We received your request to withdraw your application for an NPDES Stormwater Permit to
discharge stormwater associated with industrial activities on December 16, 2012 You report that
industrial activities subject to NPDES permitting regulations ceased at this plant as of November 8,
2012, and that discharges from inactive coal ash basins on the property are not possible in events
smaller than the 25 -year, 24-hour storm.
Based on your report, we concur that an NPDES stormwater discharge permit is not applicable
unless activities or circumstances at this site change Should the potential for such discharges arise
at the Cape Fear Plant, the company must apply for an NPDES discharge permit. If you have any
