After confirming with Michael Turchy ( NCDOT ECAP group), in situations where there is habitat for federally protected plant species but a survey does not detect that species, the Biological Conclusion for that scenario will be No Effect. Therefore, for the 3 projects where habitat for small whorled pogonia was noted but no plants of that species were observed, the Biological Conclusions are No Effect. I am working on the survey memos today. Site BC Habitat Present Rambling Road No Effect No Running Creek No Effect Yes High Rock Road No Effect Yes Ingold Road No Effect Yes I apologize for the earlier confusion . USFWS Asheville office has a different opinion and aquatic species are evaluated differently as well . Please let me know if you have any questions. Again, sorry for the confusion . Take care, Neil
