulted in
LC50 values greater than 100%. Therefore, our office recommends changing Part I A(2)
to reflect annual testing for acute toxicity. Please find attached the correct toxicity
language to use in this permit.

Dear Mr. Myers:
Solite reviewed the above -referenced draft permit and offers the following
comments for consideration:

i) Please revise all references to Carolina Solite Corporation to
reflect the current legal name of the facility, Solite
Corporation. Attached to this letter is a copy of the March 8,
1999 letter from Mr. Steven M. Diniaco, Solite Corporation,
Vice President to the Director of the Division of Water
Quality which provides notification of the facility's legal
name change.
ii) The existing permit also designates the Rocky River as
receiving waters. However, this designation has been deleted
from the draft permit. Please clarify that this deletion in no
way affects the discharge from quarry dewatering (outfall 002)
into the Long Branch which is an influent stream into the
Rocky River.

For clarity, please revise the text to specifically reflect the continued
operation of an existing quarry dewatering system, as is currently

Effluent Limitations and Monitoring Requirements
i) On February 9, 2000, Mr. Roberto Scheller (NCDENR-DWQ-MRO) conducted a
Compliance Evaluation Inspection in accordance with the facility's existing
NPDES permit. During the inspection, Mr. Scheller suggested that it would be
more practical for Solite to collect grab samples, rather than composite samples,
for total suspended solids, chromium and manganese given the limited quarry
dewatering by Solite. Therefore, Solite requests that the sample type for these
three effluent characteristics be changed from composite to grab.
ii) Solite requests that the sample type for acute toxicity be revised to reflect a grab
sample type which is consistent with the current permit.
iii) Total Suspended Residue is listed as an effluent characteristic. Please advise as to
whether or not this is the same parameter as Total Suspended Solids, and if the
same parameter code, 00530, will be used on the Effluent Discharge Form (MR-
1).
iv) There has been no change in the permitted facility. Therefore, please delete the
additional requirement to sample for conductivity at the effluent from the permit.

SUMMARY
Carolina Solite originally had two permitted outfalls. Outfall 001 discharged treated process wastewater and
outfall 002 discharged quarry dewatering wastewater. Outfall 001 was highly contested and the facility has
since eliminated outfall 001 by recycling 100% of their process wastewater. Outfall 002 is still being
maintained by the facility and has episodic discharges. In 1996 and 1999 the facility had no discharge through
outfall 002. In 1997 and 1998, there were limited discharges resulting in four sampling events.
Outfall 002 discharges into Long Branch, which is a class C water in the Yadkin -Pee Dee River Basin.
Upstream of the discharge, Long Branch has been rated as partially supporting of its designated uses and the
Division is in the process of evaluating the identity of the problem parameter(s). However, the reach of the
stream where outfall 002 is located has been rated as supporting of its designated uses.

COMPLIANCE SUMMARY:
No compliance problem for the limited number of discharges over the past four years.
INSTREAM MONITORING:

North Carolina Environmental Management Commission proposes to issue a
National Pollutant Discharge Elimination System (NPDES) wastewater

General Information
The facility originally maintained two outfalls 001 and 002. At the last renewal outfall
001 was removed from the permit, since the facility recycles all process wastewater.
Quarry dewatering wastewater is discharged through outfall 002. The permittee is
requesting renewal of NPDES permit NC0028169 for outfall 002. According to a note
from Coleen to Steve Tedder, the facility wants to maintain outfall 002 in order to
manage extreme stormwater events. According to Mike Parker's Staff Report the
treatment facility does not have any treatment capabilities.

PART IV - EVALUATION AND RECOMMENDATIONS
Carolina Solite Corporation (CS) has applied for renewal of the subject permit. There
have been no changes to the current operation/discharge, which involves the dewatering of the
quarry pit where the slate/shale used in the manufacturing process is excavated. All process
wastewater, generated from the use of wet scrubbers that remove particulate from four kilns used
in light weight aggregate production, is being recycled and reused in the plant. All other
contaminated water generated at this site is processed through a recycle pond that is covered
under Permit No. WQ0003150.
It is recommended that the permit be reissued as requested.
