Jerry,
I just wanted to follow up after our phone conversation . After confirming with Michael Turchy ( NCDOT ECAP group), in
situations where there is habitat for federally protected plant species but a survey does not detect that species, the
Biological Conclusion for that scenario will be No Effect. Therefore, for the 3 projects where habitat for small whorled
pogonia was noted but no plants of that species were observed, the Biological Conclusions are No Effect. I am working
on the survey memos today.

Running Creek No Effect Yes
High Rock Road No Effect Yes
Ingold Road No Effect Yes
I apologize for the earlier confusion . USFWS Asheville office has a different opinion and aquatic species are evaluated
differently as well . Please let me know if you have any questions. Again, sorry for the confusion .
